RAILROAD REQUIREMENTS. 1.02.01 Contractor shall comply with the rules and regulations of Railroad and the instructions of the Railroad's representatives in relation to the proper manner of protecting the tracks and property of Railroad and the traffic moving on such tracks, as well as the wires, signals, and other property of Railroad, its tenants or licensees, at and in the vicinity of the work area during construction.

RAILROAD REQUIREMENTS. The tenant must notify the Railway at least seven (7) days before beginning construction on DEPARTMENT owned right of way. The TENANT shall, promptly pay the Railway for the costs incurred by the railroad for such items as a flagman or inspection. RAILROAD REQUIREMENTS. The Contractor shall notify Xx. Xxxxx X. Smith, Manager Industry and Public Projects, 0000 Xxxxxxxx Xxxxxx, Roseville, CA 95747, Telephone (000) 000-0000, and the Engineer, in writing, at least 10 working days before performing any work on, or adjacent to the property or tracks of the Railroad. The Contractor shall cooperate with the Railroad where work is over or under the tracks, or within the limits of Railroad property, to expedite the work and avoid interference with the operation of railroad equipment. The Contractor shall comply with the rules and regulations of Railroad or the instructions of its representatives in relation to protecting the tracks and property of Railroad and the traffic moving on such tracks, as well as the wires, signals and other property of Railroad, its tenants or licensees, at and in the vicinity of the work during the period of construction. The responsibility of the Contractor for safe conduct and adequate policing and supervision of its work at the job site shall not be lessened or otherwise affected by the presence at the work site of Railroad representatives, or by the Contractor’s compliance with any requests or recommendations made by Railroad representatives. The Contractor shall perform work to not endanger or interfere with the safe operation of the tracks and property of Railroad and traffic moving on such tracks, as well as wires, signals and other property of Railroad, its tenants or licensees, at or in the vicinity of the work. The Contractor shall take protective measures to keep railroad facilities, including track ballast, free of sand or debris resulting from his operations. Damage to railroad facilities resulting from Contractor's operations will be repaired or replaced by Railroad and the cost of such repairs or replacement shall be deducted from the cContractor's progress and final pay estimates. The Contractor shall contact the Railroad's "Call Before You Dig" at least 48 hours prior to commencing work, at 0-000-000-0000 during normal business hours (7:00 a.m. to 9:00 p.m. Central Time, Monday through Friday, except holidays – also a 24 hour, 7-day number for emergency calls) to determine location of fiber optics. If a telecommunications system is buried anywhere on or near railroad property, the Contractor will coordinate with the Railroad and the Telecommunication Company(ies) to arrange for relocation or other protection of the system prior to beginning any work on or near Railroad Property.   • Related Requirements If the coverages have an expiration or renewal date occurring during the time for performance of this Agreement, Subrecipient must furnish renewal certificates to the email address and/or website location specified by the City. All deductibles or self- insured retentions on referenced insurance coverages must be borne by Subrecipient. Subrecipient hereby waives and agrees to require their insurers to waive their rights of subrogation against the City of Chicago, its employees, elected officials, agents or representatives. The coverages and limits furnished by Subrecipient in no way limit Subrecipient's liabilities and responsibilities specified within this Agreement or by law. Any insurance or self- insurance programs maintained by the City of Chicago do not contribute with insurance provided by Subrecipient under this Agreement. The required insurance to be carried is not limited by any limitations expressed in the indemnification language in this Agreement or any limitation placed on the indemnity in this Agreement given as a matter of law. If Subrecipient maintains higher limits than the minimums shown above, the City requires and shall be entitled to coverage for the higher limits maintained by Subrecipient. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the City. If Subrecipient is a joint venture or limited liability company, the insurance policies must name the joint venture or limited liability company as a named insured. Subrecipient must require all subcontractors to provide the insurance required in this Agreement, or Subrecipient may provide the coverages for subcontractors. All subcontractors are subject to the same insurance requirements of Subrecipient unless otherwise specified in this Agreement. Subrecipient must ensure that the City is an additional insured on the insurance required from Subcontractors. If Subrecipient or Subcontractors desire additional coverages, the party desiring additional coverages is responsible for the acquisition and cost of such additional protection. Notwithstanding any provisions in this Agreement to the contrary, the City of Chicago’s Risk Management Department maintains the right to modify, delete, alter or change these requirements.

  • ORDERING REQUIREMENTS Eligible Purchasers shall order Goods and/or Services from this Master Contract, consistent with the terms hereof and by using any ordering mechanism agreeable both to Contractor and Purchaser but including, at a minimum, a purchase order.
