MANAGEMENT RIGHTS 3. 01 The Union acknowledges that within the framework of this Agreement the Company reserves the right to hire, discharge, or suspend for just cause, layoff, demote, discipline, transfer or promote employees provided that any employee retains the right to lodge a grievance as hereinafter provided for. Except as otherwise expressly provided in this Agreement, nothing contained in this Agreement shall be deemed to limit the Company in any way in the exercise of the regular and customary function of management. The Union recognizes the right of the Company to operate and manage its business in all respects in accordance with its commitments and responsibilities and to make and alter, from time to time, rules and regulations to be observed by employees, provided that, before publishing, any changes or additions to plant rules shall be first explained to the Plant Chairperson.
MANAGEMENT RIGHTS 3. 1 The Union recognized the exclusive right of the College to manage the College’s affairs and to direct and discipline the employees, subject to the terms of this Agreement.

(1) It is the sole and exclusive right and obligation of the Board to exercise its management functions and trustee responsibilities and to manage the affairs of the Board and to exercise these rights and obligations in a manner consistent with the collective agreement and subject to the provisions of the Ontario Labour Relations Act, the Constitution Act, 1867, and in particular Section 93 thereof, and the Acts and regulations of the Ministry of Education and the Province of Ontario.
(2) A teacher will be considered to be on probation until the teacher:
a) has completed two years of employment with the Board, if the teacher has less than one year of experience, as a teacher in a secondary school in Ontario before commencement of employment with the Board; or
b) has completed one year of employment with the Board, if the teacher has one or more years of experience, as a teacher in a secondary school in Ontario before commencement of employment with the Board.
(3) Effective September 1, 2000 it is expected that teachers will provide two months notice of resignation for the purpose of retirement as verified by the Teachers Pension Plan.

a) maintain order and efficiency;
b) hire, promote, demote, classify, transfer, layoff, suspend and rehire employees, and to discipline or discharge any employee for just cause provided that a claim by a seniority employee of discharge or discipline without just cause may be the subject of a grievance and dealt with as hereinafter provided;
c) make, enforce and alter from time to time rules and regulations to be observed by the employees;
d) operate and manage its educational facilities in all respects in accordance with its commitments and responsibilities including the determination of the number of personnel required, the methods, procedures, machinery and equipment to be used, schedules of work and all other matters concerning the operation of the Employer's facilities not otherwise specifically dealt with elsewhere in this Agreement.

MANAGEMENT RIGHTS 3. 01 Subject only to any specific provision contained herein, the Company is not in any way limited in the exercise of all the rights, powers, authority and regular and customary functions of Management, and without limiting the generality of the foregoing these rights shall include the right to introduce technical improvements and methods of operations; the right to engage, promote, demote, transfer and lay off employees; and the right to suspend, discharge or otherwise discipline employees for just cause subject to the right of any employee to lodge a grievance in the manner and to the extent herein provided.
