Non-Member. ‌ When a non-member signs a CTA Engagement Contract, the non-member assigns to Equity such amounts that are equal to the deductions taken from a member’s Contractual Fee. The non-member authorizes and directs the Theatre to deduct such amounts from their weekly fees and remit same to Equity, which authorization and direction shall be effective and irrevocable for the term of the CTA Engagement Contract. In a case where the Theatre has not fulfilled its obligation in accordance with Clauses 3:01 and 3:02(A) and (B) above Equity may notify the Theatre that an Artist has not fulfilled their financial obligations to Equity, and the Theatre shall deduct the total amount or a weekly amount as instructed by Equity, from the Artist's fee which the Theatre shall promptly remit to Equity. If the Artist feels that an error has been made, the Artist shall resolve the matter directly with Equity. The Theatre shall nonetheless make the deduction as directed by Equity.

Non-Member. If an employee does not become a member of the Association during any membership year (i.e., from September 1 to the following August 31) which is covered in whole or in part by this Agreement, said employee will be required to pay a representation fee to the Association for that membership year. The purpose of this fee will be to offset the employee’s per capita cost of services rendered by the Association as majority representative.

Non-Member. Air Carrier agrees that it will maintain a security deposit (a Faithful Performance Guaranty) to secure the prompt payment of the amounts due from it each month to TBITEC pursuant to this agreement. The initial amount of the Faithful Performance Guaranty shall be three (3) months of Fees payable by Non-Member Airline to TBITEC based on the estimated annual usage of Aeronautical Equipment and TBITEC Services, and reviewed annually. Non-Member Airline covenants and agrees to maintain and cause to be maintained such Faithful Performance Guaranty. Non-Member. Any employee who is in a job classification represented by the Association but chooses not to pay dues or become a fair share member will be considered a non-member of the Association although this employee is still an employee in a classification represented by the Association. Non-members are considered bargaining unit members and the Articles and provisions of this CBA apply to them. In order to maintain consistency and application of the CBA, any dispute or discipline involving a non-member, the Association may choose to participate and/or be present regardless of whether the non-member wants the Association involved.
