Guaranteed Minimum Payment. (1) (i) Regular daily hire employees who present themselves for work in accordance with the provisions of this Agreement on any day shall receive a minimum days pay based on the ordinary time rate applicable to each employee's classification except for casuals who may receive a minimum of four (4) hours pay per day. Loadout, driver and drover personnel may be offered less than 4 hours work without entitlement to this minimum.
Guaranteed Minimum Payment. Notwithstanding anything herein to the contrary, in regard to the payments due pursuant to Section 5.1 above, IML guarantees to Vanderbilt a minimum of Fifty Thousand Dollars ($50,000.00) during the first year of this Agreement and a minimum of One Hundred Thousand Dollars ($100,000.00) during the second year of this Agreement.
Guaranteed Minimum Payment. 1. Ford will pay a minimum sum of $30,000,000 for the benefits provided for in Sections II.B, II.C, and XX.XX of the Settlement (“Guaranteed Minimum Payout”). 2. Within thirty days after October 21, 2024, the Claims Administrator shall calculate and submit to Ford and Class Counsel the Total Payment Amount, which will be the sum of the total dollar value of all prepaid cards issued pursuant to Sections II.B, II.C, and XX.XX, plus the total face value of all Vehicle Discount Certificates issued under Section II.C. If the Total Payment Amount is less than the Guaranteed Minimum Payout, that difference (“the Residue”) shall be distributed equally to each Class Member who submitted a valid claim under Sections II.B, II.C or XX.XX or who received a payment from Ford after providing Notice of Intent to arbitrate pursuant to Section II.N.4. In the event the per capita amount of the residual payment would be less than $5.00, the Residue shall be distributed only to Class Members who submitted a valid claim pursuant to Section II.C. If the per capita amount of the residual payment remains less than $5.00, the Residue shall be distributed to a cy pres beneficiary to be determined jointly by Class Counsel and Ford.
Guaranteed Minimum Payment. After the conclusion of the claims process as set forth in Section II.D (including resolution of any disputed claims under Section II.D.4), the Settlement Administrator will calculate the Total Payment Amount, which will be the sum of (1) the total dollar amount of valid claims for monetary compensation under Section II.B.1, and (2) the total dollar amount of unilateral payments under Section II.B.2. If the Total Payment Amount is less than $17 million, Ford will cause the difference between the Total Payment Amount and $17 million to be distributed on a pro rata basis to all Members of the Settlement Classes who, prior to 180 days after the Preliminary Approval Order, submitted valid claims of any type under Section II.B.1. Ford and the Settlement Administrator will, in consultation, with Class Counsel, complete this distribution reasonably promptly after the conclusion of the claims process as set forth in Section II.D (including resolution of any disputed claims under Section II.D.4).

(2) Regular Daily Employees who present themselves for work in accordance with the provisions of this Agreement during the whole of any pay week are entitled to receive either the total amount of money payable in that pay week for work performed or a guaranteed weekly minimum payment of not less than the amount prescribed in clause 3, whichever is the greater. In the event of stop work meetings or strikes by employees, the minimum weekly payment entitlement will be forfeited by the equivalent amount for payment for the time of the stoppage. (3) For the purpose of the guaranteed minimum payment all days off on paid or Unpaid leave shall reduce proportionately the amount payable under this clause by one-fifth. Such leave shall be: (a) Annual Leave (b) Sick Leave (c) Long Service Leave (d) Public Holidays (e) Compassionate Leave (f) Parental Leave (g) Special Leave (h) Jury Service
Guaranteed Minimum Payment. In consideration of the special investment by PacifiCorp to supply service hereunder, SUMMO shall make minimum annual total payments for service of $281,664 in each year for a period of five years, beginning six months from the commencement of deliveries. The guaranteed minimum payments shall be in the amount of $23,472 per month for sixty (60) consecutive months. PacifiCorp shall calculate and xxxx the guaranteed minimum at intervals of every twelve (12) months beginning one year from commencements of deliveries. Where the actual billed service is less than $281,664, PacifiCorp shall xxxx XXXXX for the difference between actual billed service and the required stated minimum. In the event actual use as determined by meter readings exceeds the monthly minimum guaranteed payment, SUMMO shall pay the higher amount.

Guaranteed Minimum Payment. After the deadline for submitting claims for compensation for MFT Software Repairs and Unsatisfactory MFT Performance (six months after the Effective Date of Settlement) has expired, the Settlement Administrator will calculate the Total Payment Amount, which will be the sum of (1) the total dollar amount of valid claims for monetary compensation under Section II.B.1, and (2) the total dollar amount of unilateral payments under Section II.B.2. If the Total Payment Amount is less than $17 million, Ford will cause the difference between the Total Payment Amount and $17 million to be distributed on a pro rata basis to all Members of the Settlement Classes who, prior to six months after the Effective Date of Settlement, submitted valid claims of any type under Section II.B.1. Ford and the Settlement Administrator will, in consultation, with Class Counsel, complete this distribution reasonably promptly after the deadline for submitting claims for compensation has expired, taking into account the need to resolve any resubmissions of deficient claims and appeals of denied claims.
Guaranteed Minimum PaymentThe guaranteed minimum payment from the Landowner for Infrastructure Coordination and Finance Fees per quarter shall commence upon substantial completion of the water reclamation facility and remains payable until 1,500 of the EDU’s have received a final plat approval and the Landowner Payments have been paid in full to Coordinator. The guaranteed minimum payment that Landowner must pay per quarter is as follows: A. For the first year, starting with the date of substantial completion, Landowner will pay Coordinator the equivalent of 80 EDU’s per quarter for the unpaid portion of the $5,015 per EDU. B. The second year after substantial completion, Landowner must pay Coordinator the equivalent of 125 EDU’s per quarter for the unpaid portion of the $5,015 per EDU. C. The third year after substantial completion, Landowner must pay Coordinator the equivalent of 170 EDU’s per quarter for the unpaid portion of the $5,015 per EDU. Under this section, Coordinator acknowledges and agrees that Landowner shall be obligated to make payment only for the first 1,500 EDUs that are connected to the system and are actively being billed monthly. Coordinator acknowledges that Landowner intends to sell the land to other builders and developers who will make and assume the obligations for the Infrastructure Coordination and Finance Fee payments to Coordinator under this Agreement. To the extent Coordinator receives payments from such builders or developers for amounts already paid to Coordinator by Landowner, Coordinator shall refund such amounts to Landowner. Finally, to the extent sales in the first year exceed 125 EDUs per quarter and payments are made under this Agreement, such payments shall be credited against Landowner’s guaranteed minimum payment obligation of 1,500 EDUs under this paragraph on a going forward basis.
