Jury/Witness Leave a) Any employee called upon to serve on jury duty, subpoenaed as a Crown witness or subpoenaed as a witness in any legal proceedings other than as set out in clause 11.5 c), shall notify their Manager at the earliest possible moment and submit a copy of the notice of jury duty selection or subpoena before being relieved from duty, unless there is insufficient time to do so. The employee shall be paid their regular hourly rate for all hours during which the employee would have been normally scheduled to work, less any amount received by way of fees for service on a jury or as a witness.

On presentation of court documentation, employees who must serve as a juror, including jury selection process, shall be paid the difference between their regular wage and the amount of compensation received from the court. This procedure shall apply for each day that employees are required to act as jurors, provided that employees report to work if required to do so during regular hours that they are not required to attend court. Any employee who is subpoenaed as a witness is entitled to his/her regular pay while serving as a subpoenaed witness, where the underlying action is one in which the District or a District employee (in his or her official capacity) is a party, or where the witness is being called regarding an event or transaction in which he or she perceived or investigated in the course of his or her duties. The employee shall provide the District with any funds received for said appearance from the party issuing the subpoena.
B. Any employee summoned to appear for jury service is entitled to his/her regular pay while on jury duty. The employee must sign the Juror Fee Waiver Form per the California Code of Civil Procedure, Section 215, which states that a juror who is employed by a government entity and receives regular salary and benefits while on jury duty must waive the daily juror fee.
C. Employees working evening or night shifts shall be entitled to release time from their own work schedule for the number of hours spent on jury duty during the day.
Jury/Witness Leave. Necessary leave shall be allowed by the City Manager to permit any employee to report for duty to serve as a member of a jury or as a non-party witness. The employee shall receive from the Employer as compensation during this leave period the excess of the employee's regular salary over the compensation received by the employee for such jury duty. Employees shall be required to report for work for any portion of their regularly scheduled shift during which they are not actually serving on a jury or waiting to be impaneled.
Jury/Witness Leave. C12.1 The University shall grant leave with full pay and benefits to Members, other than those on any form of leave without salary, who are required by law to serve as jurors in a court of law.
C12.2 The University will grant leave with full pay and benefits to a Member, other than those on any form of leave without salary, who is required by law to serve as a witness in a court action or statutorily-established tribunal, provided that the Member has not initiated the action or is not acting as a defendant with regard to the Member’s private affairs.
C12.3 The Member taking such leave is expected to advise the Chair (or Xxxx or University Librarian, where appropriate).
Jury/Witness Leave. 13.9.1 The District shall grant to members of the bargaining unit called for jury service in the manner provided by law, or subpoenaed to appear as a witness in court other than as a litigant (except for cases resulting from Section 21.10), or to respond to an official order from another governmental jurisdiction, for reasons not brought about by the connivance or misconduct of the unit member, leave of absence without loss of regular pay for the time the unit member is required to perform jury duty or appear under the official order during regularly assigned working hours.
13.9.2 Unit members so called for jury duty or other service described above must notify the District of required service date(s) upon receiving said notice from officers of the Court or other governmental jurisdiction.
13.9.3 In computing such pay, the unit member shall first endorse the check received for jury or witness fees to the District. The District shall issue to the unit member the normal salary warrant in the full amount due. Mileage and incidental expenses that may be included within the jury/witness fees tendered the unit member shall not be included in computing the unit member's salary payment.

Such leave will not constitute a break in service for the calculation of seniority, sick leave credits or any other benefit based on length of service. Upon completion of jury or witness service, such employee shall present to the Corporation a satisfactory certificate showing the period of such service. Temporary Full-Time Employees shall be eligible for the provisions of this Article upon the completion of twelve (12) months' continuous service. For the purposes of this Article "subpoenaed as a witness" shall apply only to the court system and shall not include Arbitration, Labour Board, WorkSafeBC or related tribunals, or situations where an employee's private affairs have occasioned a court appearance.
