Common Area Costs definition
Common Area Costs means Landlord's reasonable costs for the operation, maintenance and repair of the interior and exterior Common Areas identified on Exhibit "B" attached hereto, consistent with other first- class shopping centers in the area. In no event shall the Common Area Costs include amounts for (i) depreciation of the original cost of constructing, erecting and installing the Shopping Center, the Common Areas, common facilities and related services; or (ii) principal and interest payments pursuant to any mortgage or deed of trust which encumbers the Premises or Shopping Center or any ground lease payments; or (iii) Taxes; or (iv) administrative charges, marketing fees, management fees, merchants association fees or leasing commissions; or (v) legal fees incurred in the negotiation of leases for the Shopping Center or in leasing disputes with Tenants; (vi) excess premiums for insurance covering the Common Areas occasioned by the extra-hazardous use or activities or occupants other than Tenant; or (vii) expenses incurred due to the negligence or willful misconduct of Landlord or any occupant of the Shopping Center or their respective agents or employees; or (viii) costs and expenses incurred for repairs or replacements due to faulty construction, faulty workmanship or structural defects; or (ix) costs and expenses for repairs or replacements due to the installation of antiquated machinery, equipment, components, pipes and lines or resulting from improper engineering or substandard quality; or (x) costs and expenses of any structural and roof repair and replacements and renovations to the Shopping Center; (xi) replacement or repairs covered by construction contracts or contractor's warranties, or by insurance proceeds; (xii) charges or fees for, or taxes on, the furnishing of water, sewer service, gas, fuel, electricity or other utility services to those portions of the Shopping Center which are leased to tenants; (xiii) the cost of providing janitorial or trash removal service to those portions of the Shopping center which are leased to tenants; (xiv) the cost incurred in repairing or replacing structural portions of the Shopping Center; (xv) the cost of acquiring property to be added to the Shopping Center and the cost of any construction appertaining to any property so added; or (xvi) the cost of Landlords federal, state or local income taxes; (xvii) expenses related to an individual occupant of the Shopping Center or to a particular tenant space; or (xviii) any cos...
Common Area Costs means the total costs and expenses incurred in operating, managing and maintaining the Shopping Center and the Common Areas, including but without limitation, such maintenance, repair, replacement and remodeling as shall be required in Landlord's sole and absolute judgment to preserve the utility thereof in the same condition and status as existed at the time of completion of the original construction. Common Area Costs shall also include Tenant's share of insurance costs.
Common Area Costs with respect to any year shall mean the total costs and expenses incurred by Landlord or its agents during such year for operating, maintaining, repairing and/or replacing all or any part of the Parking Areas and other Common Areas (and any installations thereon, thereunder or thereover), and any Common Facilities (as hereinafter defined, including any Common Facilities located upon or under the Premises), which costs and expenses shall include, but shall not be limited to, the following: the total costs and expenses incurred in cleaning, mowing, trimming, replanting and maintaining the lawns and landscaping within the Shopping Center; the costs of all Landlord’s insurance (other than Landlord’s fire and casualty insurance), including, but not limited to, bodily injury, public liability, property damage liability, automobile parking lot liability, workmen’s compensation, and any other insurance carried by Landlord with respect to the Common Areas or any part thereof; all costs for repairs, repaving, line repainting, exterior repainting, rental and maintenance of signs’ and equipment, lighting, sanitary control, removal of snow and ice, trash, rubbish, garbage and other refuse, repair and/or replacement of water lines, electrical lines, gas lines, sanitary sewer lines and storm water lines; all costs for repairs, replacements, alterations or improvements to the Parking Areas and other Common Areas and Common Facilities required by governmental statutes, ordinances, regulations or other requirements, including without limitation those relating to accessibility and usability; all electrical, water, sewer or other utility charges for serving the Common Areas (including any off-site sanitary treatment plants serving the Shopping Center and all pipes leading to and from the same); the cost of personnel to implement such services; wages and salaries (including employee benefits) of any personnel; personal property taxes, sales and use taxes on material, equipment, supplies and services; fees for required licenses and permits; fire, security and police protection; supplies, materials and labor. In addition there shall be include a charge equal to fifteen percent (15%) of all such costs and expenses incurred by Landlord to cover Landlord’s administrative overhead.
Examples of Common Area Costs in a sentence
Landlord may cause any or all of such services to be provided by third parties and the cost of such services shall be included in Common Area Costs.
Nothing herein shall imply that Landlord will permit Tenant or any other tenant of the Project to incur Common Area Costs.
Tenant acknowledges and agrees that Tenant shall have no right to audit Landlord's books and records concerning Common Area Costs.
The "Common Area Charge" shall be an annual charge of [***] per square foot of the Premises for the Common Area Costs defined in Section 7.04(b), subject to adjustment as provided in Section 7.05.
Common Area Costs shall not include depreciation of real property which forms part of the Common Areas.
More Definitions of Common Area Costs
Common Area Costs means the total costs and expenses incurred by LANDLORD, its agents and/or designees for operating, maintaining, repairing and/or replacing all or any part of the Common Areas (and any installation therein, thereon, thereunder, or thereover), which costs and expenses shall include, but shall not be limited to, the following: the total costs and expenses incurred in cleaning, planting, replanting and maintaining the landscaping of the common facilities of the POMPANO/LINCOLN INDUSTRIAL, LTD; the cost of all LANDLORD'S insurance, including, but not limited to, fire and other casualty, bodily injury, public liability, property damage liability, automobile parking lot liability insurance, sign insurance, workmans compensation insurance and other insurance carried by LANDLORD for the Common Areas; assessments; repairs; repaving; line repainting; exterior repainting; rental and maintenance of signs and equipment; lighting; sanitary control; removal of trash, rubbish, garbage and other refuse; depreciation of machinery and equipment used in such maintenance; depreciation of roof and paved areas; repair and/or replacement of on-site water lines, electric lines, gas lines, sanitary sewer lines and storm water lines; all electrical, water, sewer or other utility charges for serving the Common Areas (including any on-site and/or off-site sanitary treatment plant(s) serving the POMPANO/LINCOLN INDUSTRIAL, LTD and all pipes leading to and from same); Management Fees and the cost of personnel to implement such services, including the directing of parking; wages and salaries (including employee benefits, unemployment insurance and social security payments) of any personnel necessary to implement the operation, maintenance and repairs of the POMPANO/LINCOLN INDUSTRIAL, LTD (excluding the cost of any work performed at LANDLORD'S home office); personal property taxes, sales and use taxes on material, equipment, supplies and services; fees for required licenses and permits; fire, security and police protection, sprinkler system; public address system(s); public toilets; reasonable straight line of depreciation of, and rental charges for, movable equipment; supplies, material and labor.
Common Area Costs or "CAM" shall mean the total costs and expenses incurred in operating, heating, ventilating, cooling, security, insurance, sprinklering, compactor expenses, managing, food court maintenance and maintaining the Common Areas, including but without limitation, such maintenance, repair, replacement and remodeling as shall be required in Landlord's sole and absolute judgment to preserve the utility thereof in the same condition and status as existed at the time of completion of the original construction and installation.
Common Area Costs shall exclude:
Common Area Costs means all costs and expenses of the nature hereinafter described which am incurred in connection with ownership and operation of the Building or the Project in which the Premises are located, as the case may be not directly allocable to or payable by a single tenant in the Building or the Project, together with such additional facilities as may be determined by Landlord to be reasonably desirable or necessary to the ownership and operation of the Building and/or Project. Common Area Costs shall not include any capital expenditures, except to the extent such expenditures benefit the occupants of the Project, Building, and Tenant during the term of the Lease and are amortized over the useful life of the property acquired or constructed as a result of such expenditure. All costs and expenses shall be determined in accordance with generally accepted accounting principles which shall be consistently applied (with accruals appropriate to Landlord's business), including but not limited to, the following:

Common Area Costs means all costs, expenses and other expenditures of any nature whatsoever, foreseen or unforeseen, ordinary or extraordinary, (including capital expenditures) incurred in connection with the administration, supervision, management, enforcement, billing, construction supervision, records management, repair, maintenance, alteration, improvement, replacement, insurance, design, building and zoning code compliance, control and security for or with respect to the Common Areas.
Common Area Costs means all costs reasonably incurred for operation, maintenance and repair of the Common Areas and supervision thereof, including but not limited to, repairing, surfacing, sealing, repainting and restriping the parking areas, cleaning, sweeping and other janitorial services, sanitation, snow and ice removal, maintenance of Common Area refuse receptacles, maintenance, irrigation, and replanting existing landscaping areas (including in adjacent right-of-ways), repairing directional signs and other markers, payment of utility costs consumed in the Common Areas, and Maintenance of lighting and other utilities and taxes, insurance. Tenant will be absolutely responsible for all Common Area Costs irrespective of how such cost is itemized, identified, or labeled and even if such cost is billed to the Landlord.
