Travel Plan. The Owner covenants:
2.1 Prior to Occupation of the Development:
2.1.1 to pay the Travel Plan Evaluation and Support Contribution;
2.1.2 to submit a draft Travel Plan for written approval to the County and obtain such approval and for the avoidance of doubt the Travel Plan shall be based on and accord with the Travel Plan Guidance and shall further contain as many of the provisions of the Travel Plan Guidance as in the opinion of the County are appropriate to the nature of the Development such written approval shall not be unreasonably withheld and in any case the County shall respond within 10 (ten) Working Days;
2.1.3 to nominate a Travel Plan Champion for written approval of the County and obtain such approval and such nomination shall include contact details full particulars and curriculum vitae of the proposed Travel Plan Champion and the nature of their relationship to the Owner such written approval shall not be unreasonably withheld and in any case the County shall respond within 10 (ten) Working Days; and
2.1.4 to appoint and retain the Travel Plan Champion at its own expense which retention shall endure throughout the duration of the Travel Plan.
2.2 Not to Occupy nor cause nor permit Occupation of the Development until the Travel Plan has been submitted to and approved in writing by the County.
2.3 At all times during Occupation of the Development to:
2.3.1 comply with the terms of the approved Travel Plan including but not limited to implementing any actions by any dates specified in the Travel Plan;
2.3.2 promote and publicise the approved Travel Plan to owners occupiers and visitors to the Development;
2.3.3 implement the Travel Plan by the dates or within the time limits set out in the Travel Plan;
2.3.4 carry out the Travel Plan Annual Review and submit a written report setting out the findings of such review to the County within three (3) calendar months from the dates of each Travel Plan Annual Review such report shall include (but shall not be limited to) recommendations for amendments or improvements to the approved Travel Plan and whether or not the objectives of the Travel Plan have been achieved;
2.3.5 comply with any variations or amendments to the Travel Plan permitted by this Agreement which shall in addition include any amendments or improvements reasonably required by the County following review of the report submitted pursuant to paragraph 2.3.4 above and notified in writing to the Owner;
2.3.6 to ensure that they will include ...
Travel Plan. 1.1. Not to Occupy or permit the Occupation of any Dwelling prior to the implementation of those parts of the approved Travel Plan that are capable of being implemented prior to Occupation. Those parts capable of implementation only after Occupation shall be implemented in accordance with the timetable contained in the Travel Plan and shall continue to be implemented as long as any part of the Development is Occupied.
1.2. At no cost to the District Council or the County Council to implement or procure the implementation of all measures identified in the Travel Plan.
1.3. To co-operate with the County Council in such manner and on such occasions as the County Council reasonably require in the verification of the accuracy of any data used to assess the extent to which the objectives of the Travel Plan have been achieved.
1.4. Any amendment to the Travel Plan under review or the discontinuance of any measures is not permitted without the consent of the County Council.
Travel Plan. 1.1 The Owners covenant with the Council:
(a) prior to the first anniversary of Occupation to provide a Travel Plan prepared in accordance with paragraph 4.2 of the Framework Travel Plan to the Council; and
(b) thereafter to maintain and monitor the Travel Plan in respect of the use of the Development.
1.2 The Owners covenant with the Council that they shall not Occupy any Dwellings until they have lodged the Travel Plan Bond with the Council.
1.3 Throughout the Monitoring Period the Travel Plan Coordinator shall be entitled to drawdown on the Travel Plan Bond in the event of a failure by the Owners to comply with Travel Plan.
Travel Plan. The Developer covenants with the Council and TfL:
3.1 Not to Occupy the Development until the Travel Plan has been submitted to the Council and TfL and the Council and TfL have approved the plan in writing.
3.2 To implement and comply with the Travel Plan approved pursuant to paragraph 3.1 above for the duration that the Development or any part of the Development remains Occupied.
Travel Plan. Travel Benefit Plan effective May 10, 2013. Eligible benefits are limited to a maximum of sixty (60) days per trip commencing with the date of departure from your province of residence. (See Benefit Plan Booklet for full details).
Travel Plan. The Owner covenants with the Council as follows:
Travel Plan. 1. The Owner covenants with the Council as follows:
1.1. The New Dwellings shall not be Occupied unless and until a Travel Plan Co-ordinator has been appointed and their details (name, address, email address and telephone number) have been notified to the Council.
1.2. Not to Occupy nor permit Occupation of more than one hundred and fifty (150) New Dwellings unless and until it has submitted the Travel Plan to the Council for approval.
1.3. For the avoidance of doubt the Travel Plan shall contain details of the specific measures proposed in order to achieve the aims objectives set out in the Framework Travel Plan such details to be based on the indicative measures of the Framework Travel Plan.
1.4. If the Council has not confirmed in writing within eight (8) weeks of receipt of the Travel Plan whether:
(a) the proposed Travel Plan is acceptable; or
(b) where it considers that the Travel Plan is not acceptable what amendments are required to make the Travel Plan acceptable then the Travel Plan submitted in accordance with paragraph 1.2 shall be deemed to be approved.
1.5. In the event the Council confirms the that the Travel Plan submitted in accordance with paragraph 1.2 is not acceptable or requires specified amendments in order to be acceptable then a revised Travel Plan shall be submitted and the provisions of paragraph 1.4 of this Part 4 shall apply to the revised Travel Plan and shall continue to apply until such time as the Travel Plan is approved (or deemed to be approved).
2. The Owner shall not Occupy or permit to be Occupied more than one hundred and ninety (190) New Dwellings until the Travel Plan has been approved or is deemed to be approved.
3. The Owner covenants to publicise the approved Travel Plan to Occupiers of the Development and on written request by an Occupier of the Development to provide a copy of the approved Travel Plan without charge.
4. In accordance with the requirements of the approved Travel Plan the Owner shall:
4.1. monitor and review the Travel Plan for five (5) years from the date of first Occupation of the Development; and
4.2. provide a written report to the Council at the end of the said five (5) year period and thereafter take into account any reasonable comments provided thereon by the Council.
5. Following the expiry of the five (5) year period specified in paragraph 4 of this Part 3 the provisions contained in this Part 4 shall determine and shall cease to be enforceable by the Council.
Travel Plan. The Parties on behalf of themselves and their successors in title covenant with the County Council to perform the following obligations:
Travel Plan. 7.1 The Owner shall prior to Occupation prepare and submit to the Council a draft travel plan (“the Travel Plan”) and shall implement the Travel Plan following written approval of the same from the Council.
7.2 The Travel Plan shall accord with the terms of the current Travel Plan Development Control Guidance issued by Transport for London which shall include as a minimum:
(a) effective measures for the ongoing monitoring of the Travel Plan;
(b) effective means to delivering the Travel Plan objectives; and
(c) effective mechanisms to achieve the objectives of the Travel Plan by present and future occupiers of the Development.
7.3 The Development shall be managed only in accordance with the terms of the Travel Plan.
7.4 The Owner undertakes that it will submit a Monitoring Report to the Council following the first anniversary and the third anniversary of the Travel Plan being formally agreed by the Council.
7.5 In the event that the Monitoring Report shows that the Travel Plan has failed to meet the objectives / targets in any respect, then the Owner shall within three months indicate to the Council the remedial measures that it will take in order to secure that the Travel Plan objectives / targets are met and the Owner shall thereafter carry out the new measures so as to ensure that the Travel Plan Objectives / Targets are met.
7.6 The Owner shall produce the Monitoring Report required that shall be:
(a) based upon the surveys of traffic flows in and around the vicinity of the Property (“Monitoring Survey") conducted by the Owner;
(b) comply with Transport for London’s format or such other format as the Council may reasonably specify; and
(c) submitted to the Council within 3 months of the first and third anniversaries of the Travel Plan.
7.7 In the event that the Owner fails to carry out any Monitoring Survey then the Owner shall in addition pay to the Council the sum of five hundred pounds per annual survey in respect of the Council's costs in carrying such survey.
7.8 The Monitoring Survey shall be undertaken on an annual basis for the three years following Occupation.
Travel Plan. 3.1 To pay the Travel Plan Contribution into a separately identified interest-bearing section of the County Council's combined accounts as soon as reasonably practicable.
3.2 Not to use any part of the Travel Plan Contribution other than towards to enable Lancashire County Council to monitor and support the development, implementation and review of the Full Travel Plan. This will include reviewing: Annual surveys Progression of initiatives/actions plan Targets
3.3 In the event that the Travel Plan Contribution has not been spent or committed for expenditure by the County Council within 5 years following the date of receipt of the payment of the Travel Plan Contribution the County Council shall refund to the party who paid it any part of the Travel Plan Contribution which has not been spent or committed for expenditure, together with any accrued interest.
