JURY DUTY AND SUBPOENAED WITNESS LEAVE. The Co-op agrees to pay a maximum of twenty (20) working days to an Employee who is summoned for jury duty or witness duty the difference between her/his pay received, exclusive of any expenses received, as a juror or witness and the pay she/he would have received had she/he worked her/his regularly scheduled working hours at her/his straight time hourly rate. To qualify for such make-up pay the Employee must promptly notify the Co-op of her/his selection for jury duty or witness duty, must furnish proof of service amount received for jury duty or as a witness and must return to work at every reasonable opportunity during the period of such jury or witness duty.

JURY DUTY AND SUBPOENAED WITNESS LEAVE. 27:01 An Employee who is summoned for jury duty or who receives a summons or subpoena to appear as a witness in a court proceeding, other than a court proceeding occasioned by the Employee’s private affairs, shall be granted a leave of absence with pay for the required period of absence and all witness fees received by the Employee shall be remitted to Southeast Child and Family Services.
JURY DUTY AND SUBPOENAED WITNESS LEAVE. 39.01 A seniority employee called for jury duty or subpoenaed as a Crown witness shall receive for each day absent from regularly scheduled working hours, the difference between regular pay lost and the amount of jury or witness fees received, provided the employee furnished the Company with a certificate of service signed by the Clerk of the Court showing the amount of any fee received.

To qualify for such excusal and/or make-up pay the Employee must promptly notify the Co- op of her/his selection for jury duty, must furnish proof of that selection, must provide proof of the amount received for jury duty and must return to work at every reasonable opportunity during the period of such jury duty. The Co-op agrees to excuse the absence of and pay an Employee who is summoned as a witness the difference between her/his pay received, exclusive of any expenses received, as a witness and the pay she/he would have received had she/he worked her/his regularly scheduled working hours at her/his straight time hourly rate to a maximum of two months as follows: To qualify for such excusal and/or make-up pay the Employee must promptly notify the Co- op of her/his summons as a witness which summons is enforceable in Ontario, must furnish proof of service of that summons, must provide proof of the amount received for as a witness and must return to work at every reasonable opportunity during the period of such witness duty. Notwithstanding the above, however, no such excusal or pay will be provided to an Employee who is summoned as witness in an action, motion or application in which the Employee is a plaintiff, moving party or applicant and no such excusal or pay will be provided to an Employee who is summoned as witness in an action, motion or application in which the Employee is a defendant or respondent without the prior written permission of the Co-op.

  • Jury and Witness Leave An employee will be granted paid leave for time spent responding to a summons for jury duty, time spent participating in the jury selection process, time spent actually serving on jury, or when subpoenaed to appear in court. An employee will not be terminated, disciplined, threatened or otherwise subjected to adverse action because of the employee’s receipt of or response to a jury summons. The employee shall present documentation of his or her jury service to the building principal or an immediate supervisor. If the subpoena is directly related to the employee’s school duties, the employee will be released for court appearance without loss of leave. Other court appearances due to personal situations will be deducted from the employee’s personal business leave.
