Continuing Contract Teachers. A teacher who has acquired continuing contract rights must not be placed on unrequested leave of absence (ULA) while Tier 1-licensed, Tier 2- licensed, or probationary teachers are retained in positions for which the teacher who has acquired continuing contract rights is licensed and qualified.

Continuing Contract Teachers. The School Board may place continuing contract teachers on unrequested leave from their teaching area and from any other field to which they are assigned, in the reverse order of their employment. In the case of equal seniority, the order in which continuing contract teachers shall be placed on unrequested leave of absence shall be determined as follows:

Continuing Contract Teachers. For the purposes of RIF, all continuing contract teachers with a final holistic rating of Accomplished shall be considered comparable. All continuing contract teachers with a final holistic rating of Skilled and Developing shall be considered comparable. All continuing contract teachers with a final holistic rating of Ineffective are considered comparable, unless the teacher has two consecutive years of a final holistic rating of Ineffective. In the case of two consecutive years of Ineffective, for the purposes of RIF, the teacher shall possess no seniority or continuing contract status and shall be deemed comparable to an Ineffective limited contract teacher (see below).

ISD 196 shall not be required to transfer (or “Strand”) a more senior teacher to a different assignment in order to accommodate the seniority claim of a teacher proposed for unrequested leave of absence. Nor shall ISD196 be required to split existing assignments into separate part-time positions for the purpose of affecting the order in which teachers are recalled from unrequested leave of absence. A teacher’s seniority date is the date of their first contracted duty day of uninterrupted service in ISD 196. In the case of equal seniority, the teacher with the lower license file number as issued by the PELSB shall be deemed senior. ECFE teachers and ABE teachers are placed on unrequested leave of absence in the inverse order of seniority. ISD 196 shall not allow an ECFE teacher or an ABE teacher to bump into a K-12 or ECSE position in accordance with the provisions of M.S. 122A.26.
