USE OF PUBLIC ROADS. The Joint Venturers will have the right to use any public roads that may from time to time exist in the area of their operations under this Agreement both prior to the commencement date and also in the course of their operations hereunder. If the exercise by the Joint Venturers of such right results in or is likely to result in intensive use of any public road whereby excessive damage or deterioration is caused thereto or whereby the road becomes inadequate for use by the Joint Venturers and the public the Joint Venturers will upon demand (except where and to the extent that the Commissioner of Main Roads agrees to bear the whole or part of such cost) pay to the State or the local authority concerned or other authority having control of such road the cost of preventing or making good such damage or deterioration or of upgrading the road to a standard commensurate with the increased traffic.
USE OF PUBLIC ROADS. 1. An Applicant proposing to use any County, municipality, Township or Village road(s), for the purpose of transporting XXXX parts, components or related Substation parts or equipment for construction, operation or maintenance of the XXXX or Substation(s) shall:
a. Identify all such public roads
b. Obtain applicable weight and size permits from the relevant governmental agencies prior to construction.
c. Obtain applicable Entrance and Utility permits from relevant governmental agencies prior to construction, should they be required.
2. To the extent an Applicant must obtain a weight or size permit from the County, municipality, Township or Village, the Applicant shall:
a. Conduct a third-party pre-construction baseline survey to determine existing road conditions for assessing potential future damage; and
b. Any proposed public roads that will be used for construction purposes shall be identified and approved in writing by the respective Road District Commissioner or the County Engineer prior to the granting of the Conditional Use Permit. Traffic for construction purposes shall be limited to these roads. All overweight and/or oversized loads to be transported on public roads may require a permit from the respective highway authority. Any road damage caused by the transport of the XXXX’x equipment, the installation, maintenance or removal, must be completely repaired to the reasonable satisfaction of the Road District Commissioner or the County Engineer. The Road District Commissioner or County Engineer may choose to require remediation of road repair upon completion of the XXXX, in addition to being authorized to collect fees for overweight and/or oversized load permits. Further, financial assurance in an amount to be fixed by the Road District Commissioner or County Engineer to ensure the Road District or the County that future repairs are completed to their reasonable satisfaction shall be provided. Applicant shall submit a draft form of said financial assurance with the application for a Conditional Use Permit.
c. Enter into a road use agreement with the County and each affected Road District that includes the following provisions, at a minimum:
1. Project layout map;
2. Transportation impact analysis;
3. Pre-construction plans
4. Project traffic map;
5. Project scope of repairs;
6. Post-construction repairs;
USE OF PUBLIC ROADS. 17.1 The Contractor shall comply with all requirements of the relevant authorities in respect of the use of the public roads. He shall make proper provision to prevent the excavated materials, sand and aggregates from being deposited on the roads from his vehicles and shall remove any materials which are so deposited promptly and at his own expenses.
17.2 The Contractor shall at his own expenses make good any damage to public roads caused by the Contractor's vehicles. Such making good shall be to the satisfaction of the S.O.
USE OF PUBLIC ROADS. Access to the site shall be via Xxxxxxxx’x Road. The Contractor shall be responsible for cleaning up to the satisfaction of the Superintendent any material spilled by him or his subcontractors on the works, on access and public roads. All costs associated with the above requirements shall be deemed to be included in the contract rates and the work shall be carried out immediately such spillage occurs. The Contractor shall be responsible for the maintenance of all access / haul roads for the duration of the Contract. The cost of this above work shall be deemed to be included in the Contract Sum.
