Prohibited Operations and Uses. No use or operation will be made, conducted or permitted on or with respect to all or any part of any Parcel or Improvement which is obnoxious to, or out of harmony with the development or operation of the business conducted on any other Parcel or on other sites in the general vicinity of the Center. Included among the uses or operations which are prohibited because of their obvious detrimental effect on the general appearance of the Parcels and their conflict with the reasonable standards of appearance and maintenance required by Declarant and the Board, are uses or operations which produce, or are accompanied by, the following characteristics: (a) Any public or private nuisance; (b) Any use which, in the Board's sole and absolute discretion, is considered to be objectionable as an intrusion into the environment of sound, odor, visual effect or physical impact or that will disturb or tend to disturb the other Owners or Occupants or their customers or invitees in the Center; (c) Any use that produces intense glare or heat, unless such use is performed only within an enclosed or screened area in a manner such that the glare or heat emitted will not be discernible from any property line of the Parcel; (d) Any use or operation that results in a discharge or release of Hazardous Materials (defined in Section 7.7) on or under the surface of a Parcel or into the surface or ground water of the Center, unless such discharge or release is in compliance with all applicable Laws relating to Hazardous Materials; EXHIBIT F -19- PEREGRINE SYSTEMS CORPORATE CENTER [Peregrine Systems] (e) Any use or operation that results in air omissions of pollutants or contaminants unless such emissions are in compliance with all applicable laws relating to Hazardous Materials; (f) Any emission of odorous, noxious, caustic or corrosive matter or gas, whether toxic or non-toxic; (g) Any unusual litter, dust, dirt or debris, except as generated during construction of Improvements; (h) Any unusual firing, explosion or other damaging or dangerous hazard, including, but not limited to, storage, display or sale of explosives or fireworks; (i) Any mobile home or trailer court, labor camp, junk yard, stock yard, distillation of bones, or raising, storing, slaughtering or disposing of animals of any kind; (j) Any drilling for, excavation, refining and/or removal of earth materials, oil, gas, hydrocarbon substance, water, geothermal steam or any other subsurface substance of any nature whatsoeve...
Prohibited Operations and Uses. No site shall be used as a junk yard, stock yard, or xxxxxxxxx yard or for commercial excavation of building or construction materials, fat rendering or distillation of bones, dumping, disposal, incineration or reduction of garbage, sewage, offal, dead animals or refuse, or the smelting of iron, tin, zinc or other ores or the prospecting or drilling for natural gas, oil or like substances, except with prior written permission of the Architectural Control Committee, and then only in such manner as will not materially inconvenience other Owners or materially depreciate the value of adjacent property.
Prohibited Operations and Uses. The following operations and uses ------------------------------ shall not be permitted on any of the Property subject to these Restrictions: (a) Hazardous waste disposal or permanent storage; (b) Labor camps; (c) Trailer courts, mobile home courts, camping or recreations vehicles; (d) Drilling for and/or removal of oil, gas or other hydrocarbon substances; (e) Junk yards or landfills. (f) Mining or commercial excavation of building or construction materials unless utilized in on-site construction; (g) Distillation of bones; (h) Dumping, disposal, incineration or reduction of garbage, sewage, offal, dead animals or refuse; (i) Fat rendering; (j) Stockyard, raising, or xxxxxxxxx of animals; (k) Tanning or curing of leather goods; (l) Freight terminals or truck terminals; (m) The manufacture, sale, rental, repair or storage of heavy equipment, buses, trucks, trailers, automobiles, recreational vehicles and mobile or trailer homes outside of any building; (n) Unscreened outdoor storage or outdoor fabrication of any machinery, parts, material, supplies or products; (o) Junkyards, scrap metal yards and any use involving the storage or processing or wrecked or junked motor vehicles or materials; (p) Overnight parking of campers, mobile homes, boats, trailers or motor homes, except those of an Owner's contractors and subcontractors during the period of construction improvements; (q) Erection and maintenance of structures of a temporary nature, except those of an Owner's contractors and subcontractors during the period of construction of improvements; (r) Jails, prisons, labor camps, penal, detention or correction facilities or farms; (s) Cemetery or mausoleum; (t) Racetracks, raceways and drag strips; (u) Massage parlors, topless night clubs or similar business operations; (v) Refining of petroleum or its products; (w) Smelting of iron, tin, zinc or other ores; (x) Petroleum storage, other than as may be reasonably necessary for the occupants' normal business operations, but the occupants may not engage in petroleum storage as a primary purpose of its business; (y) Fertilizer manufacture; (z) Coal or wood yard; (aa) Manufacture or storage of explosives or fireworks; (bb) Auction, public sale, flea market, yard sale or other similar operations or other auction house operation; (cc) Bingo or other gambling or game of chance operations; (dd) Commercial or non-commercial recreational, athletic, sporting or racing activities; (ee) Entertainment, theatrical presentatio...
Prohibited Operations and Uses. Operations and uses not expressly allowed by zoning operations and uses not expressly allowed by the Development Order or any other applicable Governing Laws and the following operations and uses are prohibited within Bayside Concourse: (a) The erection, operation or use of drilling equipment for or removal of oil, gas, hydrocarbon substances, minerals, or water (except that the Developer and the Association may draw and use water). (b) Residential uses other than hotel uses. (c) Trailer or mobile home courts. (d) Junkyards. (e) Commercial excavation of building or construction materials. (f) Dumping, storage, disposal, incineration, or reduction of offal and dead animals. (g) Dumping, storage, disposal, incineration or reduction of garbage, refuse, sewage, hazardous wastes or toxic materials, except to the extent that such activity is incidental to an operation and use permitted hereunder, and that such incidental activity is in compliance with all federal, state and local laws, rules and regulations relating thereto. (h) Stockyard or xxxxxxxxx of animals. (i) Recycling or refining of petroleum or its by-products. (j) Recycling or smelting of iron, aluminum, tin, zinc, or other ores. (k) The raising, breeding, grazing, keeping or slaughtering of animals, livestock or poultry of any kind. (l) Sale or storage of explosives. (m) The use of machinery, devices or apparatus which causes interference with telephone, television, cable television, or radio reception within Bayside Concourse In the event an Owner wishes to use a Building Site for any purpose not expressly permitted or prohibited herein, the Owner shall submit the proposed use to the Board and if approved by the Board, in their sole discretion, Owner must still obtain approval from all applicable governmental authorities with respect to such use pursuant to Section 10.02 herein.

  • Permitted and Prohibited Uses 1.1. The Data may only be used for linguistic education and research, including but not limited to information retrieval, document understanding, machine translation or speech recognition. 1.2. User shall not publish, retransmit, display, redistribute, reproduce or commercially exploit the Data in any form, except that User may include limited excerpts from the Data in articles, reports and other documents describing the results of User’s linguistic education and research.

  • Contractual and Operational Compliance Audits (a) ICANN may from time to time (not to exceed twice per calendar year) conduct, or engage a third party to conduct, contractual compliance audits to assess compliance by Registry Operator with its representations and warranties contained in Article 1 of this Agreement and its covenants contained in Article 2 of this Agreement. Such audits shall be tailored to achieve the purpose of assessing compliance, and ICANN will (a) give reasonable advance notice of any such audit, which notice shall specify in reasonable detail the categories of documents, data and other information requested by ICANN, and (b) use commercially reasonable efforts to conduct such audit during regular business hours and in such a manner as to not unreasonably disrupt the operations of Registry Operator. As part of such audit and upon request by ICANN, Registry Operator shall timely provide all responsive documents, data and any other information reasonably necessary to demonstrate Registry Operator’s compliance with this Agreement. Upon no less than ten (10) calendar days notice (unless otherwise agreed to by Registry Operator), ICANN may, as part of any contractual compliance audit, conduct site visits during regular business hours to assess compliance by Registry Operator with its representations and warranties contained in Article 1 of this Agreement and its covenants contained in Article 2 of this Agreement. ICANN will treat any information obtained in connection with such audits that is appropriately marked as confidential (as required by Section 7.15) as Confidential Information of Registry Operator in accordance with Section 7.15.

  • Prohibited Transactions and Activities None of the Depositor, the Servicer or the Trustee shall sell, dispose of or substitute for any of the Mortgage Loans (except in connection with (i) the foreclosure of a Mortgage Loan, including but not limited to, the acquisition or sale of a Mortgaged Property acquired by deed in lieu of foreclosure, (ii) the bankruptcy of the Trust Fund, (iii) the termination of the Trust Fund pursuant to Article IX of this Agreement, (iv) a substitution pursuant to Article II of this Agreement or (v) a purchase of Mortgage Loans pursuant to Article II or III of this Agreement), nor acquire any assets for any REMIC created hereunder (other than REO Property acquired in respect of a defaulted Mortgage Loan), nor sell or dispose of any investments in the Collection Account or the Distribution Account for gain, nor accept any contributions to any REMIC created hereunder after the Closing Date (other than a Qualified Substitute Mortgage Loan delivered in accordance with Section 2.03), unless it has received an Opinion of Counsel, addressed to the Trustee (at the expense of the party seeking to cause such sale, disposition, substitution, acquisition or contribution but in no event at the expense of the Trustee) that such sale, disposition, substitution, acquisition or contribution will not (a) affect adversely the status of any of any REMIC Regular Interest created hereunder as a REMIC or (b) cause any REMIC Regular Interest created hereunder to be subject to a tax on “prohibited transactions” or “contributions” pursuant to the REMIC Provisions.

  • Procedural and Operational Requirements By accepting and using the Financial Assistance awarded under this Agreement and for this Program Element, LPHA agrees to conduct the following activities in accordance with the indicated procedural and operational requirements: a. LPHA must operate its Communicable Disease program in accordance with the Requirements and Standards for the Control of Communicable Disease set forth in ORS Chapters 431, 432, 433 and 437 and OAR Chapter 333, Divisions 12, 17, 18, 19 and 24, as such statutes and rules may be amended from time to time. b. LPHA must use all reasonable means to investigate in a timely manner all reports of Reportable Diseases, infections, or conditions. To identify possible sources of infection and to carry out appropriate control measures, the LPHA Administrator shall investigate each report following procedures outlined in OHA’s Investigative Guidelines or other procedures approved by OHA. OHA may provide assistance in these investigations, in accordance with OAR 333-019-0000.
