Temporary Assignment of Duties. When a University employee is formally assigned the substantial responsibilities and duties of a PEA position, to the exclusion of the substantial responsibilities and duties of the employee’s regular position, for forty (40) consecutive working days or more, but for no more than seven (7) months, or in the case of leave replacements no more than fourteen (14) months (or twenty-two (22) months in the case of maternity/paternal leaves), the employee shall be an Association member. Benefit coverage may vary from the provisions of this agreement where the employee is covered by other terms and conditions of employment. Part B - Appointment and Promotion Procedures
Temporary Assignment of Duties. Benefit coverage may vary from the provisions of this agreement where the employee is covered by other terms and conditions of employment. When the University otherwise makes an appointment to a PEA position the person appointed shall be a member of the Association in accordance with Article 1.03.
Temporary Assignment of Duties. In some circumstances and with the agreement of the member, the University may assign the APT member to undertake another position, or a substantial portion of the duties of another position, for a limited period of time not to exceed nine months. With the mutual agreement of the University, the Association and the APT member, the nine-month assignment may be extended to a period not to exceed twelve months in total. The details of the assignment shall be specified in writing to the member prior to the member deciding whether or not to agree to the assignment. If the temporary assignment is for a period of fifteen or fewer working days, there will be no adjustment in the APT member’s salary. If the temporary assignment is for a period of more than fifteen working days and the duties of the position have different functions, the APT member’s salary will be adjusted from the date of reassignment to the greater of:
a) the first step in the salary range of the position to which assigned; or
b) the present salary plus two increments from the range of the position to which assigned; or
c) the present salary plus two increments in their current position. When an APT member is frequently assigned to assume some or all of the duties of another position, but not all of the assignments are for more than fifteen working days’ duration, the APT member may request that the cumulative effect of the substitution be considered under 13.3, or in some other equitable fashion. Employees who are subsequently appointed permanently to the position shall not have their salary reduced by the application of Article 17.3.2.
Temporary Assignment of Duties. 2801 In the event an employee is assigned temporarily to a higher paid position by the Department Head or his representative to other duties within the bargaining unit, he shall be paid the minimum rate or the next highest step in the pay range of the higher position above his present salary.
Temporary Assignment of Duties. 9.5.1 In some circumstances and with mutual agreement of the Employee, the Employer may assign an Employee to take on additional duties from another position or a special project, for a limited period of time not to exceed six (6) months. The Employee’s salary will be adjusted from the date of assignment to the greater of the range minimum of the salary grid to which assigned or an additional fifteen per cent (15%) of salary.
Temporary Assignment of Duties. 2901 In the event an employee is assigned temporarily to a higher paid position by the Department Head or his representative to other duties within the bargaining unit, for the majority of a given shift, he shall be paid the minimum rate or the next highest step above his present salary in the pay range of the higher position whose duties he is assigned to perform. No employee shall perform the work of a higher paid classification unless the afore-mentioned conditions are met. 2902 No employee of this bargaining unit shall do the work of a supervisor outside of the bargaining unit. 2903 An employee temporarily assuming a lower paid position will not have his salary reduced.
Temporary Assignment of Duties. In some circumstances and with With mutual agreement of the APT member, the University may assign an APT member to undertake another position, or a substantial portion of the duties of another position, for a limited period of time not to exceed 6 months. The details of the assignment shall be specified in writing to the APT member prior to the APT member deciding whether or not to agree to the assignment. If necessary, the regular duties shall be adjusted in order to perform the additional duties. If the temporary position is for twenty‐ eight or fewer consecutive calendar days, there shall be no adjustment in the APT member's pay. If the temporary position is for a period of more than twenty‐ eight consecutive calendar days, the APT member's salary shall be adjusted from the date of reassignment to the greater of:
(a) the first step in the salary range of the position to which assigned;
(b) the present salary plus two increments in the range of the position to which assigned;
(c) the present salary plus two increments in their current position range. If the temporary assignment is to an Out-of-Scope position the member’s salary shall be adjusted by 8%. Range maximums shall not apply when adjusting APT member’s salary under this clause. The temporary assignment of duties may be extended beyond the six months with mutual agreement of the APT member. The Out‐of‐Scope Head or Out‐of‐Scope Designate shall also review the workload of the position and restructure the area should the workload be excessive. The Faculty Association shall be informed of such reviews. Except in unusual circumstances as agreed to by the parties, the temporary assignment of duties shall not exceed a period of one year. When an APT member is frequently assigned to assume some or all of the duties of another position but not all of the assignments are for more than twenty‐ eight calendar days' duration, the APT member may request that the cumulative effect of the substitution be considered under 10.6 or in some other equitable fashion.
Temporary Assignment of Duties a. The District and PARA acknowledge that California Education Code 45101 requires that all classified positions have set duties, however, due to the current unforeseen and unprecedented nature of COVID-19, PARA bargaining unit members may be asked to perform duties not currently contained in their current job description or to assume additional job assignments. These duties may include, but are not limited to:
i. Assisting in the maintenance of the health and safety guidelines (e.g. temperature taking, questionnaire collection, supervision of ingress and egress of students and staff on a campus, wiping down areas, and removing trash within assigned workspace/classroom.
ii. Material distribution;
iii. Scripted phone calls/ communications with parents for the purposes of connecting students to the school program.
iv. Classroom setup.
b. District shall not assign bargaining unit members work that exceeds the education, experience, knowledge and ability outlined in their job description.
c. Other concerns specific to temporary out of class work will be referred to the Collective Bargaining Agreement, Article 7 Wages, Section 14(E).
d. The Parties agree the temporary assignment of duties is a solution to the current COVID- 19 pandemic needs and shall not be considered a waiver of the parties’ rights to negotiate the transfer of duties as required by law. These changes shall be solely temporary and shall not be considered precedent setting for either party.
e. The District shall provide any necessary training to unit members for all assigned temporary duties.
Temporary Assignment of Duties.
C9.1 Employees who are temporarily assigned duties at a higher classification for a period of 5 or more consecutive days will be entitled to payment at that classification level for the period.
C9.2 Payment for temporarily assigned duties at a higher classification level will be made at the greater of:
a) the first point within the relevant salary point range that exceeds the employee’s ordinary salary; or
b) at the next point in the relevant salary point range after the employee has performed at the higher classification level in the ACMA: for a continuous period of 12 months; or for a total period of more than 12 months, and has been rated at least as ‘meets expectations’ at the higher classification level under the Performance and Development Framework.
C9.3 During a period of temporary assignment, an employee will continue to receive payment at a higher APS classification level while on paid leave and on public holidays. C10. Temporary assignment of duties at SES level C10.1 Where an employee covered by this Agreement is temporarily assigned duties at the Senior Executive Service (SES) level for a period of 5 or more consecutive days, they will be paid additional remuneration as determined by the Chair, having regard to the duties to be undertaken and the duration of the temporary assignment, and the experience, qualifications and skills of the employee.
Temporary Assignment of Duties. 3403 An employee assigned in writing by the Service Director or designate to temporarily perform all or substantially all of the duties and responsibilities of a more highly paid classification shall be paid the rate of the higher classification for all hours worked in the higher classification. 3404 An employee who is temporarily assigned to perform the duties of a lower paid classification will continue at his former rate of pay.
