Mutual Recognition of Professional Qualifications. 1. Nothing in this Article shall prevent a Party from requiring that natural persons possess the necessary qualifications and professional experience specified in the territory where the service is supplied, for the sector of activity concerned.
2. The Parties shall encourage the relevant professional bodies or respective authorities, as appropriate, in their respective territories to develop and provide a joint recommendation on mutual recognition of professional qualifications to the Committee on Investment, Trade in Services, Electronic Commerce and Government Procurement established pursuant to Article 17.2 (Specialised Committees). Such a joint recommendation shall be supported by evidence of:
(a) the economic value of an envisaged agreement on mutual recognition of professional qualifications (hereinafter referred to as "Mutual Recognition Agreement"); and
(b) the compatibility of the respective regimes, such as the extent to which the criteria applied by each Party for the authorisation, licensing, operation and certification of entrepreneurs and service suppliers are compatible.
3. Upon receipt of a joint recommendation, the Committee on Investment, Trade in Services, Electronic Commerce and Government Procurement shall, within a reasonable period of time, review the joint recommendation with a view to determining whether it is consistent with this Agreement.
4. Where, on the basis of the information provided for in paragraph 2, the joint recommendation has been found to be consistent with this Agreement, the Parties shall take necessary steps to negotiate, through their competent authorities or designees authorised by a Party, a Mutual Recognition Agreement.

A Party may recognise the education or experience obtained, requirements met, or licences or certifications granted in the territory of the other Party for the purposes of the fulfilment, in whole or in part, of its standards or criteria for the authorisation, licensing or certification of natural persons with professional qualifications.

2. Recognition referred to in paragraph 1 above, which may be achieved through harmonisation or otherwise, may be based upon an agreement or arrangement between the Parties or may be accorded unilaterally.
3. Where a Party recognises, by agreement or arrangement or unilaterally, the education or experience obtained, requirements met or licences or certifications granted in the territory of a non- Party, the Party shall accord the other Party an adequate opportunity to demonstrate that the education or experience obtained, requirements met or licences or certifications granted in the territory of the other Party should also be recognised.

3. On receipt of a joint recommendation, the [Committee] shall, within a reasonable period of time, assess its consistency with this Agreement and, in the case of a positive assessment, provide a recommendation to the Parties to start negotiating a Mutual Recognition Agreement.
Mutual Recognition of Professional Qualifications. This Chapter commits the parties to encourage their respective national authorities and professional bodies to enter A UK/EU Agreement could supplement the CETA provisions with an additional Annex which specifies – and perhaps provides a
Mutual Recognition of Professional Qualifications. In order to make it easier for nationals of the Member States to take up and pursue activities as workers and self-employed persons, the Member States shall take the necessary measures, as contained in Appendix 3 to Annex K and in the Protocol to Annex K on the free movement of persons between Liechtenstein and Switzerland, concerning the mutual recognition of diplomas, certificates and other evidence of formal qualifications, and the coordination of the provisions laid down by law, regulation or administrative action in the Member States concerning the taking up and pursuit of activities by workers and self-employed persons.
Section I: Establishment
Mutual Recognition of Professional Qualifications. 1. For the purposes of this Article, the term "professional qualifications" means formal qualifications, professional experience, professional registration or other attestation of competence.
2. Nothing in this Article shall prevent a Party from requiring that natural persons possess the necessary professional qualifications specified in the territory where the service is supplied, for the sector of activity concerned.
3. Where appropriate, the Parties shall encourage the establishment of dialogue between their relevant experts, regulators and industry bodies to share and facilitate understanding of their respective professional qualifications, registration requirements and processes, and cooperate with a view to achieving mutual recognition of professional qualifications.
4. The Parties shall encourage the relevant professional bodies or authorities in their respective territories to develop and provide a joint recommendation on mutual recognition of professional qualifications to the Committee on Investment, Services, Digital Trade, Government Procurement and Intellectual Property, including Geographical Indications, established pursuant to Article 24.4 (Specialised committees). That joint recommendation shall be supported by evidence of:
(a) the economic value of an envisaged instrument on mutual recognition of professional qualifications (hereinafter referred to as "mutual recognition instrument"); and
(b) the compatibility of the respective regimes, being the extent to which the criteria applied by each Party for the authorisation, licensing, operation and certification of professionals are compatible.
5. On receipt of a joint recommendation referred to in paragraph 4, the Committee on Investment, Services, Digital Trade, Government Procurement and Intellectual Property, including Geographical Indications, shall review the consistency of that joint recommendation with this Chapter within a reasonable period of time. Following such review, the Committee on Investment, Services, Digital Trade, Government Procurement and Intellectual Property, including Geographical Indications, may develop a mutual recognition instrument (1) and the Trade Committee may adopt it by means of decision as an annex to this Agreement.
(1) For greater certainty, such mutual recognition instruments shall not lead to the automatic recognition of qualifications but shall set, in the mutual interest of both Parties, the conditions for the competent authorities granting recognition...
Mutual Recognition of Professional Qualifications. 1. The two sides agree to take forward mutual recognition of professional qualifications in the areas of construction and related engineering and real estate, etc.
2. Relevant authorities or professional bodies of the two sides will commence exchanges on the mutual recognition of qualifications of electrical and public facility engineers and will start technical exchanges on civil engineers (geotechnical) and land surveyor.
3. The two sides will establish a working group to study and take forward matters in connection with registration and practice for construction sector professionals after they have acquired professional qualifications through mutual recognition.
4. Relevant authorities or professional bodies of the two sides will carry on the mutual recognition of qualifications for professionals in disciplines where mutual recognition agreements have been signed and conditions well met.
5. Study the matters related to carrying on the mutual recognition of qualifications between Supervision Engineers of the Mainland and Building Surveyors of Hong Kong. Relevant authorities or professional bodies of the two sides will commence the mutual recognition of professional qualifications (supervision engineering) between Supervision Engineers of the Mainland and Building Engineers of Hong Kong, and exchanges in recognition of Hong Kong Architects obtaining qualification of Supervision Engineers of the Mainland.
6. Relevant authorities or professional bodies of the two sides will take forward the technical exchanges of landscape architectural professionals between the two places.
7. The two sides will continue with the mutual recognition of professional qualifications between real estate appraisers in the Mainland and general practice surveyors in Hong Kong, and between cost engineers in the Mainland and quantity surveyors in Hong Kong.
8. Continue to promote the work on mutual recognition of professional qualifications between estate agents of the Mainland and Hong Kong.
9. To allow Hong Kong residents who have formally become members of the Hong Kong Institute of Certified Public Accountants on or before 31 March 2009 to be exempted from the "Finance and Accounting" paper when sitting for Mainland's Tax Agent qualification examination.
10. Relevant authorities and professional bodies of the two sides will study, consult, and formulate specific methodologies for mutual recognition of professional qualifications.
Mutual Recognition of Professional Qualifications. 1. The two sides shall encourage mutual recognition of professional qualifications and promote the exchange of professional talents between each other.
2. Competent authorities and professional bodies of both sides will, in consultation with each other, consider and design specific methodologies for mutual recognition of professional qualifications. Construction and Related Engineering Xxxxxx

5. Competent authorities or professional bodies of both sides will carry on the mutual recognition of qualifications for professionals in disciplines which have mutual recognition agreements signed and well-tested conditions met.

The two sides agree to take forward the work on mutual recognition of professional qualifications (supervision engineering) between Supervision Engineers of the Mainland and Building Engineers of Hong Kong and recognition of Hong Kong Architects for obtaining qualification of Supervision Engineers of the Mainland.
7. Competent authorities or professional bodies of both sides will take forward the technical exchanges of landscape architectural professionals between the two sides.
