Work Retention and Sub-Contracting. Where the Company's facilities, space, and trained personnel are available, the Company shall continue to have all work which is presently performed by employees of the Bargaining Unit, retained and performed by employees of the Bargaining Unit.

(b) If a Machinists Lodge 692 shop cannot perform the work, then a Union shop mutually agreed to between the International Association of Machinists and Aerospace Workers, Vancouver Lodge 692 and the Company will be chosen.

Prior to contracting out work presently performed by employees of the Bargaining Unit, the Company shall, whenever feasible:
1. Notify the Union at least thirty (30) days in advance of the commencement of the proposed contracting out;
2. Provide the Union with an opportunity to propose alternative arrangements by which the work could be performed by employees in the Bargaining Unit; and
3. Make itself available to discuss the proposed contracting out with two (2) designed representatives of the Bargaining Unit. The Company shall be relieved of these obligations in urgent or emergency situations or when timely notification and discussion are otherwise not feasible in the circumstances. Nothing stated in this Article will be interpreted as limiting or altering the Company’s rights under Article 2.01 or otherwise.

(c) If there is a conflict with the aforementioned the Company and Union will meet to resolve the issue of subcontracting. No jobs will be lost as a result of subcontracting and the Union will not unreasonably withhold such a request.

(b) If no Machinists Lodge 692 shop or other union shop in the Prince Xxxxxx area is available to perform the work, then the Company may use other available means to do the work. The company shall notify the Union when work is sublet to another facility.
