Project Monitor. The Project shall be monitored by the Sponsor through the Director of the Xxxxxxx-Xxxxxxxxx County Human Services Department (“Project Monitor”). In the event of noncompliance with this Grant Contract by Grantee, the Project Monitor shall report said noncompliance to the Lancaster County Board for further action which may include termination of the Grant Contract.

The Subrecipient shall provide County and/or Project Monitor with such financial and program service reports as the County and/or Project Monitor shall deem necessary during the Term. Based upon these reports and upon the Project Monitor’s observations of the operation of the Project, the Project Monitor shall submit reports required by County, containing the Project Monitor’s review of the progress of the Project. In the event of noncompliance with this Subaward Contract by Subrecipient, the Project Monitor shall report said noncompliance to the Lancaster County Board for further action which may include termination of the Subaward Contract.
Project Monitor. The project monitor shall perform, including, but not limited to, the following duties: a. Conduct pre-existing damage survey. b. Conduct pre-abatement area monitoring to establish baseline fiber concentration. c. Conduct pre-abatement inspection of work area engineering controls. d. Review contractor/worker training/medical documentation. e. Maintain a daily log of all job site activity detailing the contractors’ progress, performance and conformance with regulations and all individuals working on the remediation activities. f. Conduct daily monitoring of the areas where the work is being Performed. g. Conduct post-abatement visual inspections. h. Conduct final air clearance monitoring prior to re-occupancy. i. Document damage to facility components during abatement. j. Identify and manage corrective measures as needed during abatement. k. Prepare final abatement compliance report documenting all project activity.

The Sponsor and its designated representative shall be provided such financial and program service reports as they shall deem necessary during the contract period. Based upon these reports and upon her observations of the operation of the project, the Grantee shall submit reports required by Sponsor, containing her review of the progress of the project. In the event of noncompliance with this Agreement by Grantee, the Project Monitor shall report said noncompliance to the Lancaster County Board for further action which may include termination of the agreement.
Project Monitor. 3.1 It is agreed that Xxxx. Xxxx X Axford and those designated by MANNATECH may, at mutually agreeable times during the Study and for a reasonable time after completion or early termination of the Study, arrange with the Principal Investigator or his/her designee: 3.1.1 to examine and inspect at regular business hours, SGUL facilities required for performance of the clinical trial; and 3.1.2 subject to applicable patient confidentiality considerations, to inspect, audit and to copy or have copied, all data and work product relating to the Study conducted under this Agreement and to inspect and make copies of all data necessary for MANNATECH to confirm that the Study is being conducted in conformance with the Protocol and in compliance with all applicable legal and regulatory requirements, including without limitation, any applicable requirements of the United States Food and Drug Administration or equivalent English law.

Project monitors shall be listed in the American Industrial Hygiene Association’s Asbestos Analysts Registry. Project monitors shall perform on-site analysis of up to twelve (12) area air samples per day by Phase Contrast Microscopy (PCM). Sample collection and analysis in excess of twelve (12) analyses will require approval of the Client Agency representative. For re-occupancy clearance sampling administered by PCM, the Contractor shall Perform on- site analysis of each sample by PCM to determine successful completion of abatement in accordance with DPH clearance criteria.

For re-occupancy clearance sampling administered by Transmission Electron Microscopy (TEM) the Contractor shall Perform laboratory analysis of each sample to determine successful completion in accordance with DPH clearance criteria. If TEM analysis cannot meet the re-occupancy criteria, no further analysis of remaining samples is to be conducted until the area has been re-cleaned by the Contractor and re-air sampled. d. Immediately upon receipt of favorable re-occupancy clearance test results, the project monitor shall submit in writing to the Client Agency representative documentation stating the area has successfully achieved the re-occupancy clearance requirements as set forth in the DPH regulations. The Client Agency representative reserves the right to designate other additional notification requirements. A copy of the test results is to be attached to the documentation and posted on site. e. At the conclusion of all work, the project monitor shall provide three copies of the final close- out report, to the Client Agency representative. This report is to include all project documentation including the waste manifest and certificate of disposal if requested.
Project Monitor. (a) The Project Monitor shall have no liability in connection with this Development Contract to the Developer, and the Developer hereby releases the Project Monitor from all costs, damages, losses or other amounts or claims of whatsoever nature or kind that may be suffered or incurred by either Party as a result of the actions, inaction, decisions, approvals and reports of, and other activities undertaken by, the Project Monitor in connection with this Development Contract. (b) Neither Party nor the Change Funder may bring a claim against the Project Monitor for any decision, recommendation, finding or determination of the Project Monitor made in relation to or as contemplated by Section 4.2 or 7.1(e) . (c) For greater certainty, nothing in this Section 13.2 is intended to limit the liability of the estate of Urbancorp (Leslieville) Developments Inc. for any breach by the Owner under this Development Contract. Other than claims against the Construction Receiver for its gross negligence or wilful misconduct, all claims against the Owner or the Construction Receiver may only be brought against the estate of Urbancorp (Leslieville) Developments Inc. (d) The provisions of this Section 13.2 are intended for the benefit of the Construction Receiver and the Project Monitor, as the case may be, as a third party beneficiary and may be relied upon by the Construction Receiver and the Project Monitor, as the case may be, notwithstanding that it is not a party to this Development Contract.
Project Monitor. An individual licensed by the Commonwealth of Virginia whose duties and functions include, but are not limited to, observing and monitoring the activities of an asbestos abatement contractor or RFS contractor on asbestos projects to determine that proper work practices are used and compliance with all federal, state and local laws and regulations are maintained.
