MEDICALLY FRAGILE STUDENTS. A. Authorization Prior to any bargaining unit member performing health care related services to students required by an IEPC, written authorization signed by a licensed physician and the student’s parent(s)/guardian(s) shall be received by the District and available to the bargaining unit member. Such authorization should include specific health care related procedures that are to be performed, the underlying condition calling for such services and the specific conditions under which the services are to be provided. (See Health Care Procedure Authorization Form.)
MEDICALLY FRAGILE STUDENTS. 1. If a teacher will be providing instructional or other services to a medically fragile student, the teacher or another adult who will be present when the instruction or other services are being provided will be advised of the steps to be taken in the event an emergency arises relating to the student's medical condition.
2. No teacher will be required to provide services of a medical nature to a medically fragile student without being trained to provide the services, unless the services are necessitated by emergency.
3. On a case-by-case basis, the District will determine what training and other support should be provided to a teacher who will be providing instructional or other services to a medically fragile student.
4. When a general education classroom teacher is assigned a student from a special education program for severely impaired students (POHI, SXI, SMI, TMI), and/or students covered under the Americans with Disabilities Act, the teacher shall not be expected to perform routine, scheduled maintenance of a medical appliance or apparatus used by the student to sustain his/her bodily functions nor render routine, scheduled care or maintenance of exceptional bodily functions related to the student's impaired condition. The teacher shall be informed and instructed as to emergency measures which may be necessary on occasion due to the student's impaired condition. Otherwise, it shall be the responsibility of the teacher to implement the student's individualized educational plan for attending to the educational needs of the student while in the teacher's class.
MEDICALLY FRAGILE STUDENTS. When a general education classroom teacher is assigned a medically fragile student, the teacher shall not be expected to perform routine, scheduled maintenance of a medical appliance or apparatus used by the student to sustain his or her bodily function, nor render routine, scheduled care or maintenance of exceptional bodily functions related to the student's impaired condition. The teacher shall be informed and instructed as to emergency measures that may be necessary on occasion due to the student's impaired condition. Teachers agree to render routine non-medical assistance.
MEDICALLY FRAGILE STUDENTS. A. Definition: For the purpose of the Article, the term "school health services" shall mean any act or function constituting the "practice of medicine" within the meaning of Section 17001 of the Public Health Code (MCL 333.17001).
B. No teacher shall be required to provide school health services except in an emergency situation.
MEDICALLY FRAGILE STUDENTS. No bargaining unit member shall be required to provide health services such as tracheotomy, diapering, blood test, or similar procedures to medically fragile student, except in an emergency situation.

2. Any bargaining unit member who has a medically fragile student assigned to him/her will be trained by licensed medical personnel in conjunction with the child’s parent to handle the student’s special health care needs.
3. The District agrees to supply the bargaining unit member with the necessary communication equipment to allow direct communication with appropriate licensed medical personnel (i.e., portable phone, etc.).
4. Any bargaining unit member working with any school student is covered as an agent for the school under the Board’s liability policy in the amount of $3,000,000. The insurance shall specifically cover personal liability for the employee(s) providing such services. The Association will be provided a copy of the policy and any applicable riders annually upon request.
5. The employee shall not be required to provide any supplies or equipment necessary for the services to medically fragile students.
6. If the preceding five steps are not followed, the bargaining unit member has the right to refuse to perform the health care procedures requested. The employee shall promptly notify, in person, a responsible administrator if he/she cannot perform the required procedures. Such notice should be as far in advance as possible.
MEDICALLY FRAGILE STUDENTS. A. If a teacher will be providing instructional services, excluding those typical classroom responsibilities, to a medically fragile student, the teacher or another adult who will be present when the instruction services are being provided will be advised of the steps to be taken in the event an emergency arises related to the student’s medical condition.
B. The Board shall provide the services of an individual with appropriate medical training to meet the needs of the medically fragile student enrollment.
C. On a case-by-case basis, prior to placement of a medically fragile student, the Board will provide training by a licensed health professional and other support to any teacher who will be providing instructional services to a medically fragile student. The Board shall pay all costs in connection with the training, including the time taken by the member to receive the training, calculated on a pro rata basis.
MEDICALLY FRAGILE STUDENTS. 1. Members may request additional training from the responsible nurse to assist the member in working with medically fragile students. Except in an emergency, the training request will be submitted to the coordinator so that training programs can be made available to other staff as well.
MEDICALLY FRAGILE STUDENTS. It is mutually agreed by the parties that the primary function of the teacher is to provide instruction and general care to all students in the school environment. When health care needs or custodial needs routinely require adult assistance, the IEP or 504 plan will designate an appropriate adult other than the teacher to routinely fulfill these needs. Bargaining unit members especially employed to assist multiply impaired/medically fragile students (e.g. SXI teachers) will provide required school health services under the supervision of a licensed health professional.
MEDICALLY FRAGILE STUDENTS. No bargaining unit member, except a school nurse, shall be required to provide school health services except in an emergency situation.
