Before Use. The DCE shall retain copies of all written and electronic Marketing Materials and appropriate records for all Marketing Activities in a manner consistent with Section 16.02.
Before Use. The scaffold must be suitable for the intended use. Prior to a scaffold being used, make sure there is positive indication that the scaffold is ready for use. The scaffold should not have any tag, notice or sign that advises that the scaffold should not be used or should be limited in its use. The working platform must contain no litter and must not have been adversely affected in any way by previous users. The approaches, accesses, walkways and egresses must be suitable for transportation of the materials and equipment intended to be used. Means must be provided for the movement of materials to and from the working platforms with minimum risk. Effective lighting of all approaches, accessways, walkways, working platforms and exits must be provided. Lighted areas should be free from glare and deep shadow. The scaffold and its supporting structure must not be subject to instability, as a result of any tunnelling, drilling, trenching or other excavation work.

Before Use. All rentals must be paid in full in advance. The balance of the rental fee is due two days before the event or the first of the month for monthly renters. Rent may be left in the locked rent collection box on the wall outside the studio door, across from the men’s dressing rooms. There will be a $5/day late fee incurred for monthly rentals received after the 3rd day of the month. • Please note (and notify your dancers, if necessary) that appropriate dance shoes are required. Indoor shoes only. No marking black-soled tennis or aerobics shoes are permitted in the studio. Heels should be free of protruding nails. No tap shoes allowed. All street shoes are to be removed at the entrance to the space and stored in the area provided. • If another group is scheduled in the dance studio immediately before yours, please wait in the lobby until your rental time begins. Items in the lobby are the property of Halfmoon Acupuncture and Pilates. Begin and end your class or event at your scheduled time. • Items in the lobby are the property of Halfmoon Acupuncture and Pilates. Renters are responsible for the actions of their students and must assure the safety and proper use of all equipment, returning equipment safely to their appropriate place. Desks are not to be used to sign in classes or in any other capacity. • The Pilates Studio is not part of this rental agreement and is a private space. Renters and their students will not use the equipment in any way, or enter the studio. Renters are fully responsible for any damage occurred to the Pilates studio equipment or physical injury to a guest who may enter the studio. • If there is no one in the Halfmoon space during your use, please lock the front door to prevent security issues. Participants who arrive late can ring the doorbell by the front entrance door to be let in. • Shift Movement and Healing Arts, LLC is not responsible for accidents, injury, illness or loss of group or individual property. Please remind all participants to take safety precautions. • Do not put tape on the dance floor. Do not drag anything across the floor. Before Use. Check the weather for incoming tides as well as the strength of the waves, wind strength, storms and heat prior to hiring the wheelchair. The staff at Bribie Island Surf Lifesaving Club will be able to provide you with helpful information about weather conditions and suitability for beach wheelchair use. • Ensure walkway/routes to be taken are clear of hazards. • Visually inspect seating, tyres and moving parts for possible damage and report same to Bribie Island SLSC immediately. • Ensure the support person(s) stabilise the wheelchair so that it will not move when a person is being seated. Mobi-Chair Only: • The Mobi-Chair has been designed to be used on dry sand, wet sand, at the water’s edge, and to float in shallow water levels up to waist height of a support person in still water conditions. • It is recommended that all harnesses are securely fastened at all times to ensure safe and stable positioning. The harnesses can easily be adjusted in length to create a suitable fit. • The backrest angle can be adjusted into three positions by pulling the looped chain located at the back of the chair behind the backrest. • When entering the water to float: o Follow any directions given by the volunteer surf lifesavers on patrol. o two support people must accompany the wheelchair user. o the chair must not be taken to a depth which exceeds waist height of the shortest support person. • The Mobi-Chair will begin to float as the water level reaches half way up the balloon tyres. At this point, the user will notice a small tilt backwards as the chair transitions into the floating position. Mobi-Chair and Sandcruiser: • Do not exceed maximum recommended loading of each wheelchair: o Sandcruiser - 120kg o Mobi-Chair - 150kg. • When parking the wheelchair, find a level surface to park on and do not leave a wheelchair user unattended. • The wheelchair is not designed for self-propulsion (independent use) and must be supervised and pushed by a responsible support person. • Gradients steeper than a standard ramp rise are not recommended unless two people are assisting to propel the chair. • The nominated support person should always keep the chair user informed about what they are intending to do (turning, entering water, crossing road, etc). • The wheelchair must not be propelled by being towed behind a motor vehicle, kite or other means, other than being pushed/pulled by a support person • Ensure heavy items are not placed on back of the wheelchairs. • The wheelchair i...

  • Exclusive Use (A) After the Occupancy Date, Lessee expressly agrees and warrants that the Leased Premises will be used exclusively as a Champps Restaurant or other casual dining sit-down restaurant. In any other such case, after obtaining Lessor's prior written consent, such consent not to be unreasonably withheld or delayed, Lessee may conduct any lawful business from the Leased Premises. Lessee acknowledges and agrees that any other use without the prior written consent of Lessor will constitute a default under and a violation and breach of this Lease. Lessee agrees: To open for business within a reasonable period of time after completion of construction of the contemplated Improvements; to operate all of the Leased Premises during the Term or Renewal Terms during regular and customary hours for businesses similar to the permitted exclusive use stated herein, unless prevented from doing so by causes beyond Lessee's control or due to remodeling; and to conduct its business in a professional and reputable manner. (B) If the Leased Premises are not operated as a Champps Restaurant or other casual dining sit-down restaurant or other permitted use hereunder, or remain closed for thirty (30) consecutive days (unless such closure results from reasons beyond Lessee's reasonable control) and in the event Lessee fails to pay Rent when due or fulfill any other obligation hereunder, then Lessee shall be in default hereunder and Lessor may, at its option, cancel this Lease by giving written notice to Lessee or exercise any other right or remedy that Lessor may have; provided, however, that closings shall be reasonably permitted for replacement of trade fixtures or during periods of repair after destruction or due to remodeling.
