Assignment Duration. A. The Association and the Department agree that opportunities for various assignments should be made available to Port Police Lieutenants. Reasonable time limits in an assignment increase the opportunity for Unit members to learn specialized skills and ensure a wider dissemination of knowledge, experience, and expertise throughout the Port Police Division.
B. Port Police Lieutenant assignments are normally made for a minimum of three years. Temporary extensions may be granted on a case-by-case basis by the Port Warden II, who is the Chief of the Port Police Division within the Department.
C. The establishment, duties, and staffing levels of special assignments are based on the needs of the Port Police Division and are at the discretion of the Port Warden II.
D. The creation or reduction of assignment positions and length thereof are at the discretion of the Port Warden II.
E. Regardless of time in a specialized assignment, an employee may be reassigned when:
1. An employee requests to be moved from the position;
2. An evaluation of the performance of the assigned employee is below acceptable standards and the employee fails to correct performance problems within a reasonable time period;
3. An employee commits an act of misconduct;
4. The position is no longer necessary as deemed by the Port Warden II or their designee and is eliminated; or,
5. The Port Warden II determines that positions must be rotated sooner based on the needs of the Port Police Division.
Assignment Duration a. Contract Placement
Assignment Duration. It is the intent of the parties that the Assignment shall continue until the occurrence of a Divestiture. However, if no Divestiture shall have occurred on or before the second anniversary of the date hereof, or if a Divestiture does occur, but the Executive is not offered a Qualifying Position (as defined below), the Executive may request, by written notice to American delivered not later than 30 days after (and not earlier than 30 days before) the event (or the expected occurrence of the event) referenced in the immediately preceding sentence, that American negotiate with the Executive in good faith to find a suitable position for the Executive at American on mutually agreeable terms. If such an agreement is reached between American and the Executive, the Assignment will terminate and, notwithstanding anything else herein to the contrary, including but not limited to Section 4, neither party shall have any further rights or obligations under this Agreement.
Assignment Duration a. Assignments will run for a limited time up to the agreed end date and/or the completion of the agreed assignment. The assignment will end ipso jure at that point.
b. Notice of early termination of an assignment should be given in writing, subject to a notice period of at least one month.
c. Xxxxxxxxx Xxxxx is entitled to suspend the completion of all current assignments between the client and Xxxxxxxxx Xxxxx, or to terminate these assignments without serving notice of default and without any obligation to compensate for damage, if: • the client fails to (promptly) fulfil any obligations under the assignment; • it becomes apparent that the client will not, not fully and/or not promptly fulfil or be able to fulfil its obligations towards Xxxxxxxxx Xxxxx; • the client is under liquidation, has been declared bankrupt or has applied for suspension of payment. If an assignment is terminated, the obligations of the client towards Xxxxxxxxx Xxxxx will become due immediately.
d. An assignment will end ipso jure if and when Xxxxxxxxx Xxxxx is no longer able to contract the IP because the model agreement between Xxxxxxxxx Xxxxx and the IP has been terminated for whatever reason. In this event, no failure to meet its obligations towards the client may be attributed to Xxxxxxxxx Xxxxx, and Xxxxxxxxx Xxxxx will not accept liability for any damage suffered by the client as a result. The IP is entitled to set his/her own working times and hours within the specifications of the assignment and the requirements for proper performance of the assignment.
Assignment Duration. Employees assigned to the Peak Period Engine Company shall be assigned for a minimum of two (2) years. If an employee is as assigned to the Peak Period Engine Company involuntarily, the assignment shall be for nine (9) months. Employees assigned to the Peak Period Engine Company may petition the Fire Chief to return to a regular 56-hour work schedule for any reasonable reason, including but not limited to an emergency. Upon completion of an employee's assignment to the Peak Period Engine, the employee will be assigned to the same shift (A, B, or C) that the employee was assigned immediately prior to service on the Peak Period Engine Company. Assignments to the Peak Period Engine Company may be shortened at the department's discretion or last longer if mutually agreed upon by the employee and the Fire Chief.
