Course Tuition and Test Fees. The Company will pay tuition fees for courses, and test fees, for those courses and tests pertaining to the trade of the employees covered by this Collective Agreement. The employees shall make a request to the Company for the Company's approval before taking such courses or tests. Such approval shall not be unreasonably withheld. If an employee is required to write First Aid exams during a regularly scheduled shift, he shall be given the required time off without loss of pay.

It shall be the obligation of the enrolled employee to attend all classes and make every effort to complete the course successfully. The employee agrees that upon the successful completion of an Apprenticeship Training year, he shall remain in the employ of the Company for a period of two (2) years from the completion of his course. In the event the employee fails to successfully complete the school portion of the Apprenticeship Training in each year, the employee will be required to repay the full amount of wages and tuition received from the Company during that training period. If for reasons outside of the employee’s control he is unable to fulfill this obligation, or other reasons acceptable to the Company, he will be excused from this repayment. In the event the employee fails to remain an employee of the Company for the two (2) year period after a training session he shall be required to repay the full amount of wages and tuition received from the Company during that training period. If for reasons outside of the employee;s control he is unable to fulfill this obligation, or other reasons acceptable to the Company, he will be excused from this repayment. In the event the employee is in the position of having to repay the Company for a training session because of a breach of the above conditions, the liability shall be for 1/24 of the amount owing for each month the employee leaves prior to the 24 month anniversary of the completion of the training course.

Similar testing may be required after initial operation. Developer and Connecting Transmission Owner shall each make any modifications to its facilities that are found to be necessary as a result of such testing. Developer shall bear the cost of all such testing and modifications. Developer shall generate test energy at the Large Generating Facility only if it has arranged for the injection of such test energy in accordance with NYISO procedures.

  • COMPENSATION FOR CONSTRUCTION PHASE SERVICES 5.1 For the Construction Manager’s performance of the Work as described in Section 2.3, the Owner shall pay the Construction Manager the Contract Sum in current funds. The Contract Sum is the Cost of the Work as defined in Section 6.1.1 plus the Construction Manager’s Fee.
