Commitments and Responsibilities. 9.1 The Company and vehicle rental service:
9.1.1 Will not be held responsible for any damage and/or loss and/or theft of equipment that is located in and/or on the vehicle.
9.1.2 Will not be held responsible for any harm and/or direct damage and/or indirect or any other damage and/or other damage that may be caused to the Subscriber while using the vehicle.
9.1.3 Will not be held responsible for any damage, loss and/or theft caused to a third party due to an act by the Subscriber and/or additional driver or anyone in the vehicle.
9.1.4 Will not be held responsible for any harm and/or direct damage and/or indirect damage or any damage caused as a result of unavailability of a vehicle due to a prior reservation.
9.1.5 Will not be held responsible for any damage and/or direct harm and/or indirect harm and damage and/or other damage caused as a result of the use of an accessory and/or device in or on the vehicle.
9.1.6 Will not be held responsible for any damage and/or direct and/or indirect damage and/or any damage and/or injury caused by the electric charging station or parking poles.
9.2 The Subscriber and the subscription card:
9.2.1 Both the Subscriber and the additional driver undertake to care for the subscription card and report directly to the Company in the event that he or she becomes aware that the card has been lost.
9.2.2 The subscription card is the property of the Company, and is provided to the Subscriber and/or the additional driver for personal use only and is not transferrable.
9.2.3 The Subscriber will bear the full responsibility for any direct and/or indirect damage and any other damage cause to the vehicle from the moment that the vehicle is unlocked and until the end of the reservation as a result of vehicle usage, parking and securing of the vehicle, including (and not limited to) responsibility for damage and/or direct and/or indirect damage and/or any other damage that might be caused to the electric charging station or parking pole.
9.2.4 The Subscriber takes full responsibility for the use of the subscription card including use of a subscription card that is not by the Subscriber.
9.3 The Company hereby clarifies that they will not be held responsible for anything related to the presence or absence of a child safety seat in the vehicle as well as the manner in which it is connected or installed or its usage by the Subscriber that results from an accident and/or dysfunction of the safety seat and/or due to the installation of the ...

10.2 The Subscriber will be held entirely responsible for any damage that is caused to the vehicle during the vehicle rental period.
10.3 The Subscriber and the subscription card:
10.3.1 The Subscriber undertakes to keep the subscription card and report directly to the Partnership in the event that he or she becomes aware of the loss of the card.
10.3.2 The subscription card is the property of the Partnership, and is provided to the Subscriber for personal use only and is not transferrable.
10.3.3 The Subscriber takes full responsibility for the use of the subscription card including use of a subscription card that is not by the Subscriber.

12.2 The use of the services and / or vehicles is the sole responsibility of the member and for his personal use only. To be clear, the member may not transfer or permit the use of his account and / or the vehicle to any third party, except for a driver that has been added to the membership, and as long as he does so (and without allowing such action) the member and third party will bear full responsibility for any injury and / or damage that has occurred.
12.3 Without derogating from the generality of the aforesaid, the member will be liable for any loss or damage which will be caused by him intentionally or by his negligence.
12.4 The member assumes responsibility for any injury, damage or loss incurred due to non-compliance with obligations under this contract and under any law.
12.5 The company and car rental:
12.5.1 Will not be liable for any damage and / or loss related to the member's use of the services and / or vehicles, or his reliance on them, or his inability to gain access to the services and / or operate and / or use them, and will not be liable for any other loss related to the member's use of the services and / or the vehicle, except as required by law.
12.5.2 Shall not be liable for any damage and / or loss and / or theft of equipment inside and / or on the vehicle.
12.5.3 Will not be liable for damage and / or direct and / or indirect injury, and any other damage caused to the member during the use of the vehicle.
12.5.4 Shall not be liable for any damage, loss and / or theft that may be caused to a third party due to the act of the member and / or the additional driver or anyone present with them.
12.5.5 Shall not be liable for damage and / or direct and / or indirect damage, and any other damage caused as a result of the unavailability of the vehicle, including due to the failure to return the vehicle on time by a member who used the vehicle beforehand.

The LICENSEE undertakes to remunerate all athletes, technical committee, as well as any support team eventually hired to assist the “League of Legends” team in E-Sports, as well as other E-Sports modalities, without any connection or contracting between them and the LICENSOR. If the LICENSEE athletes receive any kind of material incentive, allowance or sponsorship, this shall only be paid by the LICENSEE, without any remuneration relationship with the LICENSOR. It is hereby stipulated that if any member of the technical or support team, athletes, or any of their employees and / or representatives enter legally in the face of the LICENSOR seeking any kind of relationship or legal relationship, the LICENSEE will be fully responsible for the expenses incurred by the LICENSOR with its defense, as well as for the payment of any court fees, appeal bonds, loss of suit and conviction fees, and it is certain that the responsibility of the LICENSEE for the sums due will be computed as from January 1, 2020 and any previous amounts is the responsibility of the LICENSOR. The LICENSEE shall, in this event, pay to the LICENSOR all amounts spent by it, as defined in this clause, within five (05) days after the LICENSOR communicates the fact.
2.1.1. The LICENSEE declares that if any athlete or member of its technical committee of its League of Legends team in E-Sports has at any time filed a lawsuit against the LICENSOR, the LICENSEE, upon notice from the LICENSOR in writing, accompanied by the appropriate documentary evidence of the respective lawsuit brought against the LICENSOR, undertakes to dismiss it within a maximum of fifteen (15) days of its knowledge, taking all reasonable steps to maintain absolute confidentiality about the reasons for dismissal.
2.2. If any national or international pay-per-view, cable TV, open or closed pay-TV broadcaster has an interest in capturing, fixing, editing, displaying or broadcasting “League of Legends” team matches and / or other modalities in E-Sports, the LICENSOR shall agree to said contract, and the authorization of the LICENSEE to third parties is expressly forbidden without the written consent of the LICENSOR. In such cases, the LICENSOR shall have up to 10 (ten) business days from the request made by the LICENSEE in writing and effectively to respond to the request, and the absence of response by the LICENSOR will be considered tacit approval, provided that they are subject to the terms of this Agreement.
