Rights to Representation. Any party of interest may be represented at all meetings and hearings at any level of the grievance procedure by another teacher or another person. Provided, however, that no teacher may be represented by an officer, agent, or other representative of any educational organization other than the Association and the Michigan Education Association and the National Education Association. When a teacher is not represented by the Association, the Association shall have the right to be present and to state its views at all stages of the grievance processing.
Rights to Representation. 1. A grievant shall have the right to be accompanied by the Association at all steps of the grievance procedure.
2. In the event a grievant elects to file and proceed without Association representation, he/she may do so through the first two steps of the procedure only, provided that the Association is present at every meeting or conference in order to protect its contract rights, and further provided that copies of the grievance, appeals and responses are given to the President in a timely fashion.
3. No grievance may be processed with a grievant having representation other than him/her self or the Association.
Rights to Representation. Upon request of the grievant(s), an Association representative shall be present for any meetings, hearings, appeals, or other proceedings relating to a grievance which has been formally presented.
Rights to Representation. Only the parties to this Agreement and/or officially designated agents, as well as individual Grievant(s) may participate in meetings and/or hearings provided under this Article.
Rights to Representation. All parties of interest shall be present and may be represented by another person at all meetings and hearings at any level of the Grievance Procedure. In no event shall any employee be represented by an officer, agent, or representative of any organization in conflict or competition with the Association. Provided, further, when an employee is not represented by the Association, the Association shall have the right on its request to have its representative present to state its views at all stages of the grievance procedure.
Rights to Representation. 1. XXXXX shall designate a representative to be present at all formal levels of the Grievance Procedure when requested by the grievant.
2. XXXXX has the right to initiate Association Grievances. These grievances may be initiated at either Level I or II, depending on where the decision being grieved originated. Grievances filed at Level II must be filed in writing within twenty (20) days from the alleged occurrence.
3. XXXXX shall have the exclusive right to determine whether or not to process a grievance by an employee or group of employees at Level V and VI of the Grievance Procedure.
Rights to Representation. At least one Association representative may be present at the option of the grievant for any meetings, hearings, appeals, or other proceeding relating to employee complaints of grievances that have been formally filed. The Association reserves the right to file Association grievances on behalf of more than one teacher without specific identification of any individual(s) and fully access this procedure through all levels. The Association reserves the right to file grievances on behalf of individual teachers. Grievants may submit grievances at the level where the authority lies to grant the relief sought by the grievant as determined jointly by the Superintendent and the Association.
Rights to Representation. The grievant shall be entitled, but not required, to have at least one Association member present at any meeting, hearing, appeal or other proceeding relating to a grievance, which has been formally presented. Nothing contained herein shall be construed as limiting the right of any employee having a grievance to discuss the matter informally with the supervisor and having the grievance adjusted without intervention of the Association, provided the Association has been notified and the adjustment is not inconsistent with the terms of this Agreement.
Rights to Representation. The grievant may be represented at all meetings, hearings, steps, and stages of the grievance by another teacher. However, no teacher may be represented by an officer, an agent, or other representative of any organization other than the United Profession. The Association will have the right to be present and to state its views at all stages of grievance proceedings and may have members of the United Profession present for advice and counsel.
Rights to Representation. Both parties shall have the right to legal counsel at all levels of the procedure beginning at Step 2. The grievant shall have the right to an Association representative at all levels beginning at Step 1.
