Infrastructure Availability. Infrastructure shall consist of the following components that are provided as part of DYONYX’s Services: • Co-location space reserved for use by Customer in the DYONYX data center private cage space, • Power and environmentals provided to Customer’s co-location space, and • Internet access provided to Customer from the DYONYX provided Internet Backbone. Infrastructure Availability (Metric 14) Infrastructure available 99.5% of the time; excluding scheduled maintenance. Reported monthly.
Infrastructure Availability a. Infrastructure shall consist of the following components that are provided as part CyrusOne’s Services:
i. Colocation space reserved for use by Customer in the CyrusOne data center, including quarter, half, or full cabinets and cage space;
ii. Power provided to Customer’s colocation space; and
iii. Internet access provided to Customer from the CyrusOne Internet Backbone.
b. The Infrastructure Availability Percentage shall be calculated each month during the term of the Service Agreement monthly as follows:
i. Total minutes of Infrastructure Availability per month / Total minutes per month
c. In the event that CyrusOne fails to meet its stated Infrastructure Availability SLA in any given month during the contract term, Customer shall be entitled to receive a Service Credit as the sole and exclusive remedy hereunder, by providing CyrusOne with a written request for a Service Credit within ninety (90) days after receipt of an invoice for the period in which the Infrastructure was unavailable. The amount of the Service Credit shall be determined by multiplying the applicable Service Credit Percentage, in accordance with Table 1 shown below, by the Monthly Recurring Charge, known as “MRC”, for the affected Service or Services. d. For purposes of determining the Infrastructure Availability Percentage, the following causes of Infrastructure unavailability will be excluded:
i. Outages due to scheduled maintenance or emergency maintenance,
ii. Outages resulting from a Force Majeure event as stated in the MSA,
iii. Outages caused directly by acts or omissions of Customer or its employees, agents, contractors or representatives, iv. Outages due to the use or failure of any Customer owned or provided equipment used in connection with the services, v. Outages resulting from CyrusOne following or implementing instructions or procedures issued by Customer,
vi. Outages resulting from Denial of Service (“DoS”) and Distributed DoS attacks.
vii. Outages resulting from Customer not utilizing or implementing the redundant components of the Infrastructure provided by CyrusOne,

Infrastructure Availability. In the case of a depot fire, Verdant will provide immediate operating cover from their neighbouring contracts until the site can be cleared, prior to contract start agreement will be reached with local businesses to ensure that alternative depot facilities can be made available e.g. Bywaters of Leyton Verdant would look to develop relationships with suppliers that can provide alternative servicing arrangements locally. A priority list of sites, servicing facilities, fuel sites will be issued to staff with regard to alternative arrangements should these be necessary. As part of normal depot procedure the computer system will be backed up on a daily basis and a copy kept off site. In the event of system failure additional computers can be sourced from head office in Sevenoaks and also via the Company’s approved IT services supplier based in the South East.
Infrastructure Availability. Both County and Aumentum Technologies agree and understand that the Product being provided incorporates elements that are under the direct control of Aumentum Technologies and its third parties, the County and its third parties, as well as elements that are not under the control of either party to this agreement. Both parties agree to work together to determine in which of the above stated areas a Downtime event is attributable to and then the responsible party will resolve the issue. In the event that Downtime is attributable to an element that is outside either party’s control, both parties agree to work together to resolve the Downtime issues.
Infrastructure Availability. The infrastructure providers use commercially reasonable efforts to ensure a minimum of 99.95% uptime. The providers maintain a minimum of N+1 redundancy to power, network, and HVAC services.

Where the Contract provides for a Ship To Site solution, the Customer is responsible for ensuring that at each of the Nominated Addresses:- • the site has the required facilities and environment to support the use of the equipment supplied • any security access requirements are met and mechanical, electrical and Health & Safety regulations are satisfied • electrical power, Data and Telecommunications connectivity to the required standard are accessible and in good working order Both local area and wide area network supply and management are incumbent upon the Customer.

Infrastructure Availability. FTI will provide City with no less than twenty-four (24) hours’ notice prior to the unavailability of the Hosted Licensed Software Service due to planned maintenance, which shall be performed during off-peak hours. FTI will provide as much notice as is practicable under the circumstances for updates and fixes which must be applied on a more urgent basis. FTI will provide five business days’ notice prior to any planned network, server hardware, operating environment, or database modifications of a material nature, which shall be performed during off-peak hours. Excluding the foregoing events, FTI warrants that the Hosted Services will be available in accordance with the Service Level Agreement (“SLA”) set forth in Exhibit 2, which is attached hereto and incorporated by reference herein.
Infrastructure Availability. You shall use commercially reasonable efforts to ensure a minimum of 99.95% uptime for all applications related to the Services. You shall have an uninterruptible power supply for all Services that require operations beyond regular business hours, including all web and mobile applications. Backup copies and recovery: You shall be responsible for checking the definition and correct application of the procedures for making backup copies and for recovery of the eXp data in its possession. You shall ensure that procedures set forth for making backup copies and for recovery of the eXp data allow such data to be reconstructed in the state they were in at the time they were lost or destroyed.
