CONSERVATION AREA. 14.1 The Gates at Hilton incorporates a conservation area, identified on the layout plan. This is area is designated for the use and enjoyment of all Property Owners and the Hilton college community, subject to the following. No one shall: 14.1.1 disturb, harm or destroy any wild animal, insect, reptile bird or plant; 14.1.2 light any fire other than at a place designated for that purpose and subject to proper fire control measures; 14.1.3 set snares, traps or any similar device; 14.1.4 dump refuse or litter; 14.1.5 disturb, destroy or collect any plant material, whether alive or dead; 14.1.6 camp.

CONSERVATION AREA a. Subject to obtaining any required State of North Carolina approval, the University shall convey one or more conservation easements for the areas described in this Section to the State, a local government, or a body that is both organized to receive and administer lands for conservation purposes and qualified to receive charitable contributions pursuant to G.S. 105-130.9. The conservation area required by this section comprises approximately 311 acres. b. It is the intent of the Town and University that the conservation easement(s) shall constitute a “conservation agreement” as defined by G.S. 121-35(1) in that the conservation easement(s) shall serve to retain the applicable land and water areas predominantly in their natural, scenic or open condition. In general, the conservation easement(s) shall forbid or limit any or all (i) construction or placing of buildings, roads, signs, billboards or other advertising, utilities or other structures on or above the ground, (ii) dumping or placing of soil or other substance or material as landfill, or dumping or placing of trash, waste or unsightly or offensive materials, (iii) removal or destruction of trees, shrubs or other vegetation, (iv) excavation, dredging or removal of loam, peat, gravel, soil, rock or other mineral substance in such manner as to affect the surface, (v) surface use except for agricultural, farming, forest or outdoor recreational purposes or purposes permitting the land or water area to remain predominantly in its natural condition, (vi) activities detrimental to drainage, flood control, water conservation, erosion control or soil conservation, or (vii) other acts or uses detrimental to such retention of land or water areas. The conservation easement(s) shall allow the University to undertake appropriate research and educational activities within the area covered by the easement. The conservation easement(s) shall not automatically preclude utility and road crossings that are consistent with the provisions of the Resource Conservation District provisions of Section 3.6.3 of the LUMO and the terms of this Agreement. c. This conservation easement(s) shall cover the following critical natural areas located within the Carolina North Tract: Those six areas labeled areas 1, 2, 3, 4, 5, and 6A within the Carolina North Tract set forth on Map G-1 attached to this Exhibit (approximately 311 acres). CONSERVATION AREA. (a) If the Conservation Area determined by the Final Survey varies by more than 10% (greater or less) from the number of acres described in the definition of “Conservation Area” in Section 1 above, then Project Sponsor may, but is not required to, terminate this Agreement by providing written notice to Owner within ten (10) business days after Project Sponsor’s receipt of the Final Survey. (b) If Project Sponsor reasonably believes that Owner owns less than the entire fee simple estate in the Property, Project Sponsor (in addition to its other rights and remedies hereunder) may (i) terminate this Agreement or (ii) proceed to the Closing, in which case Owner shall be required to execute and deliver Conservation Instruments and other required the Closing documents hereunder with respect to all of its ownership interest in the Property.
CONSERVATION AREA. An area of the historic core of the town has been designated on the Specific Objectives Map as an Architectural Conservation Area. EC3 It is an objective of the Council to protect and enhance the character of this area. The repair and refurbishment of existing buildings will be favoured over demolition and new build. New development should be sympathetic in scale, massing and detailed design to the existing character of the area. Specifically, the repair (or replacement with replicas if necessary) of original timber sash windows, cast iron rainwater goods and railings, natural slate roofs, chimneys and external renders will be sought for all buildings within this area. New shop fronts and signage should be traditional in design and respect the character, scale proportions of the original building. CONSERVATION AREA. In addition to protecting individual buildings and structures, the Council is aware that many other buildings, while not of sufficient merit to warrant individual listing, are nevertheless important in the context of their contribution to the streetscape. Main St. and the smaller side streets leading of it are particularly important in this regard. The Main Street is an identifying feature of Maynooth. The axis formed by this street, the University campus, Lime Walk and the Carton Estate and the minor cross-axis along the Moyglare Rd./Leinster St. to the Harbour, is an interesting example of 18th century urban design. The Council will seek the retention and restoration of the external fabric of buildings within this zone. Particular attention will be paid to the retention and repair (or replacement with replicas of the original if necessary) of original natural slate roofs, chimneys, cast iron rainwater goods and railings, external renders, original timber sash windows and shop fronts. The Council will pursue such grant aid and/or tax incentives as may be made available in support of this policy.
CONSERVATION AREA. The Conservation Area is generally located in the Kalulu ahupuaʻa on the island of Xxxx‘i (see Figures 1 and 2). CONSERVATION AREA. The County will be solely responsible for the maintenance of the Conservation Area, including but not limited to and any and all fencing or other improvements to the Conservation Area, in its sole and absolute discretion. The County further agrees to be responsible for the removal of invasive vegetation and species within the Conservation Area.

  • Common Areas Tenant shall have the non-exclusive right to use in common with other tenants in the Project, and subject to the Rules and Regulations referred to in Article 5 of this Lease, those portions of the Project which are provided, from time to time, for use in common by Landlord, Tenant and any other tenants of the Project (such areas, together with such other portions of the Project designated by Landlord, in its discretion, including certain areas designated for the exclusive use of certain tenants, or to be shared by Landlord and certain tenants, are collectively referred to herein as the “Common Areas”). The Common Areas shall consist of the “Project Common Areas” and the “Building Common Areas.” The term “Project Common Areas,” as used in this Lease, shall mean the portion of the Project designated as such by Landlord or areas within the Project that the occupants of the Building are permitted to utilize pursuant to a recorded declaration and which areas shall be maintained in accordance with the declaration. The term “Building Common Areas,” as used in this Lease, shall mean the portions of the Common Areas located within the Building reasonably designated as such by Landlord. The manner in which the Common Areas are maintained and operated shall be at the reasonable discretion of Landlord and the use thereof shall be subject to the Rules and Regulations as Landlord may make from time to time. Landlord reserves the right to close temporarily, make alterations or additions to, or change the location of elements of the Project and the Common Areas, provided that, in connection therewith, Landlord shall perform such closures, alterations, additions or changes in a commercially reasonable manner and, in connection therewith, shall use commercially reasonable efforts to minimize any material interference with Tenant’s use of and access to the Premises.

  • Drainage ▪ Prevent silt bearing road surface and ditch runoff from delivering sediment to any streams or wetlands. ▪ Maintain rolling dips and drivable waterbars as needed to keep them functioning as intended. ▪ Maintain headwalls to the road shoulder level with material that will resist erosion. ▪ Maintain energy dissipaters at culvert outlets with non-erodible material or rock. ▪ Keep ditches, culverts, and other drainage structures clear of obstructions and functioning as intended. ▪ Inspect and clean culverts at least monthly, with additional inspections during storms and periods of high runoff. This shall be done even during periods of inactivity. ▪ Perform preventative maintenance work to safeguard against storm damage, such as blading to ensure correct runoff, ditch and culvert cleaning, and waterbar maintenance.

  • Leased Premises Lessor hereby leases to Lessee, and Lessee leases and takes from Lessor, the Leased Premises subject to the conditions of this Lease.

  • Energy Conservation The Contractor agrees to comply with mandatory standards and policies relating to energy efficiency which are contained in the state energy conservation plan issued in compliance with the Energy Policy and Conservation Act.
