Higher Duties Pay. AT A GLANCE 8.3.1 The parties are committed to improving skill levels and removing impediments to multi skilling and broadening the range of tasks that an employee is required to perform. 8.3.2 Council may direct an employee to carry out such duties that are within the limits of the employee's skill, competence and training. 8.3.3 Council shall provide adequate employees and other resources to enable employees to carry out their duties and functions over the course of working hours that are not unreasonable and support the implementation of the Council’s community strategic plan and operational plan. 8.3.4 An employee shall be paid the salary system rate of pay that recognises the skills the employee is required to apply on the job. 8.3.5 The skills paid for shall not be limited to those prescribed by the position description and may, where appropriate, include skills possessed by the individual which are required by Council to be used in line with or in addition to the employee's normal duties. 8.3.6 Employees who are required by Council to use additional skill(s) such as: 8.3.6.1 languages other than English, or 8.3.6.2 signing services to those with hearing difficulties In the performance of their duties shall have the use of these skill(s) considered in the evaluation of the position. 8.3.7 An employee required to relieve in a position which is at a higher level within the salary system shall be paid for that relief at the higher salary point. The rate to be paid shall be determined by demonstrated competence at the salary point the employee is relieving in. Should this be less than their current rate of pay, 50% of the difference between the employee’s current level in their salary point and the same level in the relieving salary point shall apply. An employee, if acting in a position for more than six months, will be paid at least the competent level of the higher salary point, excluding acting Section Manager and acting Group Manager positions, which will be assessed using the salary assessment process.

Higher Duties Pay. Council has arrangements for how employees will be paid when Council requires employees to relieve in a position, which is not their usual job. This clause should be read in conjunction with Council’s Salary System and Job Evaluation Internal Policy and Higher Duties Pay Procedure. 35.1 The provisions of this subclause should be read in conjunction with Council’s Salary System and Job Evaluation Internal Policy and Higher Duties Pay Procedure. 35.2 An employee required to perform higher duties in a position which is at a higher level within the salary system shall be paid for that higher grade relief. They will receive the salary of that position’s pay band at a pay step which provides a salary at least 8% higher than their current salary, and with consideration of their skills and experience, up to the maximum pay step of the pay band. 35.3 For periods of less than six weeks, higher-grade pay is only applicable for time spent working in the higher-graded role and not on any form of leave including flexi-leave and rostered days off. 35.4 For periods of greater than six weeks, the employee will be seconded into the role and higher-grade pay will be paid during periods of leave including flexi-leave and rostered days off. 35.5 An employee on annual leave may be entitled to a higher rate of pay in accordance with the provisions of subclause 45.9 this Agreement. 35.6 An Agreement employee who is required to relieve in a senior staff position, so designated under the Local Government Act 1993 (NSW), shall be paid an appropriate rate of pay commensurate with the duties and responsibilities of the relief work undertaken and in accordance with the Salary System and Job Evaluation Policy. 35.7 An employee who is required to relieve an employee in a higher-level position, who is on a rostered day off, shall not be entitled to be paid for that relief, except for employees who were being paid for such relief prior to the operative date of this Agreement. 38 LAKE MACQUARIE CITY COUNCIL

  • Higher Duties Allowance (a) An employee who is appointed to perform temporarily all of the duties of a higher classified position and who performs all such duties required to be performed during the appointment will be paid an allowance equal to the difference between their substantive salary and the minimum salary of the higher classified position for all the time during which the employee performs such duties. Where it is specified at the commencement of the higher duties allowance that the employee is to undertake part of the duties of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paid. (b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a period in excess of one (1) week or in excess of two (2) consecutive working days for trades staff. (c) No allowance will be payable pursuant to subclause 12.1(a) to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeks. (d) An employee who has been in receipt of a higher duties allowance for more than one (1) month will be paid such allowance for all paid leave taken during that period. (e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment. (f) Where an employee in receipt of a higher duties allowance works on a public holiday, the relevant shift loading or overtime rate will be applied to the higher duties allowance for time worked on that day.

  • Higher Duties Where any Employee on any day performs two or more classes of work to which different rates of pay are applicable, the Employee shall be paid at the higher hourly rate for the day if the Employee is required to work at that class of work for two (2) hours or more, and if for less than two (2) hours during any one (1) day the Employee will be paid the higher rate for the time so worked.

  • Position Duties Responsibilities 3.01 It is contemplated that at all times during the Period of Employment the Executive shall continue to serve as a principal officer of the Company with the office and title of Vice President, General Counsel of the Company and continue to have duties and responsibilities commensurate with those duties and responsibilities imposed on the Executive immediately prior to the Effective Date. 3.02 During the Period of Employment the Executive shall also serve and continue to serve, if and when elected and reelected, as an officer or director, or both, of any subsidiary, division or affiliate of the Company. 3.03 Throughout the Period of Employment the Executive shall devote his full time and undivided attention during normal business hours to the business and affairs of the Company, except for reasonable vacations and except for illness or incapacity, but nothing in this Agreement shall preclude the Executive from devoting reasonable periods required for serving as a director or member of a committee of any organization involving no conflict of interest with the interests of the Company, from engaging in charitable and community activities, and from managing his personal investments, provided that such activities do not materially interfere with the regular performance of his duties and responsibilities under this Agreement. 3.04 The office of the Executive shall be located at the executive offices of the Company at 00000 Xxxxxxxx Xxxxx, Xxxxx 000, Xxxxxxx, Xxxxx 00000. The Executive shall not be required to change the current situs of his employment or residence. The Executive also shall not be required to be absent therefrom on travel status or otherwise more than a total of 60 working days in any calendar year nor more than 20 consecutive days at any one time.

  • Position; Duties (a) The Executive shall serve as the President of the Company under this Agreement during the Employment Term. As President of the Company, the Executive shall have such duties, authorities and responsibilities commensurate with the duties, authorities and responsibilities of persons in similar capacities in similarly sized companies and such other duties and responsibilities as the CEO of Kaman or the Company’s Board of Directors (the “Sub Board”) shall designate that are consistent with the Executive’s position as President of the Company. (b) During the Employment Term, the Executive shall use the Executive’s best reasonable efforts to perform faithfully and efficiently the duties and responsibilities assigned to the Executive hereunder (including applicable obligations under state law) and devote substantially all of the Executive’s business time (excluding periods of vacation and other approved leaves of absence) to the performance of the Executive’s duties with the Company, provided the foregoing shall not prevent the Executive from (i) participating in charitable, civic, educational, professional, community or industry affairs or, with prior written approval of the Sub Board, serving on the board of directors or advisory boards of other companies; and (ii) managing the Executive’s and the Executive’s family’s personal investments so long as such activities do not materially interfere with the performance of the Executive’s duties hereunder or create a potential business conflict or the appearance thereof. If at any time service on any board of directors or advisory board would, in the good faith judgment of the Sub Board, conflict with the Executive’s fiduciary duty to the Company or create any appearance thereof, the Executive shall promptly resign from such other board of directors or advisory board after written notice of the conflict is received from the Sub Board. (c) The Executive further agrees to serve without additional compensation as an officer and director of any of the Company’s subsidiaries and agrees that any amounts received from any such corporation may be offset against the amounts due hereunder.

  • Position, Duties and Responsibilities During the Term (as defined in Section 2.01 below), Executive shall serve as Chief Financial Officer of Company as well as in such other positions or capacities as may be reasonably requested by the Board of Directors of Company (the “Board”) or the Chief Executive Officer of Company (the “CEO”) and shall have such duties and responsibilities as are customary for, and are consistent with, such position(s) as may, from time to time, be assigned by the Board, the CEO and/or any of their respective nominees. Notwithstanding anything contained herein to the contrary, Executive may do the following, provided that such activities do not inhibit or prohibit the performance of Executive’s duties hereunder or inhibit or conflict with the business of Company and/or its affiliates: (i) engage in charitable, educational, religious, civic and similar types of activities and manage Executive’s personal investments, and (ii) with consent of the Board which shall not be unreasonably withheld, serve on the board of directors, managers, advisors (or their equivalent) of outside business enterprises for up to 30 hours in the aggregate per calendar quarter (including but not limited to AngelMed, GenPro, and eNeura). Executive shall be required to spend on average eight days per month at the Company’s corporate offices in either Florida or Israel including travel. Executive acknowledges that he shall be required to travel as reasonably necessary to perform Executive’s duties hereunder, including international travel.

  • Duties of the Employee The Executive represents and warrants that the performance by Executive of the Executive’s duties and obligations under this Agreement will not violate any agreement between the Executive and any other person, firm, partnership, corporation or other organization.

  • Employment Duties and Responsibilities A) The Company shall employ the Executive, and the Executive shall serve the Company, as President and Chief Executive Officer, with such duties and responsibilities as may be assigned to the Executive by the Board of Directors of the Company (“BOD”) and are typically associated with a position of that nature.   • Certain Duties and Responsibilities The duties and responsibilities of the Trustee shall be as provided by the Trust Indenture Act. Notwithstanding the foregoing, no provision of this Indenture shall require the Trustee to expend or risk its own funds or otherwise incur any financial liability in the performance of any of its duties hereunder, or in the exercise of any of its rights or powers, if it shall have reasonable grounds for believing that repayment of such funds or adequate indemnity against such risk or liability is not reasonably assured to it. Whether or not therein expressly so provided, every provision of this Indenture relating to the conduct or affecting the liability of or affording protection to the Trustee shall be subject to the provisions of this Section.

  • Duties and Responsibilities of Employee (a) During the Employment Period, Employee shall devote substantially all of Employee’s business time and attention to the business of the Company and its Affiliates, will act in a manner that Employee reasonably believes is consistent with the best interests of the Company and its Affiliates and will perform with due care Employee’s duties and responsibilities. Employee’s duties will include those normally incidental to the position(s) set forth in Section 1 above of as well as whatever additional duties may be assigned to Employee, with Employee’s consent, by any senior officers or by the Board of Managers of EPE Acquisition (the “Board”) from time to time. Notwithstanding the foregoing, the parties acknowledge and agree that Employee may (i) serve on corporate boards or committees (A) listed on Schedule 2(a) hereto or (B) approved by the Board, (ii) serve on civic, educational, religious, public interest, or charitable boards or committees, (iii) manage Employee’s personal and family investments, provided that such activity is not expressly prohibited by Section 10 and (iv) engage in passive investments (the activities referred to in the immediately preceding clauses (i), (ii), (iii) and (iv) being “Permitted Activities”); provided, however, that such activities shall be permitted so long as such activities do not materially interfere with the performance of Employee’s duties and responsibilities under this Agreement or conflict with the business and affairs of the Company. (b) Employee expressly represents and covenants to the Company that Employee is not subject or a party to any employment agreement, noncompetition covenant, nondisclosure agreement, or any other agreement, covenant, understanding, or restriction that would prohibit Employee from executing this Agreement and fully performing Employee’s duties and responsibilities hereunder.
