Consumer compliance. Subject to clause 20, the Retailer will procure in its agreements with Consumers a requirement that all of the Consumer’s Installations are compliant, and are operated in accordance with the Network Connection Standards.

This program shall include at a minimum: (a) a written description of the duties and responsibilities of the compliance officer; (b) adequate internal controls to ensure compliance with consumer protection laws, rules, and regulations; (c) the preparation of a policies and procedures manual covering all consumer protection laws, rules, and regulations for use by appropriate Bank personnel in the performance of their duties and responsibilities and specifically tailored to the Bank’s deposit and lending practices; (d) timely updates of the written policies and procedures manual to ensure it remains current; (e) a formalized risk assessment process and annual audit plan to use in determining the frequency and scope of ongoing compliance monitoring and audit; (f) a comprehensive independent audit program to adequately test for compliance with consumer protection laws, rules and regulations; (g) procedures to ensure that exceptions noted in the audit reports are corrected and responded to by the appropriate Bank personnel; (h) the education and training of all appropriate Bank personnel in the requirements of all applicable federal and state consumer protection laws, rules and regulations; (i) procedures for the dissemination of changes in laws, rules, regulations and OCC policy changes to affected Bank personnel; and (j) periodic reporting of the results of the consumer compliance audit to the Board or a committee thereof. Consumer compliance. The Board has submitted to the Regional Director, for his prior written approval, revisions to update and amend the Association's September 7, 2001 Consumer Compliance Plan to address certain issues raised by the CROE (Consumer Compliance Policy). The OTS is currently reviewing the Consumer Compliance Policy to determine whether it complies with the minimal standards outlined in subsections a through e, below. a. The Consumer Compliance Policy must include, at a minimum, the following provisions relating to administration: i. procedures for a reporting mechanism to permit the Board to determine that Management is completing the compliance procedures set forth in the Consumer Compliance Policy; ii. procedures that will ensure all loans adhere to risk-based pricing guidelines, and that broker and loan fees are not excessive, and requiring detailed written explanations of variations from investor rate sheets; iii. procedures to enhance record retention and ensure compliance with regulatory requirements; iv. procedures requiring all loans include an analysis of the borrower's ability to repay the loan from assets or income independent of the collateral for the loan; v. procedures requiring that the analysis set forth in iv., above, will include, without limitation, applicable debt to income ratios, sources of income, and the impact of any pre-payment or balloon features of the loan; and vi. the procedures in iv and v above shall be implemented regardless of whether the Association is required by Section 3(a)(ii) to adhere to underwriting guidelines of individual investors that do not include such procedures. b. The Consumer Compliance Policy must include, at a minimum, the following provisions relating to the Home Mortgage Disclosure Act: i. procedures implementing a program of testing data generated pursuant to the requirements of the Home Mortgage Disclosure Act (HMDA) and Regulation C (12 C.F.R. Part 203); and ii. procedures ensuring that specific fields are being completed correctly. c. The Consumer Compliance Policy must include, at a minimum, the following provisions relating to the Truth in Lending Act: i. procedures ensuring that the Association will address the 14 loans identified at page 10 of the CROE that violate the provisions of 12 C.F.R. (S)226.32; ii. a plan, acceptable to the Regional Director, that will relieve these 14 borrowers from paying a prepayment penalty on the loans in question; and iii. provisions ensuring that the Board will adopt ...
Consumer compliance. (1) Within ninety (90) days, the Board shall adopt a written consumer compliance program designed to ensure that the Bank is operating in compliance with the Flood Disaster Protection Act (FDPA) and all applicable consumer protection laws, rules and regulations. This program shall include, but not be limited to: (a) a written description of the duties and responsibilities of the compliance officer; (b) adequate internal controls to ensure compliance with the FDPA and all other applicable consumer protection laws, rules, and regulations; (c) a process to ensure that all loans (including loans outstanding as of the date of the XXX and all new loans) secured by properties located in a flood zone have adequate flood insurance coverage, as directed in the most recent XXX, and if flood insurance coverage is found to be less than the amount required by 12 C.F.R. § 22.3, the bank must obtain coverage in accordance with 12 C.F.R. § 22.7; (d) a process to monitor loans in special flood hazard areas throughout the life of those loans, identify loans that have inadequate coverage, and force place flood insurance when needed, in accordance with 12 C.F.R. Part 22; (e) an internal audit program to test for compliance with FDPA and other applicable consumer protection laws, rules and regulations; (f) procedures to ensure that exceptions noted in the audit reports are corrected and responded to by the appropriate Bank personnel; (g) the education and training of all appropriate Bank personnel in the requirements of FDPA and all other applicable federal and state consumer protection laws, rules, and regulations; and (h) periodic reporting of the results of the consumer compliance audit to the Board or a committee thereof. (2) Upon adoption, a copy of the program, or any subsequent amendments or changes to the program, shall be forwarded to the Assistant Deputy Comptroller for review and determination of no supervisory objection. Upon receiving a determination of no supervisory objection from the Assistant Deputy Comptroller, the Board shall implement and thereafter ensure adherence to the program. (3) Within thirty (30) days, the Bank shall notify and provide documentation to the Assistant Deputy Comptroller of all loans outstanding as of September 30, 2012, and all subsequent loans that did not have adequate flood insurance at origination or at any subsequent time during the life of the loan.
Consumer compliance. Within 90 days of this Agreement, the Bank shall submit to the Reserve Bank an acceptable consumer compliance program that is commensurate with the Bank's consumer compliance risk profile, its current size, and future growth strategies.   • PCI Compliance A. The Acquiring Bank will provide The Merchant with appropriate training on PCI PED and/or DSS rules and regulations in respect of The Merchants obligations. Initial training will be provided and at appropriate intervals as and when relevant changes are made to such rules and regulations. B. The Acquiring Bank will ensure that The Merchant is kept informed of any relevant new, or changes to, PCI PED and/or DSS compliance rules and regulations. C. The Merchant will comply with PCI PED and/or DSS, and resulting obligations, in respect of establishing, and maintaining, the required security controls. D. The Merchant will ensure that all its appropriate staff (existing and new) are knowledgeable in their responsibilities with respect to PCI PED and/or DSS compliance. E. The Merchant must be able to demonstrate compliance with PCI PED and/or DSS and maintain measures necessary to successfully pass regular compliance certification checks. F. The Merchant will notify The Acquiring Bank immediately should it become evident that data security standards have been compromised. The Merchant will also provide all assistance necessary to assist The Acquiring Bank and its agents to investigate and obtain any required evidence of a security breach. G. The Merchant hereby agrees and undertakes to fully indemnify The Acquiring Bank from and against all actions, claims, losses, charges, costs and damages which The Acquiring Bank may suffer or incur as a result of The Merchants failure to comply with PCI PED and/or DSS. H. Further to the conditions set out in Section 34 below, The Acquiring Bank reserves the right to terminate this agreement with The Merchant if The Merchant: i.   • FERPA Compliance In connection with all FERPA Records that Contractor may create, receive or maintain on behalf of University pursuant to the Underlying Agreement, Contractor is designated as a University Official with a legitimate educational interest in and with respect to such FERPA Records, only to the extent to which Contractor (a) is required to create, receive or maintain FERPA Records to carry out the Underlying Agreement, and (b) understands and agrees to all of the following terms and conditions without reservation:

  • ETHICS COMPLIANCE All Bidders/Contractors and their employees must comply with the requirements of Sections 73 and 74 of the Public Officers Law, other State codes, rules, regulations and executive orders establishing ethical standards for the conduct of business with New York State. In signing the Bid, Bidder certifies full compliance with those provisions for any present or future dealings, transactions, sales, contracts, services, offers, relationships, etc., involving New York State and/or its employees. Failure to comply with those provisions may result in disqualification from the Bidding process, termination of contract, and/or other civil or criminal proceedings as required by law.
