Works and/or services. 4.4.2.1. The Supplier shall be liable for hidden faults or defects, including during the Warranty Period and until the period stipulated by the applicable legislation in the event it is longer, apart from any legal or other liabilities that may arise.
Works and/or services. 4.3.3.1. Once the Warranty Period has elapsed, the Supplier shall notify ENEL of the expiry of said Period, requesting the Final Acceptance. In view of such request, ENEL, if applicable, shall notify the Supplier of the date set for Final Acceptance, which must occur within a period not exceeding thirty (30) days from the receipt of notification by ENEL.
4.3.3.2. On the day set by mutual agreement for issuing the Final Acceptance, in the presence of the Supplier, the status of the work or service contracted shall be checked and it shall be verified whether it meets the required conditions, performing such tests as may be necessary.
4.3.3.3. The management of the execution of the works or services entrusted shall correspond completely to the Supplier.
Works and/or services. 11.2.1. The Supplier must know and verify that its personnel knows, understands and applies all the requirements and regulations related to the protection of the environment, energy efficiency and environmental quality within the premises that may be applicable in order to carry out the works or services.
11.2.2. The Supplier shall guarantee, and where appropriate, accredit that the personnel who are to carry out the work covered by the Contract, possess or receive the appropriate theoretical-practical training for this purpose and, especially, the necessary training to guarantee their correct environmental behaviour and to reduce the risk of an incident with environmental repercussions. The training shall include the obligations that are derived from the documents of the Environmental Management System, in the event that one has been implemented or is in the process of implementation, as is common in the different businesses of ENEL.
11.2.3. The Supplier shall provide its staff with the necessary means so that the work or services can be carried out in an environmentally-friendly manner. Likewise, it undertakes to comply with all the legal requirements that may be applicable, as well as those derived from the Environmental Management System, in the event that there is one implemented in the facility covered by the contract. The Supplier must provide the pertinent information on the activities envisaged in the Contract, to assist in the calculation of the ENEL Carbon Footprint (in the same way, the information on the Carbon Footprint of the activities of the Suppliers will be evaluated).
11.2.4. The Supplier shall provide its personnel with the necessary means so that the works or services can be carried out taking care of the environment, taking into account the efficient use of energy and environmental quality within the premises. Likewise, it undertakes to comply with all the applicable legal requirements, as well as those of the Environmental, Energy or Environmental Quality System at the premises, in case there is one implemented at the facilities covered by the Contract.
11.2.5. The Supplier shall be liable for any environmental incident or accident caused by it, as a result of the performance of the works or services, and ENEL reserves the right to charge the Supplier for the actions and expenses arising from non-compliance with its obligations regarding environmental issues. Works and/or services. After the agreed Warranty Period passes, the Contractor must notify ENEL of the expiry of this Period and request the Provisional Acceptance. In view of this request, ENEL, if necessary, shall communicate the established date for the Provisional Acceptance to the Contractor, without this period extending further than thirty (30) days after the receipt of ENEL's notification.
9.4.3.1. On the date established by mutual agreement for the Provisional Acceptance, the state of the contracted works or service shall be inspected, in the presence of the Contractor’s representative, to check that it fulfils the required conditions, carrying out the necessary tests.
9.4.3.2. The Contractor shall be fully responsible for the Management of the execution of the contracted works or services.
Works and/or services. 9.5.2.1. The Contractor shall be liable for latent defects or manufacturing defects, as well as during the Warranty Period and until the end of the period indicated by applicable law, in addition to the legal forms of liability or otherwise may arise apply.
Works and/or services. 9.4.3.1 The Supplier shall notify ENEL of the termination of the contractual works or services, requesting the issuance of the Provisional Acceptance.
9.4.3.2 Within ten (10) days, the Parties shall carry out a joint examination of the works or service executed and shall sign the Provisional Acceptance Certificate, provided that the works or services have been duly executed according to the provisions of the contractual documents. In case of non-substantial faults or delays which may jeopardize the persons or the goods, ENEL may provide the Provisional Acceptance, provided that the Supplier remedies such deficiencies or faults within an agreed term.
9.4.3.3 If the Supplier, despite having been summoned, does not take part to the Provisional Acceptance, the Certificate drawn up by ENEL shall have the same effect as if it had also been signed by the Supplier.
Works and/or services. 24.2.1. The SUPPLIER must be aware of all requirements and legislation applicable to its work, and must provide evidence to show its compliance with the aforementioned regulations and requirements.
24.2.2. The Contractor shall ensure, and where appropriate shall prove, that the person who will carry out the work under the Contract, has or receives the appropriate theoretical and practical training to this end, and in particular, the necessary training to ensure correct behaviour in relation to the environment and to reduce the risk of an accident which has an environmental impact. The training shall include their obligations arising from the documents of the Environmental Management System, technical standards and legal standards applicable, restrictions and licensing requirements and authorizations.
24.2.3. The SUPPLIER shall provide its personnel with the necessary resources allowing work to be carried out in respect for the environment and in accordance with the applicable regulations and requirements. It furthermore undertakes to comply with all applicable legal requirements and with the requirements deriving from the Environmental Management System, where such a system is in place in the installations addressed by the Contract.
Works and/or services. 4.3.3.1 The Supplier shall notify ENEL when the execution of the contracted works or services has finished, requesting the granting of the Provisional Acceptance.
4.3.3.2 Within a term of ten (10) days, the Parties shall carry out a joint review of the work or service executed and shall sign the Provisional Acceptance Certificate, provided that the works or services have been duly executed in accordance with the provisions of the contractual documentation, without any missing elements or defects. When there are any missing elements or inconsequential delays that do not jeopardise the safety of people or objects, ENEL may grant the Provisional Acceptance subject to the Supplier’s commitment to correct said minor deficiencies or deficiencies within a period to be agreed upon.
4.3.3.3 If the Supplier, despite having been summoned, does not attend the Provisional Acceptance act, the Certificate prepared by ENEL shall have the same effects as if it had been signed by the Supplier.
Works and/or services. 24.2.1. The Contractor must be aware of and follow all the applicable requirements and laws in order to perform the work.
24.2.2. The Contractor shall guarantee and, if necessary accredit, that the employees carrying out the contracted work, have or receive the appropriate theoretical and practical training for the work, especially that required to guarantee the appropriate environmental activities and measures and reduce the risk of an incident with environmental effects. The training must cover the obligations derived from the Environmental Management System documents, should such a system be implemented or in the process of being implemented, as is usually the case in ENEL’s businesses. the Environmental Management System, should there be one implemented in the installation that is the subject to the Contract.
Works and/or services. The Supplier shall be liable for any apparent or hidden defect, throughout the term of the Contract, including the Warranty Period, and until the date specified by the applicable law, without prejudice to the relevant legal or contractual liabilities.
