Eligibility and ParticipationAn individual is deemed an “Eligible Employee” and, therefore, eligible to participate in the Plan if he or she is a member of the Company’s Management Team at the time of such individual’s termination of employment with the Company, and such employment terminates due to an event which constitutes a Qualifying Termination.
Eligibility and Participation. All Employees who incur a Qualifying Termination and sign a Release are eligible to participate in the Plan. An eligible Employee will become a Participant in the Plan as of the Termination Date.
Eligibility and Participation. 2.1 Plan eligibility is limited to a select group of management or highly compensated Employees, as designated in writing by the Board, who participate in the Basic Retirement Plan, the Basic 401(k)/ESOP or both such plans. From time to time, the Company may designate one or more Employees who participate in the Basic Retirement Plan, the Basic 401(k)/ESOP or both such plans as participants in the Plan, from the class of Employees participating in the Basic Retirement Plan, the Basic 401(k)/ESOP or both such plans who are members of a select group of management Employees or are highly compensated Employees. Newly eligible Employees shall participate as of the date specified by the Board. 2.2 The Company may, from time to time, remove any Participant from participation in the Plan; provided, however, that, subject to Section 12.4, such removal will not reduce the amount of Retirement Income Benefit and 401(k)/ESOP Benefit credited to the Participant under the Plan, as determined as of the date of such Participant’s removal. A Participant so removed shall remain a Participant until all benefits are distributed in accordance with the provisions of the Plan. 2.3 The Committee may provide each eligible Employee with appropriate forms in connection with participation in the Plan.
Eligibility and ParticipationThe Administrator will select Participants from among those key Employees, directors and other individuals or entities providing services to the Company or its Affiliates who, in the opinion of the Administrator, are in a position to make a significant contribution to the success of the Company and its Affiliates. Eligibility for ISOs is further limited to those individuals whose employment status would qualify them for the tax treatment described in Sections 421 and 422 of the Code.
Eligibility and Participation. 3.1 Any Employee who has completed one (1) Year of Service and has attained the age of twenty (20) shall be eligible to participate in this Plan as of the earlier of the January 1, April 1, July 1 or October 1 next following the date upon which the Employee has completed the aforesaid service and age requirements, provided such Employee is so employed on such January 1, April 1, July 1 or October 1. A Leased Employee shall not be eligible to participate in this Plan. Any Employee who is included in a unit of Employees covered by an agreement in which retirement benefits are the subject of good faith bargaining between Employee representatives and the Employer shall not be eligible to participate in this Plan. Any Employee who is a nonresident alien and who receives no earned income (within the meaning of Code Section 911 (d) (2)) from the Employer which constitutes income from sources within the United States (within the 31 meaning of Code Section 861(a) (3)) shall not be eligible to participate in this Plan. Any Employee who was participating in this Plan on the day before the Effective Date of this amended and restated Plan shall continue to participate in this Plan subject to the other requirements herein. 3.2 For purposes of Years of Service for participation, all Years of Service with the Employer shall be taken into account, and an Employee who incurs a One-Year Break in Service shall participate in this Plan effective on the re-employment commencement date. Notwithstanding the preceding sentence, for Plan Years beginning before 1985, Years of Service prior to any One-Year Break in Service shall not be credited and the Participant shall satisfy again the eligibility for participation requirements if the Employee was not vested in Employer contributions and the number of consecutive One-Year Breaks in Service equals or exceeds the aggregate number of Years of Service before such break. Such aggregate number of Years of Service before such break shall be deemed not to include any Years of Service not required to be taken into account by reason of any prior One-Year Break in Service. For Plan Years beginning after 1984, Years of Service for eligibility to participate prior to a period of consecutive One-Year Breaks in Service shall not be credited and the Participant shall satisfy again the eligibility for participation requirements if the Employee was not vested in Employer contributions and the number of consecutive One-Year Breaks in Service equals o...
Eligibility and ParticipationAn Employee who incurs a Qualifying Termination and signs a Release that has not been revoked during any revocation period under the Release is eligible to participate in the Plan. An eligible Employee will become a Participant in the Plan as of the Termination Date.

Eligibility and ParticipationA Student whose Parent chooses to teach and direct the education of the child at home under a home education program as defined by 1002.01(1), F.S. and who meets all requirements for home education programs set forth in 1002.41, F.S., shall be permitted to enroll in dual enrollment coursework at College as permitted under 1007.271(13), F.S. To meet eligibility requirements for participation in the Dual Enrollment Program, a home education student shall meet the following criteria. A Student must be in any of grades six (6) through twelve (12) to enroll in postsecondary courses on the College campus as set forth below in this Agreement, provide proof of registration with the Escambia County, FL or Santa Xxxx County, FL School Board as a home education student for each semester student is enrolled in College courses, and be in good standing with the School District. If student was enrolled in a District school and has left the District school within the previous twelve (12) calendar months, then student must also meet the following eligibility criteria as indicated in the District Dual Enrollment Articulation Agreement. While there is no grade point average to initially enroll, home education student must present qualifying scores on a college placement test (SAT, ACT, or PERT). Home education students are exempt from payment of tuition and fees.
