As used in this 9 Article, “protected sick time” refers to sick leave protected under the Oregon state Sick Time 10 Law, ORS 653.601(6), et seq. The first forty (40) hours per year of “paid sick time,” as defined 11 under ORS 653.601(6), are protected under Oregon’s state sick leave law. Accrued sick leave 12 taken in excess of forty (40) hours per year is not covered or protected under the state sick 13 leave law, but may be considered protected leave under other state and federal laws.

Definition and Allowable Use. 16 Sick leave may be used by an employee for the following non- 17 occupational conditions involving the employee or conditions of a member of the 18 employee’s immediate household; spouse, parent, or children as defined in the federal 19 Family and Medical Leave Act; parents-in-law, grandparents or grandchildren as 20 defined in the Oregon Family Leave Act (OFLA); the employee’s domestic partner as 21 designated in an Affidavit of Domestic Partnership submitted to the Employee Benefits 22 Unit; or the children and parents of such domestic partner.
23 1. Illness or injury;
24 2. Quarantine based on non-job related exposure to contagious 25 disease;
26 3. Medical, dental or employee assistance program appointments; or
27 4. Family Medical Leave as defined by state, federal law, except that 28 the amount taken by the other parent of the employee’s child will not affect the parental 29 leave available to the employee.

2. Employee preventative care such as medical, dental or vision appointments and/or treatments;

4. For family members preventative care such as medical, dental or vision appointments;
5. Closure of the employee’s place of business or closure of employee’s child’s school or place of care by order of a public official for health-related reasons;
6. Employee absences that qualify for leave under the Domestic Violence Leave Act (RCW 49.76).
