CAM Costs definition

CAM Costs means the costs incurred by the Operator in good faith in repairing, replacing, maintaining, operating, managing, providing security for and insuring the Common Areas and Common Area Improvements and all other costs incurred by the Operator in the operation of the Penang Site. CAM Costs shall include, without limitation, taxes of any kind levied or assessed on materials, equipment, supplies and services purchased exclusively for repair, maintenance and replacement of the Common Area Improvements; amounts paid to non-managerial employees and agents of the Operator for work performed at the Penang Site in the repair, maintenance or replacement of the Common Areas Improvements; fees for required licenses and permits to operate, maintain, repair or replace the Common Areas in accordance with this Agreement; and reasonable rental costs of equipment used in the operation, repair, replacement and maintenance of the Common Area Improvements; and the Maintenance Fee.
CAM Costs means OD’s CAM Contribution (as defined in the Toys REOA) and all other actual, reasonable and necessary costs and expenses incurred by Landlord, without markup or surcharge (except for the Administrative Surcharge), in maintaining and repairing the Common Areas of the Shopping Center, none of which shall be a duplication of another cost or expense.
CAM Costs means Landlord's actual and reasonable out-of-pocket expenses incurred in operating, maintaining, repairing and insuring the Common Areas, including, but not limited to, cleaning and repairing; lighting, snow, ice, rubbish and garbage removal; painting and striping; landscaping; maintenance, paving, repair of utilities systems (including septic) and parking lots; sign maintenance; the providing of security, including security personnel; the providing of public liability, property damage, fire and extended coverage insurance (except as otherwise provided herein) and such other insurance as Landlord reasonably deems appropriate; fire protection charges; licenses and permit fees; rent paid for the leasing of any such equipment, and an administrative charge equal to five percent (5%) of the total amount paid by Tenant for common area costs for Landlord in maintaining and operating the common area and facilities, not including, however, real estate taxes and insurance costs. CAM Costs shall not include (i) any capital expenses incurred by Landlord, including any expenses incurred in Landlord's planned renovation of the Shopping Center, (ii) administrative expenses, home office expenses, management fees or other similar expenses, (iii) salaries, wages or other payments to Landlord's employees, except to the extent (based upon the percentage of time employed with respect to the Shopping Center) such employees work for the Shopping Center, (iv) repairs for which Landlord is obligated to maintain insurance, or for which Landlord is eligible to receive condemnation awards, (v) repairs or replacements necessary to comply with applicable laws, (vi) repairs made for the benefit of particular tenants or which are required to be made under tenant leases, (vii) legal fees, leasing commissions, accounting fees and other professional fees and payments, (viii) debt service payments or ground lease payments, (ix) real estate taxes, (x) depreciation, or (xi) any other payments or expenses not typically treated as reimbursable common area maintenance costs in community shopping centers in the geographic area of the Shopping Center. Examples of CAM Costs in a sentence

  • The foregoing list of items is provided for illustrative purposes only and shall not be deemed a full, complete, or exhaustive list of all possible CAM Costs.

  • If the Premises does not share meter facilities for utilities and if the utility or utilities are not provided as part of the CAM Costs (as defined below), tenant shall contract directly with all utility providers and all utility payments shall be directed to the respective utility providers.

More Definitions of CAM Costs

CAM Costs means all expenses and costs of every kind and nature which Landlord incurs because of or in connection with the ownership, maintenance, repair, management and operation of the Land and Common Area, subject to the exceptions set forth below. CAM Costs shall include, without limitation, all costs, expenses and disbursements incurred or made in connection with the following:
CAM Costs are defined in Section 11.03.
CAM Costs are all of Landlord's costs to perform its obligations under this ss.10, including an administrative fee equal to 15% of all of such costs.
CAM Costs as used herein shall mean and include the total cost and expense incurred by Landlord in operating, maintaining, and repairing the Development, building and improvements and common facilities, actually used or available for use by Tenant and employees, agents, servants, customers and other invitees of Tenant, excluding only items of expense commonly known and designated as debt service. CAM Costs shall specifically include, without limitation, general maintenance and repairs, the resurfacing, restriping and cleaning of parking and driveway areas, cleaning and repair of sidewalks, maintenance and repair of the building roof and structure, maintenance and repair of the heating, ventilating and air conditioning systems (to the extent not within the sole responsibility of any particular tenant within the building), plumbing and electrical systems serving the Development, a management fee (in an amount consistent with the management fees payable with regard to similar buildings in the Tampa, Florida metropolitan area) payable to Landlord or the company managing the Development (if any), gardening, landscaping, irrigation, and repairs thereto, all utilities serving the common areas and facilities, and sanitary control, removal of trash, rubbish, garbage and other refuse from the Development.
CAM Costs means all costs as Landlord may determine to be necessary in its sole and exclusive judgment, to maintain, repair, service, light and/or operate those portions of the Facility that are not Building interior areas for lease to tenants, such costs to include, but not be limited to: general landscaping, mowing of grass, care of shrubs (including replacement of expired plants); repair and maintenance of common Landlord-owned sewage facilities (including lift stations, etc.), drainage and detention facilities, water facilities, and other common plumbing facilities; operation, maintenance and repair of lawn sprinkler system; operation, maintenance and repair of Common Area lighting (excluding lighting mounted to the exterior of Buildings); repainting of exterior surfaces of Buildings which require periodic painting for preventive maintenance; paving and parking lot maintenance, including, but not limited to, repair and periodic striping or repaving; an amount determined by Landlord in good faith as a reasonable amount of water and sewer usage (if commonly metered with tenant usage) for Common Area usage thereof, subject to the provisions of Section 8(a) of the Lease in regard to periods during which Tenant is the only occupier of the Facility; any patrol or monitoring service contracted for by Landlord, if any (without obligation to provide the same or, if commenced, to continue to do so); any loss within a Permitted Deductible; and the cost of a management fee of two percent of gross revenue from the Facility as a management fee payable either to a third party property manager or to Landlord.
CAM Costs means the cost of operation and maintenance of the Common Area and other expenses approved by the Board.
CAM Costs means only those normal, reasonable and customary expenses, charges and fees consistent with similar first-class office buildings in Arlington County, Virginia which are actually incurred by the Landlord but only to the extent incurred in connection with the management, operation, maintenance, servicing, cleaning, and insuring of the demised premises or the building containing the demised premises.
