Limitations of the Services. The Services are provided on an “as is” and “as available” basis. Customer’s use of the Services is at Customer’s sole risk. TELUS does not guarantee timely, secure, error-free or uninterrupted Services or receipt of material or messages transmitted over or through TELUS’ network or the networks of other companies or through the Internet. The Services may fail or be interrupted for reasons including environmental conditions, technical limitations, defects or failures, limitations of the systems of other telecommunications companies, emergency or public safety requirements, or causes beyond TELUS’ reasonable control. TELUS disclaims all representations, warranties and conditions (express, implied or statutory) relating to the Services and any Customer Device, and all warranties, representations and conditions are, to the extent permitted by applicable law, excluded. The area in which TELUS provides the Services may be enlarged or reduced in scope from time to time at TELUS’ discretion. To maintain or improve the Services, or for other business reasons, TELUS may make changes to TELUS’ networks and other facilities, and may suspend, restrict, or modify the Services without notice to Customer. TELUS may terminate the Services upon reasonable advance notice to the Customer if TELUS is ceasing to operate the network facilities used for the Services.

Limitations of the Services. The Services use cellular or other wireless telecommunications networks in the continental United States, Alaska, Hawaii, and Canada, as well as the global positioning system ("GPS") satellite network. The Services are not available everywhere, particularly in remote areas, or at all times. Your vehicle has to have a properly functioning electrical system and adequately charged battery for the Services to have any chance of working. The Services may not work if your device is not properly installed by our authorized representative, not properly maintained, modified by any person other than our authorized representative, or combined with equipment, Services, or software not expressly approved by us. Certain elements of the Services, such as the ability to remotely unlock or disable your vehicle, may simply be incompatible with your vehicle's design. There are other problems beyond our control that may prevent us from providing the Services to you at any given time, such as damage to your vehicle in an accident, abuse or neglect of your device, terrain (hills, mountains, dips, valleys), buildings, bridges, tunnels, weather, the design of your vehicle, defects (including hidden defects) in your vehicle, localized "gaps" in cellular telephone network coverage, cellular telephone network congestion, and interference with the satellite transmissions that help supply the GPS data used by us in providing the Services.
Limitations of the Services. CINEMATCHER reserves the right to limit your use of the Services, including your ability to connect with and contact other Users. If CINEMATCHER has reason to believe you are misusing the services or are in breach of this Agreement or law, it has the exclusive right to terminate or suspend your account. Entering into this agreement does not create any agency, partnership, or employment relationship between you and CINEMATCHER and you cannot bind the Company in any manner.

  • Obligations of the Service Provider 3.1. The Service Provider undertakes to provide the services as set out online within the dedicated Hoople Schools portal to this Agreement (the ‘Services’), in consideration of the payment as set out in the dedicated Hoople Schools portal.   • Limitations of Use The Services and Atlantic Broadband Equipment, including any firmware or software embedded in Atlantic Broadband Equipment or used to provide the Services, are protected by trademark, copyright, and/or other intellectual property laws and international treaty provisions. You are granted a limited, non-sublicensable, non- transferable revocable license to use such firmware and software in object code form (without making any modification thereto) strictly in accordance with this Agreement. You acknowledge and understand that you are not granted any other license to use the firmware or software embedded in Atlantic Broadband Equipment or used to provide the Services. You expressly agree that you will use Atlantic Broadband Equipment exclusively in connection with the Services. You shall not reverse, compile, disassemble, or reverse engineer or otherwise attempt to derive the source code from the binary code of the firmware or software. If you decide to use the Services through an interface device not provided by Atlantic Broadband, which Atlantic Broadband reserves the right to prohibit in particular cases or generally, you warrant and represent that you possess all required rights to use that interface device with the Services, including all software and firmware licenses. You will indemnify and hold harmless Atlantic Broadband against any and all liability arising out of your use of such interface device with the Services.

  • Limitations of Services When using the Services, you may incur technical or other difficulties. We nor our service providers are responsible for any technical or other difficulties or any resulting damages that you may incur. Any information displayed or provided as part of the Services is for informational purposes only, may not reflect your most recent transactions, and should not be relied on for transactional purposes. We and our service providers reserve the right to change, suspend or discontinue any or all of the Services at any time without prior notice.

  • Use of the Services 1.1 We will make the Oracle services listed in Your order (the “Services”) available to You pursuant to this Agreement and Your order. Except as otherwise stated in this Agreement or Your order, You have the non- exclusive, worldwide, limited right to use the Services during the period defined in Your order, unless earlier terminated in accordance with this Agreement or Your order (the “Services Period”), solely for Your internal business operations.
