PROFESSIONAL QUALIFICATIONS AND STANDARDS. A. Amtrak will ensure that all work carried out pursuant to this PA will be done by or under the direct supervision of a qualified professional in the disciplines of Archeology, Architectural History and/or Historic Architecture who meets the relevant standards outlined in the Secretary of the Interior’s (SOI) Professional Qualifications Standards for Archeology and Historic Preservation (36 CFR § 61) (xxxx://xxx.xxx.xxx/history/locallaw/arch_stnds_9.htm). B. All archaeological investigations carried out pursuant to this PA will be undertaken in accordance with the New York State Archaeological ACHP’s Standards for Cultural Resource Investigations and the Curation of Archaeological Collections in New York State (1994) and Cultural Resources Standards Handbook (2000), the NYSHPO Archaeological Report Format Requirements (2005), and the Secretary of the Interior’s Standards for the Treatment of Historic Properties (36 CFR Part 68).
PROFESSIONAL QUALIFICATIONS AND STANDARDS. Work under the terms of this Monitoring Plan shall be carried out by or under the direct supervision of a person or persons meeting, at a minimum, the Secretary of the Interior’s (SOI’s) Professional Qualifications Standards for Archaeologists (36 CFR 61, Appendix A; Supervisory Archaeological Monitor). Additionally, all documentation, evaluation, treatment, and reporting of cultural resources as described for these procedures in this PA and its appendices will follow and meet current professional standards, including but not limited to the SOI Standards and Guidelines for Archaeology and Historic Preservation (48 Federal Register [FR] 44716).
PROFESSIONAL QUALIFICATIONS AND STANDARDS. Work under the terms of the Human Remains Protocol will be carried out by or under the direct supervision of a person or persons qualified as a biological/physical anthropologist or archaeologist, with training in osteological analysis and experience in the evaluation of human remains. The archaeologist must also meet the minimum requirements under the Secretary of the Interior’s (SOI’s) Professional Qualifications Standards (36 Code of Federal Regulations 61, Appendix A; SOI-qualified Archaeologist). Additionally, all documentation, evaluation, treatment, and reporting associated with a human remains discovery will follow and meet current professional standards, including, but not limited to, the SOI’s Standards and Guidelines for Archaeology and Historic Preservation (48 Federal Register 44716).
PROFESSIONAL QUALIFICATIONS AND STANDARDS. A. All actions required under this PA that involve the identification, evaluation, analysis, recording, treatment, monitoring, or disposition of historic properties, or that involve reporting or documentation of such actions in the form of reports, forms, or other records, will be carried out by or under the direct supervision of TBC or their consultants who meet, at a minimum, the Secretary of the Interior’s Professional Qualifications Standards (48 FR 44738-44739) (Appendix A to 36 CFR 61) in the appropriate discipline. B. When preparing all archaeological studies resulting from this PA, the preparer will take into account the ACHP’s publications, Section 106 Archaeological Guidance (2009) and Recommended Approach for Consultation on Recovery of Significant Information from Archaeological Sites (1999), as well as state-specific archaeological guidelines on best practices and procedures, as applicable, such as: Standards and Guidelines for Archaeological Investigations in Maryland (Xxxxxxx and Xxxx 1994), and Guidelines for Archaeological Investigations in the District of Columbia (1998, as amended). C. When preparing all architectural studies resulting from this PA, the preparer will take into account guidelines on specific architectural projects issued by the U.S. Department of the Interior National Park Service (such as the Bulletin entitled How to Complete the National Register Registration Form) and state-specific guidelines on best practices and procedures, as applicable, such as: Standards and Guidelines for Architectural and Historic Investigations in Maryland (MHT 2000), and How to Complete a DC State Historic Preservation Office Determination of Eligibility (DOE) Form.

  • Specifications and Standards a) All articles supplied shall strictly conform to the specifications, trademark laid down in the bidding document and wherever articles have been required according to ISI/ ISO/ other applicable specifications/ certifications/ standards, those articles should conform strictly to those specifications/ certifications/ standards. The supply shall be of best quality and description. The decision of the competent authority/ purchase committee whether the articles supplied conforms to the specifications shall be final and binding on the supplier/ selected bidder.

  • Contractor Qualifications Contractor warrants that Contractor has the necessary licenses, experience and technical skills to provide services under this Contract.

  • STAFF QUALIFICATIONS CONTRACTOR shall ensure that all individuals employed, contracted, and/or otherwise hired by CONTRACTOR to provide classroom and/or individualized instruction or related services hold a license, certificate, permit, or other document equivalent to that which staff in a public school are required to hold in the service rendered consistent with Education Code section 56366.1(n)(1) and are qualified pursuant to Title 34 of the Code of Federal Regulations sections 200.56 and 200.58, and Title 5 of the California Code of Regulations sections 3001(y), 3064 and 3065. Such qualified staff may only provide related services within the scope of their professional license, certification or credential and ethical standards set by each profession, and not assume responsibility or authority for another related services provider or special education teacher’s scope of practice. CONTRACTOR shall ensure that all staff are appropriately credentialed to provide instruction and services to students with the disabling conditions placed in their program/school through documentation provided to the CDE (5 CCR 3064 (a)).

  • Minimum Qualifications If applicable pursuant to Article 3, I acknowledge that the Bidder meets the minimum qualification requirements established for this solicitation.

  • Required Qualifications At all times during the term of the Contract, Vendor shall have available, under direct employment and supervision and/or subcontract agreement fully incorporating the terms and conditions of the Contract Documents, the required qualified and properly licensed (as applicable) personnel to properly fulfill all the terms and conditions of the Contract.

  • Arbitrator Qualifications and Powers Any arbitration proceeding in which the amount in controversy is $5,000,000.00 or less will be decided by a single arbitrator selected according to the Rules, and who shall not render an award of greater than $5,000,000.00. Any dispute in which the amount in controversy exceeds $5,000,000.00 shall be decided by majority vote of a panel of three arbitrators; provided however, that all three arbitrators must actively participate in all hearings and deliberations. The arbitrator will be a neutral attorney licensed in the State of California or a neutral retired judge of the state or federal judiciary of California, in either case with a minimum of ten years experience in the substantive law applicable to the subject matter of the dispute to be arbitrated. The arbitrator will determine whether or not an issue is arbitratable and will give effect to the statutes of limitation in determining any claim. In any arbitration proceeding the arbitrator will decide (by documents only or with a hearing at the arbitrator’s discretion) any pre-hearing motions which are similar to motions to dismiss for failure to state a claim or motions for summary adjudication. The arbitrator shall resolve all disputes in accordance with the substantive law of California and may grant any remedy or relief that a court of such state could order or grant within the scope hereof and such ancillary relief as is necessary to make effective any award. The arbitrator shall also have the power to award recovery of all costs and fees, to impose sanctions and to take such other action as the arbitrator deems necessary to the same extent a judge could pursuant to the Federal Rules of Civil Procedure, the California Rules of Civil Procedure or other applicable law. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. The institution and maintenance of an action for judicial relief or pursuit of a provisional or ancillary remedy shall not constitute a waiver of the right of any party, including the plaintiff, to submit the controversy or claim to arbitration if any other party contests such action for judicial relief.

  • Organization and Good Standing; Qualification The Seller has been duly organized and is validly existing as a limited liability company in good standing under the laws of the State of Delaware, with the power and authority to own or lease its properties and to conduct its activities as such properties are currently owned or leased and such activities are currently conducted.

  • Due Qualification and Good Standing The Borrower is in good standing in the State of Delaware. The Borrower is duly qualified to do business and, to the extent applicable, is in good standing in each other jurisdiction in which the nature of its business, assets and properties, including the performance of its obligations under this Agreement, the other Facility Documents to which it is a party and its Constituent Documents, requires such qualification, except where the failure to be so qualified or in good standing could not reasonably be expected to have a Material Adverse Effect.

  • Blue Sky Qualifications The Company will use its best efforts, in cooperation with the Underwriters, to qualify the Securities for offering and sale under the applicable securities laws of such states and other jurisdictions (domestic or foreign) as the Representatives may designate and to maintain such qualifications in effect so long as required to complete the distribution of the Securities; provided, however, that the Company shall not be obligated to file any general consent to service of process or to qualify as a foreign corporation or as a dealer in securities in any jurisdiction in which it is not so qualified or to subject itself to taxation in respect of doing business in any jurisdiction in which it is not otherwise so subject.
