ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS. I acknowledge that participation in the Activity includes skiing, riding, other snow sports and the use of passenger tramways associated therewith which subject skiers and riders to risks and hazards regardless of all feasible safety measures that may be taken. I understand that participation in the Activity involves inherent risks of skiing encompassing dangers and conditions that are an integral part of the sport, as well as other known and unknown risks including, but not limited to, changing weather and surface conditions, falls resulting from manmade and natural objects, design and condition of natural and man-made elements, severe terrain changes and collisions with other participants, spectators, vehicles and natural and man-made objects. I acknowledge that while participating in the Activity I am a competitor whether I am practicing, training or engaged in competition. I acknowledge that I have been advised to visually inspect the course, venue or area where the Activity is to occur. I accept all risk of course, venue or area conditions including, but not limited to, weather and snow conditions, obstacles, course or feature location, course construction, design and layout, freestyle terrain configuration or condition, any other courses, layout or configurations of area to be used, collision with other competitors or natural or man-made objects and any other condition which a visual inspection should reveal. I AGREE FREELY AND VOLUNTARILY TO ASSUME ALL RISKS, including the risk of physical injury, death and/or damage to person(s) and/or property related to my participation in the Activity and associated use of the Sunday River ski area.

ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS. Participant has permission to participate in the 2019-2020 SHAWNEE PEAK MULTI-WEEK SKI PROGRAM. Participant acknowledges that enrollment in the ski program does not in any way eliminate the inherent risks of skiing. Participant further acknowledges that use of or presence on the ski area and facilities of Shawnee Peak, including use of lifts and participation in skiing, snowboarding, tubing, and other winter recreational activities (collectively “skiing”) may be HAZARDOUS ACTIVITIES. Participant must keep deliberate control of his/her body, must ski within his/her own ability, must comply with the Skier’s Responsibility Code and warnings posted at the ski area, and is solely responsible for his/her speed and direction at any given time. Participant acknowledges and assumes all risks of personal injury, death, or damage of any kind arising from the common and ordinary risks to participation in these activities, including but not limited to: constantly changing weather, snow, ice, rocks, forest growth, debris, bare spots, variations in terrain, moguls, jumps, freestyle terrain, and other surface conditions, falls, other skiers, collisions, lifts, lift towers, snowmaking and other resort equipment which may be operating at any time, natural and manmade objects, obstacles, hazards, and the inherent risks of skiing. Participant, on his/her own behalf and on behalf of all heirs, executor, and assigns AGREES VOLUNTARILY TO ASSUME ALL RISKS of personal injury, death, or damage of any kind.
ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS. I understand and acknowledge that participating in the Activity has risks, dangers and hazards including, but not limited to, weather hazards (like storms and lightning); wildlife hazards (like animal attacks and insect bites or stings); mountain hazards (like unstable surfaces, slipping, tripping, falling, rockfall and avalanche); water hazards (like flooding and drowning); physical hazards (like overexertion and dehydration); hazards from other forces of nature or acts of God; risks, dangers and hazards not specifically mentioned here; illness and injury to me; and improper acts of other participants, and my property could be lost, damaged or stolen. I could also be injured, or my property lost, damaged or stolen, because of the NEGLIGENCE of CPAWS SAB, the Staff or any other person, company or organization involved with or participating in the Activity. The Activity may occur in areas where there is no cell phone service or communication may be difficult and response by emergency services could be delayed. All these risks, dangers and hazards are called "the Risks" in this Agreement.
ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS. I understand that there are numerous dangerous conditions, risks and hazards (both natural and man-made / including contracting COVID 19) at and around the Facility, and that I may be exposed to dangerous water and terrain conditions, dangerous activities by myself and others (including but not limited to archery, shooting, swimming, canoeing, etc.), defective equipment, fall hazards, poisonous plants and creatures, dangerous animals, and other risks. I voluntarily assume all risks and responsibility for any injury, death, or damages arising out of or related to the property of or the activities of the Facility.

Participant acknowledges, accepts and assumes all such dangerous and hazardous risks and conditions in exchange for the right to participate in the Event.

Contestant acknowledges that he or she is fully aware of the risks and hazards involved with participating in an eating contest, including but not limited to choking, stomach upset, sickness, weight gain, allergic reaction, damage or loss to personal property, bodily injury, or even death. Contestant fully accepts and assumes all risks, including risks that are not specifically foreseeable, and Contestant fully accepts and assumes all responsibility for losses, costs, and damages that may result from participation in the Contest. Contestant certifies that he or she has no allergies to food or other items that would create a health risk to Contestant, that he or she is not under the influence of alcohol or prescription or over the counter drugs or other substance that could impair judgment, and that he or she is physically and mentally fit to compete in the Contest. Contestant voluntarily agrees to participate in the Contest. Contestant acknowledges by signing this agreement, that he or she has been advised to consult with a physician before participating in the Contest, particularly if he or she has a history of any medical condition.

I acknowledge and understand that some, but not all, of the known risks, hazards and dangers associated with the Activities include: (1) changing and rapidly moving water currents, wave action, flooding, and boat wakes; (2) collision with other people, watercraft (mine or another party’s), or man-made or natural objects; (3) inclement weather, storms, lightning, variances and extremes of wind, weather and temperature; (4) sinking, capsizing, becoming disoriented or lost, or other hazards that result in injury, exposure to elements, hypothermia, or drowning; (5) risks associated with animal attacks, insect bites, allergic reactions, or other acute illness while on the water and without access to medical or rescue personnel; (6) equipment used in the Activities may break, fail or malfunction; (7) heat or sun-related illness or injuries, including sunburn, sunstroke, or dehydration; (8) risks in decision making, including the risk that Maine Audubon guides, staff, volunteers, or others may misjudge my/my child’s capabilities or the weather, terrain, water conditions, or route location; (9) risks regarding conduct, including the potential that I/my child, Maine Audubon, or third parties may act carelessly; (10) risk associated with transportation to and from the Activities and in connection with getting in or out of or launching any watercraft, including traffic accidents, injuries sustained while crossing a street or parking lot, slip and fall accidents, and slipping on a dock or other wet surface; (11) risks associated with rescue operations, including the risk that Maine Audubon guides, staff, volunteers or others who may or may not be trained medical or rescue personnel attempt to provide medical or other aid and/or transportation in the event of an emergency; and (12) other risks, hazards and dangers associated directly or indirectly with use of Maine Audubon equipment and guided canoe and/or kayak tour or rental activities. I understand my participation in skiing, riding, and other snow sports and the use of aerial and surface lifts involve risks which are dangers and conditions that are an integral part of the activity, as well as other known and unknown risks which include, but are not limited to: risks relating to loading onto, riding on, and unloading from lifts; existing and changing weather conditions; existing and changing snow conditions, such as ice, hardpack, powder, packed powder, slush and granular, corn, crust, cut-up and machine-made snow; surface or subsurface conditions, such as dirt, grass, bare spots, rocks, stumps, trees and other natural objects; collisions with or falls resulting from such natural objects; collisions with or falls from lift towers, lights, signs, posts, fences, mazes or enclosures, hydrants, pipes, snowmaking and snow-grooming equipment, trail maintenance vehicles and snowmobiles, which may be operating at any time, other man-made structures or objects and their components; collisions with or falls resulting from such man-made objects; variations in steepness or terrain, whether natural or as a result of slope design, including but not limited to: freestyle terrain, jumps, roads and catwalks or other terrain modifications; snowmaking or snow-grooming operations; the presence of and collisions with other skiers or riders; and the failure of skiers or riders to ski or ride safely, in control or within their own abilities.
