Xxxxxx’s Responsibilities. 7.1 The Lessee shall during the term of this agreement: (a) ensure that the Equipment is kept and operated in a suitable environment, used only for the purposes for which it is designed, and operated in a proper manner by trained competent staff in accordance with any operating instructions; (b) take such steps (including compliance with all safety and usage instructions provided by the Lessor) as may be necessary to ensure, so far as is reasonably practicable, that the Equipment is at all times safe and without risk to health when it is being set, used, cleaned or maintained by a person at work; (c) make no alteration to the Equipment and shall not remove any existing component(s) from the Equipment without the prior written consent of the Lessor, unless the component(s) is/are replaced immediately (or if removed in the ordinary course of repair and maintenance as soon as practicable) by the same component or by one of a similar make and model or an improved/advanced version of it. Title and property in all substitutions, replacements, renewals made in or to the Equipment shall vest in the Lessor immediately upon installation; (d) keep the Lessor fully informed of all material matters relating to the Equipment; (e) keep the Equipment at all times at the Site and shall not move or attempt to move any part of the Equipment to any other location without the Lessor's prior written consent OR at all times keep the Equipment in the possession or control of the Lessee and keep the Lessor informed of its location; (f) permit the Lessor or its duly authorised representative to inspect the Equipment at all reasonable times and for such purpose to enter upon the Site or any premises at which the Equipment may be located, and shall grant reasonable access and facilities for such inspection; (g) not, without the prior written consent of the Lessor, part with control of (including for the purposes of repair or maintenance), sell or offer for sale, underlet or lend the Equipment or allow the creation of any mortgage, charge, lien or other security interest in respect of it; (h) not without the prior written consent of the Lessor, attach the Equipment to any land or building so as to cause the Equipment to become a permanent or immovable fixture on such land or building. Xxxxxx’s Responsibilities. The Lessee is solely responsible for the repair and maintenance of the Premises during the Lease Term. This responsibility includes, without limitation: (a) the performance of all repairs, maintenance, and replacement (whether structural or non- structural, foreseen or unforeseen, ordinary or extraordinary) necessary to maintain the Premises and the Improvements thereon in good order, condition, and repair in a manner consistent with the operation of comparable facilities in the locale of the Park Area and in compliance with all Applicable Laws; (b) the replacement, as it becomes worn out or obsolete, of all Personal Property; (c) housekeeping and routine and periodic work scheduled to mitigate wear and deterioration without altering the appearance of the Premises; (d) the repair or replacement in-kind of broken or worn out elements, parts or surfaces so as to keep the existing appearance of the Premises; (e) scheduled inspections of all building systems on the Premises; (f) maintaining the grounds of the Premises in good condition, including regular grass mowing, managed lawn and ornamental plantings, and avoidance or removal of unsightly storage or parking of materials, equipment, or vehicles; and (g) paying to the proper authority, when and as the same become due and payable, all taxes and assessments imposed by federal, state, or local agencies applicable to the Premises or the Lessee’s activities on the Premises.

Xxxxxx’s Responsibilities. Renter shall be responsible for: a. making suitable arrangements for safe, sheltered anchorage of the Boat during storms, high winds, high or low water, ice or snow conditions and other weather conditions, and Renter warrants that such arrangements have been or will be made. Renter may not assume that the Marina Area or Slip will be a safe, sheltered anchorage at any time and the City is not required to do any act to save or preserve the Boat or the Renter's property. b. if the Boat sinks while in the Slip or otherwise in the Marina Area, Renter shall raise the Boat at Renter's sole cost and expense. If action to raise the Boat is not begun within 24 hours after Xxxxxx receives notice of the sinking, the City may take action to raise the Boat at Renter's expense which expense shall be deemed additional Rent hereunder. Undertaking to move the Boat shall not be deemed an assumption of responsibility for the safety, security and care of the Boat by City. City shall have a federal maritime lien for salvage against the Boat for any and all salvage actions and costs undertaken by the City. The City shall also have the contractual right to enforce its salvage costs and the amount of its salvage lien against the Boat Owner and/or Boat Owner's Agent personally.

This responsibility, where applicable, includes, without limitation: (a) The performance of all repairs, maintenance, replacement, upgrading, capital improvements, (whether structural or non-structural, foreseen or unforeseen, ordinary or extraordinary) necessary to maintain the Premises and the improvements thereon in good order, condition, and repair in a manner consistent with the operation of comparable facilities in the locale of the Reserve and in compliance with all Applicable Laws; (b) Housekeeping and routine and periodic work scheduled to mitigate wear and deterioration without altering the appearance of the Premises; (c) The repair or replacement in-kind of broken or worn out elements, parts or surfaces so as to keep the existing appearance of the Premises; (d) Maintaining the grounds of the Premises in good condition, including, without limitation, avoidance or removal of unsightly storage or parking of materials, equipment, or vehicles. Any repair and maintenance actions that may result in Alterations to the Premises require the prior written approval of the Lessor.
Xxxxxx’s Responsibilities. A. Lessee shall be responsible for all damage caused by Lessee or any of Lessee’s guests or visitors. B. Xxxxxx agrees to obey all park rules and regulations contained in this Agreement or posted distributed. C. Xxxxxx acknowledges that the only people allowed to reside in the RV are those listed on the front of the Agreement and this D. Xxxxxx acknowledges and agrees that Xxxxxx shall have no responsibility for Xxxxxx’s safety or the safety or protection of any of Xxxxxx’s possessions. Xxxxxx acknowledges that the park entrance is not guarded, the park has no security system or patrol, and that Xxxxxx is responsible for locking his/her RV in order to help prevent loss or damage. Xxxxxx agrees to notify Xxxxxx or the police in the event xxxxxx observes or learns of suspicious or illegal acts in the park. E. Xxxxxx agrees that at the end of the term of this Agreement Lessee shall move the RV out of the park and shall have no right to leave it or sell it to be left in the park. If someone buys the RV, the buyer must be preapproved to leave the RV, otherwise it must be moved immediately. F. There shall be no automotive maintenance or RV maintenance allowed in the park. No changing of oil is allowed. G. Clotheslines and hanging of clothes is not permitted outside the RV.

Xxxxxx’s Responsibilities. Tenant shall not destroy, deface, damage, impair, disable, or remove any part of the Premises, or modify minimum or maximum appliance or equipment set points, and shall not permit any Occupants, guests, invitees, licensees, or animals housed by Tenant to do so. Tenant shall pay for any damages, excluding ordinary wear and tear, that (i) are not described on the Move-In/Move-Out Inspection Form (Schedule 5) as modified by Tenant’s written notice(s) as existing prior to Tenant’s occupancy and (ii) caused by the deliberate, accidental, or negligent acts or omissions of Tenant or Occupants, guests, invitees, licensees or animals housed by Tenant. Tenant shall be charged for all damage to the Premises as a result of failure to (i) report a problem in a timely manner; or
Xxxxxx’s Responsibilities. The Lessee is solely responsible for the repair and maintenance of the Premises during the Lease Term and shall promptly and continuously perform the Repair and Maintenance of the Premises during the Term, provided that the performance of Repair and Maintenance is subject to the Repair and Maintenance Plan approved in writing by Lessor pursuant to Subsection 11.2 below. This responsibility includes, without limitation: (a) the performance of all repairs, maintenance, and replacement (whether structural or non- structural, foreseen or unforeseen, ordinary or extraordinary) necessary to maintain the Premises so as to avoid deterioration in good order, condition, and repair in a manner consistent with the operation of comparable facilities in the locale of the Park Area and in compliance with all Applicable Laws; (b) the replacement, as it becomes worn out or obsolete, of all Personal Property; (c) housekeeping and routine and periodic work scheduled to mitigate wear and deterioration without altering the appearance of the Premises; (d) the repair or replacement in-kind of broken or worn out elements, parts or surfaces so as to keep the existing appearance of the Premises; (e) scheduled inspections of all building systems on the Premises; (f) maintaining the grounds of the Premises in good condition, including regular grass mowing, managed lawn and ornamental plantings, and avoidance or removal of unsightly storage or parking of materials, equipment, or vehicles; and Any repair and maintenance actions that may result in Alterations to the Premises require the prior written approval of the Lessor. The parties expressly agree that Xxxxxx’s monetary obligation to perform Repair and Maintenance shall be limited to the funds available in the Repair and Maintenance Reserve, or, in the case of a Repair and Maintenance cost in excess of funds available in the Repair and Maintenance Reserve, to funds from Gross Receipts as may be approved in writing in advance by Lessor at Lessor’s sole and absolute discretion.
Xxxxxx’s Responsibilities. The parties agree that LESSEE shall: (a) Make payments for directly to the utility company or, if mutually agreed, LESSOR. All payments, whether to the utility company or LESSOR, will be made in accordance with the current tariff or rate schedule. All utilities must be separately metered for LESSEE's exclusive use. Lessor to provide all account and meter information to allow uninterrupted transfer of services. (b) Be responsible for costs of any monthly monitoring fees or required annual inspections of fire alarm or sprinkler systems required by the governing authority of LESSOR's insurance policy. (c) At its discretion and expense, hire routine preventive insect pest extermination services, except for termites or other structure- damaging insects. (d) At its discretion and expense, handle and dispose of any trash generated by its occupancy of the PREMISES.
