CONTRACTOR ELIGIBILITY. At the time of execution of this Contract, Contractor, and each tier of subcontractors/vendors, certifies that it is not on the List of Parties Excluded from Federal Procurement or Non- procurement Programs promulgated in accordance with Executive Orders 12549 and 12689, "Debarment and Suspension" as set forth in 24 CFR Part 24. Contractor has a continuing obligation to disclose any suspensions, debarment, or investigations by any government entity, including but not limited to General Services Administration (GSA). Failure to disclose may constitute grounds for suspension and/or termination of the Contract and debarment from future contracting opportunities.

CONTRACTOR ELIGIBILITY. Supple- mentary observers will be obtained by NMFS from persons or firms having es- tablished contracts to provide NMFS with observers. In the event no such contract is in place, NMFS will use es- tablished, competitive contracting pro- cedures to select persons or firms to provide supplementary observers. The services supplied by the supplementary observer contractors will be as de- scribed within the contract and as specified below.
CONTRACTOR ELIGIBILITY. No xxxxxxx subject to employment by Employers operating under this Agreement shall himself become a contractor for the performance of any electrical work.
CONTRACTOR ELIGIBILITY. Employees subject to this Agreement except those meeting the requirements of “Employer,” as defined herein, shall not contract for any electrical work. Employees subject to this Agreement who may become Electrical Contractors shall do no work as Journeymen or as Apprentices, except in case of emergency for the protection of life or property. Avoidance of the intent of this Section shall not be permitted by the pretense of ownership of the business by an immediate member of the family. This is subject to provisions of Article II, Section 8.
CONTRACTOR ELIGIBILITY. The CONTRACTOR shall be licensed as necessary to perform under this Agreement as may be required by law, rule, or regulation, and shall provide evidence of such compliance to THE COMMISSION upon request. The CONTRACTOR shall procure all supplies, pay all charges, fees, taxes and incidentals that may be required for the completion of this Agreement. By acceptance of this Agreement, the CONTRACTOR warrants that it has the capability in all respects to fully perform the Contract requirements and the integrity and reliability that will assure good-faith performance as a responsible vendor. The CONTRACTOR shall comply with Chapter 287, F.S., and all other applicable laws, rules or regulations, and ordinances. Ignorance on the part of the CONTRACTOR will in no way relieve him from responsibility.
CONTRACTOR ELIGIBILITY. The Subrecipient certifies that neither it nor its principals are presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in the transaction by any Federal department or agency. The Excluded Parties List System can be found at xxxxx://xxx.xxx.gov/.
CONTRACTOR ELIGIBILITY. 1. The use of a Marine Specialty licensed contractor (Section 489.105, F.S) is not a requirement for professional services pertaining to artificial reef deployment activities during this Agreement. A Marine Specialty Contractor license (Chapter 61G4-15.033 Florida Administrative Code) does not include artificial reefs, and therefore is not a licensing requirement for artificial reef deployment. 2. The Consultants Competitive Negotiation Act (Section 287.055, F.S.) is not applicable for professional services pertaining to artificial reef planning, procurement, deployment or survey activities during this Agreement. Signed and sealed drawings are not required. 3. In accordance with Executive Order 12549, Debarment and Suspension, the GRANTEE shall agree and certify that neither it, nor its principals, is presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this transaction by any Federal department or agency; and, that the GRANTEE shall not knowingly enter into any lower tier agreement, or other covered transaction, with a person who is similarly debarred or suspended from participating in this covered transaction, unless authorized in writing to the COMMISSION by the federal agency issuing the grant award. Upon execution of subcontracts funded by this Agreement, the GRANTEE shall require subcontractors to complete, sign and return a copy of the form entitled "Certification Regarding Debarments, Suspension, Ineligibility and Voluntary Exclusion - Lower Tier Federally Funded Transactions", attached hereto and made a part hereof as Attachment E. As required by sentences 1 and 2 above, the GRANTEE shall include the language of this section, and Attachment E in all subcontracts or lower tier agreements executed to support the GRANTEE's work under this Agreement.

CONTRACTOR ELIGIBILITY. All contractors shall be certified by the Division of Construction Industry Licensing Board of the Florida Department of Business and Professional Regulation for the duration of this Agreement and shall provide evidence of such certification to the Commission upon request.
