Civic Center Act. Charter School agrees to comply with the provisions of the Civic Center Act (Education Code § 38131 et seq.) to make the Premises accessible to members of the community. The Parties understand that the Premises are to be used primarily for educational programs and activities and, as such, any use of the Premises by the Community shall not interfere with Charter School’s educational program or activities. Any request received by Charter School for use of the Premises pursuant to the Civic Center Act shall be promptly forwarded to the District. District shall be responsible for coordinating access to the Premises under the Civic Center Act, and any fee paid for use of the Premises under the Civic Center Act shall be paid to the District.

Civic Center Act. The Parties understand and agree that use of school facilities and grounds as a civic center, including but not limited to scheduling, use, fee collection, is governed by the Civic Center Act, California Education Code section 38130; et seq., and City agrees to comply with the Civic Center Act in its management of the use of school facilities or grounds in performance of this Agreement.
Civic Center Act. Unless otherwise provided in this Agreement, Charter School shall have full and primary use of the allocated Facilities to which it has been assigned separate access only, and not shared access, from no earlier than 7:00 a.m. through 4:45
Civic Center Act. The Charter School agrees to comply with the provisions of the Civic Center Act (Education Code Section 38131, et seq.) in making use of the Facilities accessible to members of the community. The Parties understand that the Facilities are to be primarily used for school programs and activities and as such any use of the Facilities by members of the community shall not interfere with school activities. District Board Policy and Administrative Regulations related to the Civic Center Act shall control scheduling, use and collection of fees related to use of the Facilities by members of the public. Consistent with that policy and the regulations, the District shall be solely responsible for coordinating access to the Facilities under the Civic Center Act and shall require users to provide appropriate proof of insurance related to use of the Facilities and to indemnify and hold harmless the District and Charter School for injury, risk of loss, or damage to property as a result of that access by members of the community. The District agrees to promptly clean and repair, if necessary, any portion of the Facilities used by members of the community immediately following such use. All requests for use of the Facilities made directly to the Charter School shall be forwarded to the District for coordination of use consistent with Board Policy and Administrative Regulations.
Civic Center Act. Use of the PREMISES and PROPERTY are subject to the Civic Center Act (Education Code section 38131 et seq.) and District Policies and Regulations for making use of the facilities accessible to members of the community. LESSEE shall have primary use of the space allocated at the PREMISES for the operation of its educational program during its regular school hours; provided, however, that after 6:00 pm during the week and all day on weekends and holidays, the PREMISES and PROPERTY shall be subject to use by the public pursuant to the Civic Center Act and/or any joint use or recreational program use that has been established by the LESSOR. In the event LESSEE requires use of the PREMISES outside of regular school hours (e.g., Back-To-School Night, parent education and information nights, student performances, etc.), LESSEE shall coordinate such usage with LESSOR. LESSOR shall be in charge of accepting, reviewing and assigning use permits for use of facilities on the PREMISES in accordance with its Board policy and in accordance with its online application process; provided, however, that all such permits shall be coordinated with LESSEE so as not to unreasonably disrupt LESSEE’s program.
Civic Center Act. After 6:30 pm during the week and all day on weekends and holidays, the Locust Site and/or Birch Site shall be subject to use by the public pursuant to the Civic Center Act (Education Code Section 38131 et seq.) and/or any joint use or recreational program use that has been deemed appropriate by the District. Charter School and District shall meet prior to the beginning of each semester and prior to the beginning of summer vacation to schedule Charter School activities directly related to the Charter School’s educational program (such as back to school nights, board meetings, school plays and similar) during the times otherwise subject to use pursuant to the Civic Center Act or other use deemed appropriate by the District. For any use not scheduled at the beginning of the semester, or for any use not directly related to the Charter School’s educational program, as provided for in the Charter, Charter School must submit a facilities request through the District’s online system and reimburse the District for additional costs incurred related to its use (e.g., custodial overtime not already included in the Charter School’s Facilities Fee paid pursuant to this Agreement) but the Charter School shall not be charged an additional use fee. Civic Center Act use requests, for use of the Subject Property and/or Birch Site by users other than Charter School, shall be evaluated and handled by the District, but coordinated with the Charter School. The District will consult with Charter School prior to scheduling any Civic Center Act use of space allocated to Charter School’s exclusive use, and shall ensure that no uses are scheduled when the Charter School has use of the requested space. Charter School shall direct all Civic Center Act requests for use of the Locust Site and/or Birch Site to the District’s Associate Superintendent, Business Services. All proceeds derived from the use of the Subject Property and/or Birch Site pursuant to the Civic Center Act or as otherwise provided for in this Section 1.B shall be the property of the District and the District shall be responsible for cleaning and repairing the Subject Property and/or Birch Site after each Civic Center Act use.
Civic Center Act. The DISTRICT, on at least seven (7) days advance written notice to Tenant, shall be entitled to use the auditorium and the grounds of the Premises for activities permitted under the Civic Center Act, so long as such use is outside of the Tenant’s school hours, and/or does not interfere with a previously scheduled after hour Tenant event or activity (collectively for each such use, the “Civic Center Activities”), and TENANT shall cooperate with the DISTRICT’s election to do so. Notwithstanding anything to the contrary, DISTRICT shall be responsible (at the DISTRICT’s sole cost and expense) for any damage to the Premises and/or any cleanup of the Premises that may be required or caused as a result of any of the Civic Center Activities at the Premises. DISTRICT hereby agrees to indemnify, defend, protect, and hold harmless TENANT, its directors, trustees, officers, employees, contractors, and/or volunteers (collectively, the “Tenant Indemnified Parties”) from any and all Claims (as defined below) arising out of any liability or damage (including cleanup costs) to person or property (including, without limitation, any property of Tenant located at the Premises), or any other loss, sustained or claimed to have been sustained by any of the Tenant Indemnified Parties arising out of any of the Civic Center Activities, except for any Claims caused solely by willful misconduct or negligence attributable to any of the Tenant Indemnified Parties.

Civic Center Act. Unless otherwise provided in this Agreement, Charter School shall have full, exclusive, and primary use of the allocated Facilities to which it has been assigned exclusive access only, and not shared access, from no earlier than 7:00 a.m. through 4:45 p.m. from Monday through Friday, during regular school days. Access to Charter School’s allocated Facilities by third parties shall be governed by the terms of the Civic Center Act. (Ed. Code section 38130 et seq.) before and after these scheduled times during the week and all day on weekends and holidays. The District shall make all determinations with respect to all requests to use the Site and above-described facilities under the Civic Center Act.
Civic Center Act. Contractor shall provide facilities for community use as required under the Civic Center Act. The Contractor shall be authorized to use the grounds at any time its use would not conflict with the use permit that has been issued to another individual/organization, which is in effect at that time. District or its designee shall be responsible for the issuing of use permit.
Civic Center Act. Both parties acknowledge that the School Site, including the Facilities, will be identified as a “Civic Center” pursuant to the Civic Center Act (Education Code Section 38130 et seq.). Both parties understand that other individuals and/or entities may utilize the School Site, including the Facilities, pursuant to the Civic Center Act, as applicable.
