Unrequested Leave of Absence Ula. The School Board may place on ULA such teachers as may be necessary because of discontinuance of position, lack of pupils, financial limitations, or merger of classes. Such leave of absence shall continue for a period of five (5) years, after which the right to reinstatement shall terminate; provided the teacher’s right to reinstatement shall also terminate if the teacher fails to file with the Director of Human Resources, by February 1st of each year, a written statement requesting reinstatement. Such leave shall be effective at the close of the contract year or at such earlier time as mutually agreed upon by the teacher, as supported by the Exclusive Representative, and the Superintendent or Designee.

Unrequested Leave of Absence Ula. Section 1. Purpose: The purpose of this Article is to implement the provisions of M.S. 122A.40, Subd. 10, which constitutes the required plan for unrequested leave of absence (ULA) because of discontinuance of position, lack of pupils, financial limitations, or merger of classes caused by consolidation of school districts. As used in this Article the term “Principal’ shall refer to a member of the Principals’ Association bargaining unit and shall include both Principals and Assistant Principals unless otherwise stated.

In placing teachers on ULA, the School Board shall be governed by the following provisions: ● Teachers who have acquired continuing contract rights shall be placed on ULA in the field in which they are teaching in the inverse order of employment. ● All layoffs become effective on the last day of the school year. ● Teachers who have acquired continuing contract rights must not be placed on unrequested leave of absence (ULA) while Tier 1, 2, or 3 are retained in positions for which the teacher who has acquired continuing contract rights is licensed.
