PHYSICAL ABILITY. A. EXAMINATIONS The Employer reserves the right to require that an employee submit to a physical and/or psychological examination by qualified persons(s), in which case the Employer is entitled to all information relevant to job performance. If such person declares an employee is unable to fulfill his/her assigned obligations, the employee may request another examination to be performed by some other qualified person designated by the Employer. The Employer shall bear the full cost of these examinations, other than annual physicals.
PHYSICAL ABILITY. (b) Sufficient Ability and Seniority When factors (ii) and (iii) are sufficient of this job for the normal requirements, seniority shall govern.

If these two medical doctors find that the employee in question has the physical ability to return to his regular work schedule on a definite date within one year, his seniority will be accumulated to such date. The one-year will begin from the date of the second doctor’s examination. The employee must return on the first regularly scheduled workday after such definite date or lose his seniority. If two medical doctors state that the employee has the physical ability to perform his regular schedule, the employee will be so informed to return to work. If the employee does not do so, he will be removed from the seniority list. If two medical doctors state that the employee will not be able to return to his regularly scheduled work, he will be removed from the seniority list one year from the date of the second doctor’s examination. All employees, at their expense, shall show proof of freedom from active tuberculosis within fourteen (14) days of starting employment, and shall continue to do so annually, or less frequently, as required by the employer. If an employee is physically unable to perform his regular job assignment due to health reasons or other physical reasons, and, at the same time is physically able to satisfactorily perform other duties within the bargaining unit, the Employer will endeavor to assign the employee to another job assignment in line with his seniority and ability.

PHYSICAL ABILITY. Where 2 and 3 are relatively equal, the nurse’s R.N. seniority date will be the determining factor for purposes of layoff and/or recall. In the event of layoff, the Hospital will allow those nurses who are cross- trained or otherwise qualified to perform the job without additional training to displace less senior nurses in the same or a lower rated job classification; provided, however, that the more senior nurse possesses the necessary ability and qualifications to perform the work without training. Ability and qualifications to perform the work will be determined by the Hospital, subject to the grievance arbitration procedure.
