EMERGENCY SERVICE PROVISIONS. A. In the event of a hurricane, tornado, major storm, natural disaster, or other such event, the Administrator may grant the Contractor a variance from regular routes and schedules. Such variance from regular routes and schedule to ensure the safety of the Contractor's employees and members of the community shall not be unreasonably denied by the City. However, Contractor shall make its best effort to resume regular Collection service as soon as possible. As soon as practicable after such event, the Contractor shall advise the Administrator when it is anticipated that normal routes and schedules can be resumed. The Administrator shall make an effort to inform the public when regular Collection services may be resumed.

EMERGENCY SERVICE PROVISIONS. In an emergency event such as a hurricane, tornado, major storm, natural disaster, or othersuchevent, the City Manager may grant the CONTRACTOR a variance from regular routes and schedules. As soon as practicable after such event, the CONTRACTOR shall advise the City Manager when it is anticipated that normal routes and schedules can be resumed. The clean-up from emergency events is not exclusive to this Agreement. The CITY reserves the right to select the CONTRACTOR and/or another agency and/or company to perform the clean-up from emergency event(s). The CONTRACTOR shall, by request of the CITY, work jointly with other agencies and/or companies during emergency events. The clean-up from some events may require that the CONTRACTOR hire additional equipment, employ additional personnel, or work existing personnel on overtime hours to clean debris resulting from the event all in accordance with the "Emergency Preparedness Plan", Exhibit 3, submitted by the CONTRACTOR and approved by the CITY. The CONTRACTOR shall receive additional compensation, above the normal compensation contained in this Agreement, to cover the costs of rental equipment, additional personnel, overtime hours and other documented expenses based on the rates set forth in Exhibit 4, attached hereto and included herein provided the CONTRACTOR has first secured written authorization and approval from the CITY through the City Manager. The CONTRACTOR shall be responsible for the preparation of all documents and forms and support information required by FEMA. EMERGENCY SERVICE PROVISIONS. In the event of a flood, tornado, major storm, earthquake, fire, natural disaster, or other such event, the County Manager may grant the Company a variance from regular routes and schedules. As soon as practicable after such event, the Company shall advise the County Manager when it is anticipated that normal routes and schedules can be resumed. The County Manager shall make an effort through the local news media to inform the public when regular services may be resumed. The parties recognize that the County intends to maintain separate as needed-contracts to support clean up response efforts following large scale catastrophic events and that this Agreement is not intended to govern the provision of such services as long as such contracts are in place. However, upon County’s request, Company shall hire additional equipment, employ additional personnel, or work existing personnel on overtime hours to clean debris resulting from smaller-scale events within the Service Area. For the purposes of this Agreement, smaller-scale events shall mean those events for which no disaster declaration is made by any local, state or federal authority, and large-scale events shall mean those events for which such a declaration is made. In the event that separate agreements with the County to support a clean up response to a large-scale event are not in place when the need arises, Company agrees to provide such services as may be requested by County in accordance with the provisions of this Agreement. The Company shall receive additional compensation, above the normal compensation contained in this Agreement, to cover the costs of rental equipment, additional personnel, overtime hours and other documented expenses based on the rates set forth in Amended Exhibit E-4 to this Agreement, provided the Company has first secured written authorization and approval from the County through the County Manager. Company shall not have the exclusive right to the provision of emergency clean-up services. County shall have the right to contract with additional service providers to provide clean-up services within Company’s Service Area as needed during a large-scale emergency event.
EMERGENCY SERVICE PROVISIONS. Force Majeure Event means Acts of God; strikes, lockouts or other industrial disturbances; acts of the public enemy, wars, blockades, insurrections, or riots; epidemics or quarantine; landslides, lightning, earthquakes, fires, severe storms (rain, hail, ice, snow or other), hurricanes, tornadoes, floods, droughts, or high water washouts; arrests and restraints of government and people; civil disturbances; explosions or power failures or surges; pest damage; breakage, freezing or accident to machinery or lines of pipe (including utility lines), or failure of gas xxxxx or gas supply; enactment of statutes, laws or regulations; acts of governmental or semi-governmental bodies (including without limitation failure of the parties to agree on the terms of a Force Majeure Proposal (as defined herein below))or the other party's default under this Agreement. Not withstanding any provision to the contrary herein, upon the commencement of a Force Majeure Event notified by one party to the other, Contractor's obligation to provide collection service at the frequency and on the dates otherwise required by this Agreement ("Regular Services") shall be suspended for so long as other or additional services are required and Contractor, either as part of its notice or in prompt response to City's issuance of such notice, will propose to City ("Contractor's Force Majeure Proposal"):  measures to be taken by Contractor through provision of other or additional services to address the Force Majeure Event as soon as conditions reasonably permit including establishment of emergency or temporarily changed service routes and schedules, or alternative methods or collection and disposal to cope with restricted access or increased volumes in order to restore Regular Services; and  a good faith estimate of the time required before regular schedules and routes can be resumed, it being understood, however, that following City's notice described below Contractor will use best efforts to mitigate the effects and costs of such suspension and to minimize the period of suspension, and  the amount, or a method to calculate the amount, to be paid to Contractor for the other or additional services (including without limitation expenses and costs to be incurred by Contractor to mobilize and demobilize for a Force Majeure Event, Contractor's added operating expenses (labor, supervision, materials, permitted subcontracts, equipment rentals, additional disposal costs, equipment depreciation, and r...

  • Emergency Service Leave ‌ Where employees' services are required for emergency operations by request from the Provincial Emergency Program or appropriate police authority, leave from work as required may be granted without loss of basic pay.
