Subrecipient shall. (1) deliver individualized services as defined by Part C of IDEA to all eligible children who reside within the boundaries of the identified service delivery area(s); (2) perform services in accordance with all pertinent State and Federal statutes, rules, and regulations, including but not limited to: (A) IDEA; (i) Part C; and (ii) P.L. 108-446 (regulations in 34 CFR 303); (B) Utah Administrative Rules R402-1; (C) Department policies, as provided on the Department’s website; (D) The Education Department General Administrative Regulations (34 CFR Parts 76 and 79); (E) 2 CFR Part 200; (F) requirements communicated by BWEIP during calls, trainings, webinars, or via email; and (G) all provisions, attachments, and requirements of this contract; (3) provide every family of an enrolled child with a login ID to access the BWEIP Billing and Payment System to complete the Family Fee application; (4) educate all families who have children enrolled in early intervention about procedural safeguards, including to inform and educate about rules, responsibilities, and dispute resolution options that are available to them to protect the interests of their family and child(xxx) who participate in the Part C of IDEA system. (5) provide individualized services as described in each child’s IFSP on a 12-month basis in accordance with the Department's Eligibility Criteria policy, which includes, but is not limited to, providing services for at least 12 months, at which time ongoing eligibility is determined: (A) use the standardized state required tool, Battelle Developmental Inventory, 3rd edition, as part of determining eligibility and child outcomes measurements; (i) at a future identified date, programs will be required to score the BDI-3 evaluation electronically using the Mobile Data Solution; and (ii) local early intervention programs will be responsible for purchasing BDI-3 materials for their program; (B) utilize the state ASQ online system to complete: (i) ASQ-SE at time of intake with all children; and (ii) ASQ-3 at time of the child’s periodic IFSP review (6) require and ensure that Subrecipient’s personnel: (A) participate and pass required training and activities as outlined in the BWEIP CSPD policy; (B) possess the Early Intervention Specialist credential as outlined in the CSPD Policy; (C) are currently licensed in good standing according to the requirements of their profession; and (D) obtain a Utah BCI criminal background check: (i) ensure background checks are...

You agree to have a binding written agreement with Your Service Provider with terms at least as restrictive and protective of Apple as those set forth herein.   • The Contractor must 16.1.1. treat all Authority Protected Information as confidential and safeguard it accordingly, implementing appropriate technical and organisational measures to protect Authority Protected Information against disclosure; 16.1.2. only use the Authority Protected Information for the purposes of performing its obligations under the Framework Agreement; 16.1.3. only disclose the Authority Protected Information to such Contractor Representatives that are directly involved in the performance of the Framework Agreement and need to know the information; and 16.1.4. not disclose any Authority Protected Information without the prior written consent of the Authority.

  • Contractor Key Personnel ‌ The Contractor shall assign a Corporate OASIS SB Program Manager (COPM) and Corporate OASIS SB Contract Manager (COCM) as Contractor Key Personnel to represent the Contractor as primary points-of-contact to resolve issues, perform administrative duties, and other functions that may arise relating to OASIS SB and task orders solicited and awarded under OASIS SB. Additional Key Personnel requirements may be designated by the OCO at the task order level. There is no minimum qualification requirements established for Contractor Key Personnel. Additionally, Contractor Key Personnel do not have to be full-time positions; however, the Contractor Key Personnel are expected to be fully proficient in the performance of their duties. The Contractor shall ensure that the OASIS SB CO has current point-of-contact information for both the COPM and COCM. In the event of a change to Contractor Key Personnel, the Contractor shall notify the OASIS SB CO and provide all Point of Contact information for the new Key Personnel within 5 calendar days of the change. All costs associated with Contractor Key Personnel duties shall be handled in accordance with the Contractor’s standard accounting practices; however, no costs for Contractor Key Personnel may be billed to the OASIS Program Office. Failure of Contractor Key Personnel to effectively and efficiently perform their duties will be construed as conduct detrimental to contract performance and may result in activation of Dormant Status and/or Off-Ramping (See Sections H.16. and H.17.).

  • Contractor Project Manager The Contractor Project Manager shall serve, from the Effective Date, as the Contractor project manager and primary Contractor representative under this Agreement. The Contractor Project Manager shall (i) have overall responsibility for managing and coordinating the performance of Contractor’s obligations under this Agreement, including the performance of all Subcontractors; and (ii) be authorized to act for and bind Contractor and Subcontractors in connection with all aspects of this Agreement. The Contractor Project Manager shall respond promptly and fully to all inquiries from the JBE Project Manager.

  • Third Party Vendors Nothing herein shall impose any duty upon DST in connection with or make DST liable for the actions or omissions to act of the following types of unaffiliated third parties: (a) courier and mail services including but not limited to Airborne Services, Federal Express, UPS and the U.S. Mails, (b) telecommunications companies including but not limited to AT&T, Sprint, MCI and other delivery, telecommunications and other such companies not under the party’s reasonable control, and (c) third parties not under the party’s reasonable control or subcontract relationship providing services to the financial industry generally, such as, by way of example and not limitation, the National Securities Clearing Corporation (processing and settlement services), Fund custodian banks (custody and fund accounting services) and administrators (blue sky and Fund administration services), and national database providers such as Choice Point, Acxiom, TransUnion or Lexis/Nexis and any replacements thereof or similar entities, provided, if DST selected such company, DST shall have exercised due care in selecting the same. Such third party vendors shall not be deemed, and are not, subcontractors for purposes of this Agreement.
