Timing of annual leave. (a) An Employee must take annual leave during a shut down period. A shut down is defined as a period where the Employer shuts down the business, or any part of the business, in which the Employee works. (b) Where an Employee has not accrued sufficient annual leave to be taken during the shut down period, the Employee is entitled to leave which will be unpaid. (c) An Employee who works Term weeks only must take annual leave during Non- term weeks. Leave must generally be taken, in the case of an Employee whose employment is continuing into the next school year, in the five (5) week period immediately following the final term week of the current school year, unless otherwise agreed with the Employer.

An Employee with an entitlement to more than five weeks annual leave, or to leave without pay under cl.33 are required to take annual leave during non-term weeks.
