Incidence. 5.1 This Agreement shall apply to all employees of Port Xxxxxxxx Council and employees of committees of Council established under the Local Government Act1993 (NSW), with the exception of Group Managers and the General Manager.
5.2 This Agreement shall regulate totally the terms and conditions of employment previously regulated by all Awards and Agreements covering employees of Port Xxxxxxxx Council.
Incidence. (i) This Agreement will replace the Office of Environment and Heritage (NSW) Flight Operations Enterprise Agreement 2017.
(ii) This Agreement does not affect the terms and conditions of employment regulated by the following industrial instruments as varied, except where specifically varied by this Agreement: ◾ Crown Employees (Public Service Conditions of Employment) Reviewed Award 2009; ◾ Crown Employees (Transferred Employees Compensation) Award 2009; ◾ Government Sector Employment Act 2013; ◾ Government Sector Employment Regulation 2014; and ◾ Government Sector Employment Rules 2014.
(iii) The parties agree that the hourly rate of pay for ordinary hours of work provided for by this Agreement shall not, at any time, be less than those provided for by the industrial instrument that would cover the employee, had this Agreement not been made.
Incidence. 3.1 This Agreement shall apply to Port Waratah Coal Services Limited as to the employment of, or persons coming within the scope of the conditions of eligibility for membership rule of the Union party to this Agreement in or in connection with the Company’s operations at KCT.
3.2 This Agreement shall be read in conjunction with the "Port Waratah Coal Services Limited Enterprise Agreement 2005" as varied from time to time.
3.3 Any disputes arising out of the operation of these rostering arrangements shall be progressed in accordance with the Settlement of Disputes procedure of the Industrial Agreement.
Incidence. 6.2.2.1. In the case of illness the AFC may grant an employee leave of absence with pay to the extent of that employee’s accrual subject to the following conditions; • The employee must make reasonable effort to notify the AFC of their absence on sick leave and the expected duration of the absence as soon as possible but no later than the rostered shift start time or not later than 24 hours after first being absent on account of illness. Outside normal working hours Stage Door may be notified.; • if absent for more than 2 consecutive days or more the employee will be required to produce a medical certificate or other appropriate evidence to justify the period of absence. • A consecutive Friday and Monday are considered two consecutive days, • the AFC may notify an employee of a future requirement (for a period not exceeding six months) to produce a medical certificate for an absence of less than 2 days where in the AFC’s reasonable opinion it is warranted by the circumstances.
Incidence. 3.1 This Agreement shall apply to Port Waratah Coal Services Ltd as to the employment of, or persons coming within the scope of the conditions of eligibility for membership rule of the Unions party to this Agreement in or in connection with the Company’s operations at Newcastle.
3.2 This Agreement shall be read in conjunction with the "Port Waratah Coal Services Limited Enterprise Agreement 2005" as varied from time to time.
3.3 Any disputes arising out of the operation of these rostering arrangements shall be progressed in accordance with the Settlement of Disputes procedure of the Agreement.
Incidence. 3.1 This Agreement shall apply to the same parties as the Port Waratah Coal Services Limited Enterprise Agreement 2005.
3.2 This Agreement shall be read in conjunction with the "PWCS Limited Enterprise Agreement 2005" as varied from time to time and shall have precedence over it.
3.3 Any disputes arising out of the operation of these rostering arrangements shall be progressed in accordance with the Disputes Settlement Procedure of the PWCS Limited Enterprise Agreement 2005.
3.4 This Agreement shall operate from the (Date of Certification) It is intended that this 10 Hour Daywork Roster shall operate for a period commensurate with the initial term of the PWCS Limited Enterprise Agreement 2005 applicable to PWCS-Xxxxxxxxxx and PWCS-Kooragang. In the event that circumstances circumvent the implementation/continuation of the rosters contained in this Agreement, discussion will take place between the parties prior to the alteration of this roster.
3.5 The parties to this Agreement may seek to vary or terminate this Agreement by not less than seven (7) days notice in accordance with clause 19 (a) (iv) of the "PWCS Limited Enterprise Agreement 2005".
Incidence. This Agreement binds the Employer and Employees.
Incidence. In the case of illness the Trust may grant an employee leave of absence with pay to the extent of that employees accrual subject to the following conditions; • the employee shall as soon as practicable and not later than 24 hours after first being absent on account of illness inform (or cause to be informed) the Trust of the reason for that absence (in general terms) and probable duration of that absence; • if absent for more than 2 days, which includes a Friday and Monday, the employee will be required to produce a medical certificate or other appropriate evidence to justify the period of absence; • the Trust may require the employee to produce a medical certificate for an absence of less than 2 day where it believes warranted by the circumstances.
Incidence. This Agreement shall apply to contract carriers engaged by the Company whose engagement is covered by the
