Fingerprints. The Charter Holder shall comply with the requirements of A.R.S. §15-183 (C).
A. The Charter Holder shall fingerprint check its charter school governing body members pursuant to A.R.S. §15-512 and submit all changes in members through the process stated in Paragraph 10. A fingerprint check must be conducted for each new governing body member.
B. The Charter Holder must maintain valid fingerprint clearance cards on all officers, members, partners, and boards of the Charter Holder and submit all changes in members through the process stated in Paragraph 10.
Fingerprints. The DISTRICT has considered the totality of the services to be provided under this CONTRACT and has determined that CONTRACTOR and CONTRACTOR’S employees are subject to the fingerprinting requirements of Education Code section 45125.1. CONTRACTOR shall submit fingerprints for review by the Department of Justice and authorize DISTRICT to receive subsequent arrest and conviction notifications.

Fingerprints. Applicants shall be fingerprinted, and such fingerprints will be submitted to the RCMP for comparison against databases of persons convicted of criminal offences. The Police Service will retain those fingerprints for the purpose of the administration of the Special Constable Employer Special Constable program only.

CONTRACTOR shall certify in writing to LEA that none of it employees, and volunteers, unless CONTRACTOR determines that the volunteers will have no direct contact with student, or subcontractor who may come into contact with students have been convicted of a violent or serious felony as those terms are defined in California Education Code section 44237(h), unless despite the employee’s conviction of a violent or serious felony, he or she has met the criteria to be eligible for employment pursuant to California Education Code section 44237(i) or (j). Clearance certification shall be submitted to Sonoma SELPA. The passage of AB 389 amends Education Code sections 44237 and 56366.1 as to the verification that the CONTRACTOR has received a successful criminal background check clearance and has enrolled in subsequent arrest notice service, as specified, for each owner, operator, and employee of the nonpublic, nonsectarian school or agency. Further this bill deletes the exemption for applicants possessing a valid California state teaching credential or who are currently licensed by another state agency that requires a criminal record summary, from submitting 2 sets of fingerprints for the purpose of obtaining a criminal record summary from the Department of Justice and the Federal Bureau of Investigation. Notwithstanding the restrictions on sharing and destroying criminal background check information, CONTRACTOR, upon demand, shall make available to Sonoma SELPA evidence of a successful criminal background check clearance and enrollment in subsequent arrest notice service, as provided, for each owner, operator, and employee of the nonpublic, nonsectarian school or agency. Fingerprints. Client has been informed that when an application with USCIS or the court is filed, a fingerprint appointment may be scheduled. Client understands that failure to attend any appointment within the time established by the Immigration Court or USCIS may result in the application being deemed abandoned, unless the applicant demonstrates that such failure was the result of good cause or requests a rescheduled date.

A business partner applicant shall submit fingerprints for business partner owners and employees located in California to a Live Scan facility for each person identified in Section 225.03(d) of these regulations. A copy of the Request for Live Scan Service form, DMV 8016 (Rev. 11/2001) shall be submitted for any and all persons being fingerprinted prior to participation in the BPA.

In accordance with Education Code § 45125.1, PROVIDER shall conduct a criminal background check of its employees and, upon receipt of those checks, certify to the LEA that no employee of PROVIDER working with students of the school district has been convicted of a violent or serious felony as defined by statues. PROVIDER shall also supply LEA with a list of names of those employees who are cleared to work with students of the LEA. A fingerprint certification form will be submitted with monthly invoices and attendance records.
