The Council’s Responsibilities. In addition to the commitments contained in this Agreement, the Council is responsible for all maintenance aspects of buildings not listed as being the school’s responsibility in section 2.3 of this Agreement. The Council’s Responsibilities. (a) The Council must repair and maintain:  the structure and exterior of the building (including roofing, walls, floors, ceiling, windows and window frames, external doors, drains, gutters and outside pipes)  kitchen and bathroom fixtures (including sinks, basins, toilets, baths and unless the Council agrees otherwise, kitchen units)  electrical wiring  gas pipes  water pipes  fixed heating equipment  water heating equipment  any communal areas around your home (including, stairs, lifts, landings, lighting, entrance halls, paving and parking areas). (b) The Council must paint the outside of your home at regular intervals. (c) The Council must clear up after a repair. (d) The Council must do repairs within a reasonable time of the repair being reported to the Council. The Council is not responsible: (a) For any damage or disrepair to your home caused deliberately by you or any person living with you or visiting you, or by your own neglect or carelessness. If the Council repairs such damage you may be charged for the cost of the repairs. (b) For rebuilding or reinstatement of your home if it is destroyed or damaged beyond economic repair, by fire, flood or any other accident. (c) For repairing or maintaining anything which you are entitled to remove from your home at the end of your tenancy. (d) For repairing or maintaining anything, which you have built, fitted or installed without written permission from the Council. (e) For repairing and maintaining smoke alarms fitted by the Council as these do not form part of the structure.

The Council’s Responsibilities. 11.1 The Council shall: 11.1.1 co-operate with the Trust and provide it with such information and assistance as it shall reasonably require to enable it to perform the Trust’s Obligations; 11.1.2 ensure that key personnel are available to assist the Trust when reasonable notice is given by the Trust of this requirement; 11.1.3 ensure that it has in place all necessary and appropriate internal Council consents and approvals, in order to enable the Trust to perform the Trust’s Obligations (but such that, for the avoidance of doubt, nothing in the Agreement shall oblige the Council to obtain a Third Party approval in relation to the rights granted under the Agreement) subject to the Council requiring to secure the consent of the Keeper of the Records of Scotland under the Local Government etc (Scotland) Xxx 0000 section 53 which the Council is required to do and exhibit to the Trust. 11.1.4 consult with the Trust and have due regard to its professional advice prior to altering, supplementing or replacing any of the Policies, Codes of Ethics or Standards which the Council has the right to alter in relation to the Agreement. 11.1.5 The Council shall not acquire items for inclusion in the Collections and the Libraries’ Collection or dispose of items in the Collections and the Libraries’ Collection without the agreement of the Trust, not to be unreasonably withheld; and 11.1.6 The Council acknowledges that the main source of advice on the Collections and the Libraries’ Collection and on heritage matters will be the Trust and its professional staff, and will not act on these matters without prior consultation with the Trust. The Council’s Responsibilities. The Council will: a) if it has not already done so by the date of this Agreement shall as soon as reasonably possible following the date of this Agreement do all things necessary to authorise the Agency to use its powers under the LDA 1991 to enable the Agency to carry out the works comprised in the Project either by itself or through the engagement of a contractor or contractors; b) provide its Project Manager; c) provide its Deliverables as set out in Schedule 1; d) make its Contribution as set out in Schedule 2 and pay any amounts set out in any invoice from the Agency issued under Schedule 2, on 30 day payment terms; e) ensure that it has appropriate financial and auditing procedures in place to manage its involvement in the Project; f) ensure that it has complied with all its tax requirements in connection with the Project and its Contributions; g) retain Project records for not less than six (6) years after the Term ends; h) ensure that sustainable development (which includes environmental, social and economic factors) is taken into account in all stages of the Project and Schemes thereunder and in any relevant contracts with third parties; i) provide access to its Background Rights for the purposes of carrying out the Project and in accordance with the licence terms set out in Clause 12 below; and j) ensure information is provided in order to achieve approval for Schemes within the Project and notify the Agency which Schemes are approved in a timely manner in order for Contributions to be allocated towards a particular Scheme in future financial years.

If a Young Person is in breach of the terms of the agreement, the following stages are instigated: Failure to comply with this warning would result in a Stage Three letter which would detail a period of 14 days to evidence improvement or the instigation of 28 days’ notice to leave the property. 8.8 Notifying the Owner of any need for repairs or maintenance for which the Owner is responsible reasonably promptly after becoming aware of the need. 8.9 Upon at least 24 hours’ notice from the Owner provide access to the Property (within normal office hours) and be present at the Property with the Owner (if necessary) when such access is provided. In cases of emergency the Owner, and others authorised by it, will be provided with immediate access. 8.10 Advise the Occupants that their personal items and effects are not insured and that the Occupants should take out insurance to cover them. 8.11 Reimburse the Owner for the cost of any repairs necessitated by any act or omission of the Council. 8.12 Report to the police any criminal damage at the Property and obtain a crime reference number. 8.13 Give all necessary assistance to the Owner at all reasonable times to enter and examine the condition of any part of the Property to enable the Owner to exercise its functions as owner of the Property. 8.14 Not make or permit any alteration to the Property without the prior...
