Composition and Functions. 1. The Joint Council shall be composed, on the one hand, of the members of the Council of the European Union and relevant members of the European Commission or their representatives, and, on the other hand, the Ministers of the SADC EPA States or their representatives.
2. Without prejudice to the functions of the Council of Ministers as defined in Article 15 of the Cotonou Agreement, the functions of the Joint Council shall be to:
(a) be responsible for the operation and implementation of this Agreement and shall monitor the fulfilment of its objectives;
(b) examine any major issues arising within the framework of this Agreement that are of common interest and affect trade between the Parties;
(c) examine proposals and recommendations from the Parties for the review of this Agreement;
(d) make appropriate recommendations;
(e) monitor the development of economic and trade relations between the Parties;
(f) monitor and assess the impact of the cooperation provisions of this Agreement on sustainable development;
(g) monitor and review progress on all matters covered by this Agreement;
(h) establish the rules of procedures of the Trade and Development Committee;
(i) monitor the work of the Trade and Development Committee; and
(j) perform any other duties under this Agreement.
3. The Joint Council may provide periodic reports on the operation of this Agreement to the Council of Ministers established in accordance with Article 15 of the Cotonou Agreement.

The Joint Council shall be composed, on the one hand, of the relevant Secretary of State of the United Kingdom or their representatives, and, on the other hand, of the relevant Ministers of the SACU Member States and Mozambique or their representatives. The first meeting of the Joint Council shall be co-chaired by the Parties.
2. In relation to matters where SACU acts collectively for purposes of this Agreement, SACU shall act collectively in such matters under this provision and the UK shall treat SACU as such. In relation to matters where Member States of SACU act individually in such matters under this provision, the specific SACU Member State shall act in that capacity and the UK shall treat that Member State as such.
3. The functions of the Joint Council shall be to:

Composition and Functions. The Council of Ministers shall consist of Ministers of the Governments of States members of the Organization who are responsible for the administration of intellectual property.
Composition and Functions. The Joint Council shall be composed, on the one hand, of the relevant members of the Council of the EU and relevant members of the European Commission or their representatives, and, on the other hand, of the relevant Ministers of the SADC EPA States or their representatives. The Administrative Council shall consist of Heads of Offices dealing with the administration of intellectual property in members of the Organization, provided that any member may nominate any other person or persons to represent it in the Administrative Council whom it considers to have the requisite knowledge of intellectual property.

In relation to matters where SACU acts collectively for purposes of this Agreement, SACU will act as collective under this provision and the EC Party shall treat SACU as such, and where Member States of SACU act individually, the specific Member State will act in that capacity and the EC party shall treat that Member State as such.
3. Without prejudice to the functions of the Council of Ministers as defined in Article 15 of the Cotonou Agreement, the functions of the Joint Council shall be to:
Composition and Functions. In accordance with the provisions of Article 91 of the Workers' Statute, a Joint Joint Committee for the interpretation and monitoring of the Agreement is hereby established. The Commission shall be based in Madrid. The Committee shall be composed on a parity basis of five representatives of each party, trade unions and companies that are signatories to the Agreement. With the same criteria, there shall be four alternates for each representation. The Commission may request occasional or permanent advisory services on any matters within its competence, through persons freely appointed by the parties, who shall have the right to speak but not to vote. Each year, the Committee shall elect a Chairmanship and a Secretariat from among its members with voice and vote. Both the Chairmanship and the Secretariat shall be held alternately by the trade union and employer representatives, and the two positions may not be held simultaneously by the same representative. The resolutions of the Commission shall in any case require the favourable vote of the majority of each of the two representations. These are specific functions of the Commission:
a) Surveillance and interpretation of this Agreement and monitoring for the application and development of said regulations, drawing up, in accordance with the provisions of Article 91 of the Workers' Statute.
b) Mediation in the event of disagreement after the end of the consultation period in procedures for substantial modification of working conditions (article 41 of the Workers' Statute), internal flexibility, collective redundancy procedures or any other procedure that the parties voluntarily decide to submit to this Committee.
c) Prior information in the event of non-application of the Agreement, being able to mediate between the parties, if either of them so request.
d) To mediate in those conflicts that are voluntarily and jointly submitted to them by the affected parties and which concern the application or interpretation of the aforementioned sectorial regulations.
e) To hear, prior to administrative and judicial proceedings, collective disputes that may be brought by those entitled to do so, with regard to the application of the precepts derived from this Collective Bargaining Agreement. The submission and settlement of a matter by the Joint Committee shall exempt the Joint Committee from the procedure of prior knowledge when the matter is repeated.
