FRANCHISOR'S OBLIGATIONS. 6 8. OPERATION OF THE FRANCHISEE'S BUSINESS...................................7 9.
FRANCHISOR'S OBLIGATIONS a) Prior to the Opening Date, Franchisor shall provide initial training for Franchisee and portions of Franchisee's staff, in Franchisor's sole and exclusive discretion.
FRANCHISOR'S OBLIGATIONS. A. Location. Franchisor will provide Franchisee with assistance respecting site location and evaluation for the Store. Franchisee acknowledges that Franchisor's assistance in site location and acceptance of the premises does not constitute a representation or guaranty by Franchisor that the location will be a successful location for Franchisee's ReTool(TM) Store.
X. Xxx-Out and Design. Franchisor will designate the standard design, lay-out and motif for Franchisee's premises and will furnish prototype specifications for the premises.
FRANCHISOR'S OBLIGATIONS. The Franchisor’s obligations during the tenure of this Agreement include the initial as well as the on-going obligations:
1. To permit the Franchisee to carry on the Franchise Business for operating and promoting under the name and style of “studymetro”.
2. To provide Franchisee with the charges/ fee allocated for various Services provided in the Centre. The fee structure shall be updated by the Franchisor from time to time.
3. Procurement of all types of goods be used for the Franchise Business. The same shall be provided to the Franchisee, at a cost, by the Franchisor for operation of the Franchise Business.
4. To provide the details of the vendors/dealers for purchasing the equipments, and other products required for the Franchise Business.
5. To provide training and support to the Franchisee or his appointed personnel for enabling them to effectively carry out the Franchise business.
6. The Franchisor shall provide training to the Franchisee for the operation of the Franchise Business.
7. The Franchisor shall provide the Franchisee with the brochures, pamphlets and flex banners for the advertisement purposes. The cost for the same shall be borne by the Franchisee.
8. To provide at cost to Franchisee, the design of the forms, bills format and stationery at cost including reasonable handling charges to the Franchisee.
9. The operational Software will be provided by the Franchisor at the cost of the Franchisee for maintaining the uniformity of data of customers.
10. The Franchisor may assist in monitoring and managing the Franchise Business to make sure that the best business practices get implemented at the Franchisee’s end to run it on profit.
11. The Franchisor may also provide regular advice on administrative issues as the Franchisor may deem fit.
12. The Franchisor will also take care of quality of Services to be delivered at the Franchisee’s end as well as to the customers/parents of the children, through regular interactions, surprise visits at the Franchisee centre etc.
13. Franchiser authorizes the Franchisee to conduct business with strategies suitable to the territory's market.
FRANCHISOR'S OBLIGATIONS. 6.1. The Franchisor shall at all times keep the content of the course latest and with the growing Industry trends. However since the Franchisor is an expert in this Industry, it is upon its discretion whether or not to introduce the technology in its course.
6.2. The Franchisor shall ensure a continuous and non-stop supply of the requisite stationary/books as desired by the Franchisee.
6.3. The franchisor shall ensure a smooth, un-biased, discipline, and principled operational behavior towards all the Franchisees. It shall also exercise its special powers to resolve dispute between two Franchisee and its decisions shall be accepted as final.
6.4. The franchisor from time to time shall come and inspect the Franchisee and ensure that it is competitive with the other Franchisees, to be able to set up a standard in the industry, which evolves the basic required for any business to be successful.
6.5. The franchisor shall assist in training technical staff/faculty for the Franchisee at a nominal cost.
6.6. The franchisor, if the Franchisee so desires, shall advertise, interview, and assign all faculty in the Franchisee. The total cost involved in the whole process shall be paid by the Franchisee.
6.7. The Franchisor shall ensure that it trains the most deserving faculty in the Franchisee with the latest in the Technology Industry sees a new development. The cost involved in this process is to be shared by both, the Franchisee and the franchisor, should it be more than 04 times in a year.
6.8. The Franchisor shall convene meetings, trainings; send newsletters and latest updates in the world of Information Technology, to keep the Franchisee. The same by all means possible. The cost involved in this process can be decided as per the situation.
FRANCHISOR'S OBLIGATIONS. 4.1. Franchisor's Duties. The duties to be performed by the Franchisor in connection with the Master Franchisee's Business will include the following:
a. The Franchisor will provide an initial training program in Denver, Colorado U.S.A., or other training facility designated by the Franchisor, for the Master Franchisee or, if the Master Franchisee is not an individual, the person designated by the Master Franchisee to assume primary responsibility for the management of the Master Franchisee's Business ("Manager"). No fee shall be charged by the Franchisor for the Master Franchisee or its Manager to attend the initial training program. The Master Franchisee will be responsible for all travel and living expenses related to attendance at the training program. The training will last for at least five days. Successful completion of the initial training program shall be evidenced by the Master Franchisee or its Manager receiving a certificate of training completion. At least one individual must successfully complete the initial training program prior to the commencement of operations of the Master Franchisee's Business. The Franchisor reserves the right to waive a portion of the initial training program or alter the training schedule, if in the Franchisor's sole discretion, the Master Franchisee or its Manager have sufficient prior experience or training.
b. The Franchisor will provide advice regarding the development of the Master Franchisee's Business.
c. The Franchisor will provide input, in the form of advice, studies, data or written materials, to assist the Master Franchisee in compiling a marketing plan for its first year of operation.
d. The Franchisor will provide newsletters, ad slicks and other advertising materials, as they may be available from time to time; provided, however, that they shall be in the English language and the Master Franchisee will be required to have them accurately translated for use in the Master Franchise Area at the Master Franchisee's own expense.
e. The Franchisor will make available, in the English language, one or more manuals, technical bulletins or other written materials covering the proper operating and marketing techniques of a GREASE MONKEY Center as well as standards and specifications for implementing the Master Franchise Methods, and manuals or other written materials covering the Master Franchisee's Business operations, which may include advertising, marketing, franchise promotion, franchisee selection, franchise...
FRANCHISOR'S OBLIGATIONS. 5.1 The Franchisor may provide training for such number of personnel of the Franchisee at the Franchisee's expense and on such terms and conditions as the Franchisee and the Franchisor may mutually agree. The Franchisor shall have the right to require the Franchisee's employees to attend further training courses at any time during the term of this Agreement if it reasonably considers that such further training is necessary. The time and place of any such training shall be at the absolute discretion of the Franchisor but the Franchisor shall try to accommodate the Franchisee's reasonable requirements.
5.2 The Franchisor may make available to the Franchisee, on terms and conditions to be mutually agreed, promotional and point-of-sale materials and advise the Franchisee on promotional programmes relating to the Business.
FRANCHISOR'S OBLIGATIONS. Franchisor and Franchisee agree that Franchisor may, but will not be required to, provide location, training or opening assistance as described in Sections 7(A), (D) and (E) of the Franchise Agreement.
FRANCHISOR'S OBLIGATIONS. Franchisor’s obligations during the tenure of this Agreement include the initial as well as the on-going obligations:
1) To permit the Franchisee to carry on the business from its Service Centre under the name and style of “BigFix E-care”.
2) To provide the Franchisee, as the Franchisor considers appropriate from time to time, with Spare Parts, management, sales and administrative advice in the conduct of the Business and such other advice as Franchisor considers appropriate to promote the mutual business interests of Franchisor and the Franchisee..
3) Operational software shall be provided by Franchisor on payment of Rs.*********- ************) to the Franchisee for maintaining the uniformity of data of Customers.
4) Franchisor will provide Franchisee with initial training and assistance towards repair of malfunctioned Digital Gadgets of Franchisee’s Customers.
5) The spare parts & Accessories will be provided to the Franchisee at a Dealer Transfer Price.
6) The Franchisor will have to Advertise and manage the expenses for a central Helpline Number on which the prospective customers can call and inquire of the Service centres in close proximity to their Location.
