Disputed Transactions. You must inspect each Statement you receive and must immediately contact Deserve about any errors or questions you have, as described in the “Billing Rights Summary” on your Statement and in this Agreement. If you do not notify us of an error, we will assume that all information on the Statement is correct. If we credit your Account for all or part of a disputed transaction, you give us all of your rights against others regarding that transaction, and will also: (1) give us any information about the disputed transaction, if we ask; (2) not pursue any claim or reimbursement of the transaction amount from the merchant or any other person; and (3) help us get reimbursement from others.
Disputed Transactions a) You may be entitled to claim a refund in relation to transactions made using Your Card where:
i. the transaction was not authorised under this Agreement. In most cases, We shall accept responsibility for any transaction which was incorrectly executed, provided it has been notified to Us in accordance with the Authorising Transactions Section above;
ii. a pre-authorised transaction did not specify the exact amount at the time of its authorisation and the amount charged by a Merchant is more than You could reasonably have expected (taking into account normal spending patterns on the Card or the circumstances of the transaction). However a claim for a refund in such circumstances will not be accepted if the amount of the transaction was made known to You at least 4 weeks before the transaction date or if the claim is made more than 8 weeks after being debited to Your Available Funds; and
iii. We were notified of the unauthorised/incorrectly executed transaction within 13 months of the debit date of such transaction.
b) If any of the above circumstances apply, You should contact the Merchant first as this may lead to a quicker resolution of the dispute (and for the avoidance of doubt, reasonable time taken to contact the relevant Merchant shall not be deemed an undue delay). You can also ask Us to investigate any transaction or suspected misuse of Your Card. In such cases, and subject to the other terms of this Agreement, We will immediately process a refund of the amount of the disputed transaction and/or We may need more information and assistance from You to carry out such investigation.
c) If We refund a disputed transaction to Your Card and subsequently receive information to confirm that the transaction was authorised by You and correctly taken from Your Card, We may deduct the amount of the disputed transaction from the Available Funds.
d) If Our investigations subsequently discover that the disputed transaction was genuine and authorised by You directly or indirectly, or that You have acted fraudulently or with gross negligence, We may charge You an Administration Fee, see the Fees and Limits Section below for full details.
Disputed Transactions. (a) Each business day, the Participant will forward by telecopy or e-mail to VDOT through a CSC, a report listing E-ZPass transactions by lane number from the previous day or weekend, as applicable. Each business day VDOT will cause a CSC to send the Participant via telecopy or e-mail a disbursement report reflecting E-ZPass transaction revenue credited to Participant by transaction number.
(b) If at any time the Participant’s E-ZPass revenue reflected in the disbursement report is out of balance with Participant’s reported E-ZPass transactions by $50 or more for any three consecutive days, the Participant will notify VDOT. VDOT will provide a detailed disbursement file within five business days of Participant’s notification. The Participant will compare the detailed disbursement report to its detailed audit and provide details regarding the disputed transactions sufficient to update the patron accounts. If the Participant cannot provide detail sufficient to update the patron accounts within 20 business days of the occurrence of the transactions, those transactions will not be charged to patron accounts and will not result in revenue to the Facility. The Participant will send the detailed data to VDOT with comparisons of transactions to include the transaction sequence number(s) and the acknowledgement verification by the ETC System.
(c) E-ZPass transaction/revenue disputes will be resolved on a monthly basis. The CSC will resolve disputes that are recognized and/or identified as valid by adjusting or offsetting the funds that are owed to the Participant in a subsequent transfer. Any Participant’s E-ZPass transactions rejected by their respective home agency will be identified in a report, which will be communicated to the Participant. Rejected transactions will be handled according to documented or generally accepted E-ZPass reconciliation procedures.
Disputed Transactions. Disputed transactions shall be resolved as set forth in the Business Rules and Procedures.
Disputed Transactions. 4.1. The Cardholder undertakes to resolve any disputes and disagreements regarding the purchase or receipt of goods or services (e.g., defective merchandise, unsatisfactory services) directly with the Accepting Partner. Any such action does not release the Cardholder from his/her obligation to pay for goods or services obtained with the Card, notwithstanding the Cardholder rights described under Item 7.11.
4.2. If the Cardholder gives payment instructions for an unspecified amount, and the amount then charged by the Accepting Partner is greater than the Cardholder could have expected under normal circumstances in view of the Cardholder’s previous spending pattern, the provisions of these Terms and Conditions, and the relevant circumstances of the case (e.g., ticket for a traffic violation, tank refilling for a car rental, cancellation charge for reservations), the Cardholder has eight weeks from the date of delivery of the account statement and charging of the card account to request a full refund of the amount from card complete. The Cardholder must explain the facts supporting such a request. card complete has ten working days within which to accept the request and refund the full amount or to reject it, giving its reasons for doing so. When refunding the amount, card complete must restore the account that has been charged to the balance it would have shown without the disputed charge. If the account statement (invoice) has already been paid, the card complete must refund the difference between the amount paid and the balance the account would have shown without the disputed charge. This does not affect other claims of the Cardholder.
4.3. Item 4.2. does not apply to card contracts concluded with enterprises as defined in Art. 1 of the Consumer Protection Act.
Disputed Transactions. If you dispute a Transaction posted to your account, then (i) you must notify us of your dispute as soon as you become aware of it, (ii) you must provide the information we request to investigate your dispute, including your affidavit and/or a police report, (iii) you agree to cooperate in our investigation and in our efforts to recover any loss, and (iv) you agree to cooperate with law enforcement. We may withhold the amount of a disputed Transaction from your account until we complete our investigation. We may credit your account before completing our investigation. We may reverse that credit later if we determine the Transaction was properly posted.
Disputed Transactions. You are solely responsible for the goods or services you purchase, and for a merchant’s failure to honor purchases you make with a Card. If you have a dispute with a merchant, you agree to make a good faith effort to resolve it directly before contacting us. If you are entitled to a refund for any reason for goods or services you obtained with your Card, you agree to accept credits to your Deposit Account for refunds and agree to the merchant’s refund policy. In any dispute with a merchant, you agree that any rights you may have against the merchant in the dispute may be transferred to us to satisfy any debts you owe us or to protect our rights. You may not assert any claims or defenses against us that you may have, or believe that you may have against any merchant in the dispute. We are not responsible for the quality, safety, legality, or any other aspect of any goods or services you purchase with your Card.

Disputed Transactions. In case of disputed Card transactions, we may, subject to any restrictions under applicable law, decide not to proceed with Chargebacks at our sole discretion. Reasons for this might include:
a. Not receiving sufficient information to determine that an error occurred.
b. Not receiving a notification about the payment error in a timely manner.
c. Disputes being caused by the risky nature of transactions undertaken with the Card.
d. We have evidence that you or someone you gave your Card to, authorised the transactions in dispute.
