Basic Rights. NESPA shall have the sole and exclusive right to present all employees in the negotiating unit in any and all proceedings under the Public Employees Fair Employment Act; to designate its own representatives and to appear before and appropriate official of the District to effect such representation; to direct, manage and govern its own affairs; to determine and pursue the wishes of the membership free from any interference, restraint, coercion and discrimination by the District or any of its agents.
Basic Rights. 1. In addition to basic rights already enjoyed, the following rights of all citizens residing in the Bangsamoro bind the legislature, executive and judiciary as directly enforceable law and are guaranteed: a. Right to life and to inviolability of one’s person and dignity; b. Right to freedom and expression of religion and beliefs; c. Right to privacy; d. Right to freedom of speech; e. Right to express political opinion and pursue democratically political aspiration; f. Right to seek constitutional change by peaceful and legitimate means; g. Right of women to meaningful political participation, and protection from all forms of violence; h. Right to freely choose one’s place of residence and the inviolability of the home; i. Right to equal opportunity and non-­‐discrimination in social and economic activity and the public service, regardless of class, creed, disability, gender and ethnicity;

Basic Rights. The Board retains and reserves unto itself all powers, duties, and responsibilities conferred upon and vested in it by the statutes of the State of Illinois. The Board shall not be required to bargain over matters of inherent managerial policy, which shall include such areas of discretion or policy as the functions of the employer, standards of services, its overall budget, the organizational structure and selection of new employees and direction of employees.
Basic Rights. The Company retains all rights to manage and direct the operations 39 except to the extent such rights are specifically limited or modified by the terms of this 40 Agreement. Basic Rights. Nothing in this Agreement shall affect the authority of any management official: A. To determine the mission, budget, organization, number of employees, and internal security practice of this Agency. 1. To hire, assign, direct, lay off, and retain employees in the Agency, or to suspend, remove, reduce in grade or pay, or take other disciplinary action against such employees; 2. To assign work, to make determinations with respect to contracting out, and to determine the personnel by which Agency operations shall be conducted; 3. With respect to filling positions, to make selections for appointments from among properly ranked and certified candidates for promotion, or any other appropriate source; and 4. To take whatever actions may be necessary to carry out the Agency mission during emergencies.

Vested property rights shall be recognized and respected. With respect to the legitimate grievances of the Bangsamoro people arising from any unjust dispossession of their territorial and proprietary rights, customary land tenure or their marginalization shall be acknowledged. Whenever restoration is no longer possible, the Central Government and the Government of the Bangsamoro shall take effective measures for adequate reparation collectively beneficial to the Bangsamoro people in such quality, quantity and status to be determined mutually. 3. Indigenous peoples’ rights shall be respected. 4. The Central Government shall ensure the protection of the rights of the Bangsamoro people residing outside the territory of the Bangsamoro and undertake programs for the rehabilitation and development of their communities. The Bangsamoro Government may provide assistance to their communities to enhance their economic, social and cultural development.
Basic Rights. Nothing contained herein shall be construed to deny any employee rights (s)he may have under the Illinois School Code or under other applicable laws and regulations.
