Crown Witness. 26.01 An employee with seniority who is subpoenaed as a Crown witness shall be reimbursed by the Company for the difference between fees received for so acting (excluding travelling, meals and other expenses) and the wage he would have received (not in excess of eight (8) hours per day) for the first three (3) days he is necessarily required to be absent from work by reason of the foregoing during a calendar year. The foregoing shall not apply to any proceeding between the Company and the Union and/or any person(s) represented by the Union. The employee shall present proof of service and the amount of fees received to the Company.
Crown Witness. The Company will pay an employee who is required to appear as a crown witness in any court of law in Ontario the difference between his/her normal pay and the amount of compensation received for such service. The employee will present proof of service and the amount of pay received.
Crown Witness. Where an employee receives a subpoena or is called by the Crown as a Crown Witness, the employee shall be granted leave with pay. Reimbursement for lost remuneration from the Court to the employee will be refunded to the Company against remuneration paid.
Crown Witness. A nurse who is subpoenaed as a crown witness shall be granted a leave of absence of up to two (2) working days. The nurse shall be paid one (1) normal day’s pay for the loss of each working day of such service provided she/he reports for work when not actually required for witness duty and provided she/he deposits with the Regional Treasurer the amount of fees, if any, other than expenses received for such service. The nurse on returning to work shall present a certificate showing the period of such service and the amount of compensation received. Notwithstanding the foregoing, a nurse shall receive one (1) normal day’s pay for each day of service as a witness in any matter arising out of her/his employment.
Crown Witness. Employees required to serve on Jury Duty and employees required to serve as Witnesses for the Crown shall be paid the difference between the straight time rate they would have earned and the amount they receive for Jury Duty or for witness fees as the case may be. SAFETY SHOES
Crown Witness. If an employee is subpoenaed as a Crown witness (and not in proceedings where he is the accused) he shall be given leave of absence with pay which shall be the difference between his regular pay and monies received as a Crown witness.
Crown Witness. It i s the responsibility of the employee to provide the Company with a copy of the Notice of Jury Selection or a copy of the subpoena to appear as a Crown Witness and any further information relating to his Jury Duty or appearance as a Crown Witness.
Crown Witness. Should an employee be required to report on their regular work day for jury duty or as a witness due to being subpoenaed as a crown witness in any court of law and produces a satisfactory statement that did so report, the employee will be paid the difference between pay for the regularly scheduled shift on that date at the employee’s applicable hourly rate plus any applicable shift premium and any applicable Cost of Living Allowance and Earnings Based Compensation or Nickel Price Bonus whichever is greater and the jury duty pay or witness pay and/or conduct money received by the employee for that day. A maximum bereavement of absence of three consecutive days, not to extend beyondthe day follow- ing the funeral will be granted to an employee (who has acquired seniority rights) upon a death in the employee’s immediate family. Where any such day occurs on a regularly scheduled working day for the employee, the employee shall be paid on the basis of the standard number of hours which otherwise would have been worked at the applicable hourly rate of pay plus any applicable shift premium and any applicable Cost of Living Allowance and Earnings Based Compensation or Nickel Price Bonus whichever is greater. To qualify for bereavement leave, the employee shall notify his or her immediate supervisor as soon as possible following the bereave- ment. ’Immediate family’ shall mean mother-in-law, father-in-law, daughter-in-law, son-in-law, xxxxxx’s brother, xxxxxx’s sister, employee’s brother’s spouse, employee’s sister’s spouse, grandparent or grandchild. This maximum bereavement leave of absence will be increased to five (5) consecutive days, including the day of the funeral, in the case of the death of the xxxxxx, son, daughter, mother, father, sister or If the death in the immediate family occurs and the bereavement leave begins while the employee is on a regular or special vacation, the employee will be allowed to extend his vacation in an amount equal to the number of bereavement days during such xxxx- tion.
Crown Witness. The Employer shall pay such employee the difference between normal earnings and the payment received for Jury Duty or Crown Witness. The employee will present proof of service and the amount of pay received. The employee is required to notify the Employer as soon as possible for selection for Jury Duty or Crown Witness.
Crown Witness. A When an employee is summoned for jury duty or as a Crown Witness in a court of law and must lose time from work as a result of such summons, the employee will pay to the Company any monies received for such jury or witness duty (not including expense monies) and the employee will receive the pay he would have received had he been working. Such pay shall not exceed straight time hours per day or straight time hours per week. The employee shall furnish evidence to the Company that he reported for or performed jury duty or appeared as a witness on the days for which he claims payment. C The employee is required to report for work on days when he is on for jury duty but not required to appear court. Section Bereavement Pay A Should a death occur in the immediate family of an employee, he may request bereavement leave for the purpose of making arrangements and/or attendance at the funeral. shall mean spouse, son, daughter, brother, sister, mother, father, mother-in-law, father-in-law, grandchildren. B The employee shall be granted such time off with pay up to a maximum of consecutive days for the purpose of making arrangements and/or attendance at the funeral. This will not include pay for days on which the employee is not scheduled to work. One paid day will be the day of the funeral provided the day of the funeral is on the employee's scheduled day of work. Bereavement pay shall not exceed a maximum straight time hours per day. C In the event of the death of an employee's grandparents, law or sister-in-law, he will be granted time off with pay (up to straight time hours) for the purpose of making arrangements attendance at the funeral on his scheduled day of work. Section Leave Of Absence A written request for up to days leave of absence without pay shall be considered (except for gainful employment elsewhere) by the Company. It is understood that any leave of absence is subject to reasonable notice being given to the Company. In the event such leave of absence is not used for the purpose granted, the employee may be subject to disciplinary action up to and including dismissal. It is further understood that leaves of absence will be honored on a first-come, first-served basis.
