DISPUTES. 5.1 The intent of the Parties is to identify and resolve disputes promptly. Each Party agrees to perform as follows: 5.1.1 to notify the other Party of any dispute in reasonable detail as soon as possible after any dispute arises; 5.1.2 to negotiate in good faith to seek to resolve the dispute. 5.1.3 if a dispute is not resolved within thirty days of it arising, either Party shall be entitled to submit the dispute for final and binding resolution. The parties irrevocably submit to the exclusive jurisdiction of the courts of France for the determination of any disputes arising out of or in connection with this Agreement (including (without limitation) any dispute regarding the existence, validity or termination of this Agreement and/or this clause and any dispute regarding non-contractual obligations arising out of or in connection with this Agreement). For such purposes, each party irrevocably waives any objection to the jurisdiction of those courts, and each party irrevocably agrees that a judgment or order of those courts in connection with this Agreement is conclusive and binding upon it.
DISPUTES. Any dispute relating to our services is, in the absence of an amicable agreement, subject to the exclusive jurisdiction of the competent Commercial Court under the exclusive jurisdiction of the owner-operator. DISPUTES. All disputes from which the purchase and sale transactions concluded in application of these general terms and conditions of sale could give rise, concerning their validity, interpretation, execution, termination, consequences and outcomes and which could not be resolved between the seller and the customer shall be submitted to the competent courts under the conditions of common law. The customer, noting that a violation of the general regulations on the protection of personal data has been committed, has the option of mandating an association or an organization mentioned in IV of Article 43 b of the French Law on Information Technology and Civil Liberties of 1978, in order to obtain, against the data controller or subcontractor, compensation before a civil or administrative court or before the French National Commission on Information Technology and Civil Liberties.
DISPUTES. Any dispute arising from the purchasing or sales transactions or service provision provided in these purchasing terms and conditions shall be referred to the exclusive jurisdiction of the Tribunal de Commerce de Sedan (France), as expressly agreed by the Supplier.
DISPUTES. French law is applicable for any dispute arising in relation to this document. SAGEB may not be held liable for damage of any kind, whether material or immaterial, which may result either from a Customer’s incorrect use of the transport service(s) or his failure to adhere to these General Conditions of Sale. Claims and disputes will always be received in goodwill, with good faith always being accorded to the person who goes to the trouble of explaining his situation. In the event of a dispute, the Customer should contact SAGEB Customer Services as a matter of priority in order to obtain an amicable solution.
