Approved Construction Documents. The Final Construction Documents shall be approved by Landlord (the “Approved Construction Documents”) prior to the commencement of construction of the Premises by Tenant; provided, however, Tenant may commence demolition work prior to Landlord’s approval of the Final Construction Documents with Landlord’s prior written consent, not to be unreasonably withheld, conditioned, or delayed. After approval by Landlord of the Final Construction Documents Tenant shall cause the Architect/Space Planner to submit the Approved Construction Documents to the appropriate municipal authorities for all architectural and structural permits (the “Permits”), provided that (a) the Architect/Space Planner shall provide Landlord with a copy of the package that it intends to submit prior to such submission, and (b) if there are Base Building modifications required to obtain the Permits, then Tenant shall obtain Landlord’s prior written consent to any such Base Building modifications. Tenant hereby agrees that neither Landlord nor Landlord’s consultants shall be responsible for obtaining any building permit or certificate of occupancy (or other documentation or approval allowing Tenant to legally occupy the Premises) for the Premises and that obtaining the same shall be Tenant’s responsibility; provided, however, that Landlord shall cooperate with Tenant in performing ministerial acts x000000.xx/XX EXHIBIT 3 373398-00076/i i-i3-i7/arb/jit 3 Recursion Pharmaceuticals, Inc.
Approved Construction Documents. Within 3 Business Days after receipt, Tenant shall (i) approve and return the Construction Documents to Landlord, or (ii) provide Landlord Tenant’s written requested changes to the Construction Documents, in which event Landlord shall have the Construction Documents revised (as Landlord deems appropriate) and resubmitted to Tenant for approval within 3 Business Days after receipt. If Tenant fails to request changes within such 3 Business Day period, Tenant shall be deemed to have approved the Construction Documents. Upon Tenant’s approval, the Construction Documents shall become the “Approved Construction Documents.” By granting approval of the Construction Documents (whether such approval is expressly granted or deemed given as provided above), Tenant shall be deemed to have confirmed by means of calculations or metering that the available capacity of the Building electrical system will support Tenant’s electrical requirements.
Approved Construction Documents. As further described in the Scope of Work, the approved Design Development Documents, and any further adjustments in the scope or quality of the Project authorized in writing by Owner, Contractor will prepare, for written approval by Owner, by the date specified in the Project Schedule, drawings and specifications setting forth in detail the requirements for the complete construction of the Facility (as approved by Owner, the “Construction Documents”). Following Owner’s written approval of the Construction Documents, Contractor will proceed with the remainder of the Work based upon the Scope of Work and Construction Documents.
Approved Construction Documents. Within 5 days after receipt, Tenant shall (i) approve and return the Construction Documents to Landlord, or (ii) provide Landlord Tenant's written requested changes to the Construction Documents, in which event Landlord shall have the Construction Documents revised (as Landlord deems appropriate) and resubmitted to Tenant for approval within 5 days after receipt. If Tenant fails to provide Landlord Tenant's written requested changes within the applicable 5 day period, Tenant shall be deemed to have approved the Construction Documents. Upon Tenant's approval, the Construction Documents shall become the "APPROVED CONSTRUCTION DOCUMENTS".
Approved Construction Documents. The Final Construction Documents as approved, or deemed approved by Landlord in accordance with Section 2.2(b) above shall be referred to herein as the “Approved Construction Documents”. Upon the determination of the Approved Construction Documents, Landlord and Tenant shall promptly confirm the same in writing and Tenant’s Architect shall use commercially reasonable efforts to submit the same to the appropriate municipal authorities for all applicable building permits on or before thirty days following the date that the Construction Documents are submitted to Landlord for approval; provided, however, that each day after such 30 day period until the date of submission shall constitute a Tenant Delay hereunder. Upon receipt of such permits, Tenant shall proceed with the completion of the Tenant’s Work in accordance with the Approved Construction Documents, all permits, approvals and Laws. Tenant hereby agrees that neither Landlord nor Landlord’s consultants shall be responsible for obtaining any building permit or certificate of occupancy for the First Floor South Wing Premises and that obtaining the same shall be Tenant’s sole responsibility; provided, however, that Landlord shall cooperate, at no cost to Landlord, with Tenant in executing permit applications and performing other ministerial acts necessary to enable Tenant to obtain any such permit or certificate of occupancy. No material changes, modifications or alterations in the Approved Construction Documents may be made without the prior written consent of Landlord, which consent shall not be unreasonably withheld, conditioned or delayed except to the extent such changes, modifications or alterations related to the structural components of the Building and/or the mechanical, engineering, plumbing or life safety systems of the Building (in which case Landlord may withhold its approval it is sole and absolute discretion).
Approved Construction Documents. The Construction Agent shall submit preliminary Plans and Specifications, Cost Budget, and Work Schedule to the City for approval. Upon approval by the City’s Council, the Standard Conditions, Plans and Specifications, Cost Budget and Work Schedule shall be developed to the extent necessary to commence competitive bidding of the Project. The Cost Budget will be revised, as necessary, and the Work Schedule and Draw Schedule, will be developed and completed by the Construction Agent prior to the commencement of construction and upon their completion will be submitted to the Owner’s Representative for review and to the City for approval. The date of commencement of the Work shall be the date fixed in a Notice to Proceed given by the City to the Construction Agent. The Work Schedule shall provide for timely completion of the Project by the Construction Agent and timely receipt of debt service payments related to the Project. Upon the City’s approval of such documents no further material changes shall be made except in accordance with Section 3.7 hereof. Said documents, as approved by the City, together with amendments or additions thereto, together with the Standard Conditions, Plans and Specifications, are called the “Approved Construction Documents.” The City’s approval of the Approved Construction Documents shall not alter the Construction Agent’s liability under this Agreement or any of the other Operative Documents and shall not impose any liability upon the City.

Upon Tenant’s approval, the Construction Documents shall become the “Approved Construction Documents”. Tenant designates Xxxxxxx X. Xxxxx III (“Tenant’s Representative”) as the person authorized to approve all plans, drawings, change orders, and approvals pursuant to this Construction Agreement. Landlord shall not be obligated to respond to or act upon any such item until such item has been approved in writing by Tenant’s Representative. 2.

Approved Construction Documents. No later than March 1, 1997, Tenant shall submit to Landlord complete, finished and detailed architectural, mechanical, electrical and plumbing drawings and specifications to include Tenant's partition layout, reflected ceiling, telephone and electrical outlets and equipment rooms, doors (including hardware and keying schedule), glass partitions, windows and doors, critical dimensions, heavy equipment requirements, millwork and finish schedules, air conditioning and heating systems, ductwork, and electrical facilities, together with all supporting information and delivery schedules ("Approved Construction Documents"). If Tenant fails to deliver all of Approved Construction Documents by such date, each calendar day of such delay shall be one day of "Tenant Delay".

Upon Landlord’s and Tenant’s approval, the Construction Documents shall become the “Approved Construction Documents.”
